## MUNICIPALITY OF MINITONAS-BOWSMAN BY-LAW No. 4/2018 Being a By-law of the Municipality of Minitonas-Bowsman to provide for regulating or preventing of noise. WHEREAS the Municipality of Minitonas-Bowsman is authorized to pass a by-law regulating or preventing certain noises by Section 233 of The Municipal Act; NOW THEREFORE be it enacted as a By-law of the Municipality of Minitonas-Bowsman as follows: 1. (a) "Wrongful Noise" including but not limited to; any noise unnecessarily or unreasonably caused whether as to degree of noise or at all created within the Urban area limits of the 2. Municipality of Minitonas-Bowsman by night or by day including: The ringing of bells other than church bells or school bells, the blowing of horns, the beating of drums, shouting or screaming or otherwise disturbing the peace, the firing of firearms, the firing of or setting off of fireballs, squibs, crackers, fireworks; the operating of any vehicle other than an "industrial machine" with an internal combustion engine that is not equipped with an adequate muffler, the operation of anything with the intent to cause unnecessary or unreasonable noise, ie "Jake Brakes", the operation of anything that causes noise because of bad maintenance, bad repair, or improper operation (as for instance spinning motor vehicle 3. wheels to make tires squeal on the pavement.) 4. (b) "Urban area limits" means Minitonas and Bowsman. 2. Every person is prohibited from making a wrongful noise in the Municipality of MinitonasBowsman. 3. No person shall operate an industrial machine between the hours of 10:00 p.m. and 7:00 a.m. without written permit issued under the authority of the Municipality of MinitonasBowsman. 4. No person who is in lawful control of a place shall permit any wrongful noise to be made in that place, or any noise to be made by an industrial machine during the prohibited period of the day. 5. Any person found guilty of a breach of any provision of this by-law shall be liable upon summary conviction to a fine not exceeding fifty ($50.00) dollars or to imprisonment for a period not exceeding thirty days or to both such fine and imprisonment. 6. By-law No. 213 of the former Village of Minitonas is hereby repealed.
