## THE MUNICIPALITY OF RHINELAND ## BY-LAW 2023-02 A by-law of The Municipality of Rhineland authorizing the erection of stop, yield and traffic control signs on certain intersections. WHEREAS Section 79 of The Highway Traffic Act provides in part as follows: - 79(1) A traffic authority may erect a "stop" sign at an intersection or level railway crossing within the area over which the traffic authority has jurisdiction. 79(2) Every "stop" sign erected under subsection (1) shall be reflectorized and so placed as o be illuminated by the headlights of an approaching vehicle 79(5) A traffic authority may erect, on or adjacent to any highway over which it has jurisdiction such other traffic control devices, in addition to those specifically authorized or required under this Act, as are necessary or advisable for the control of traffic in a manner required, authorized, or permitted under this Act, or as are necessary to give effect to any by-law or order that the traffic authority has power to make. AND WHEREAS Section 80 of The Highway Traffic Act provides that the xistence on a highway of a sign, marking, poster, notice, or traffic control device such as is required or permitted by this Act, purporting to regulate the use of the highway in any raise the prima facia presumption that the sign, marking, poster, notice, or traffic control device duly was duly erected and maintained by the proper authority pursuant to the power given by this Act and in accordance therewith; AND WHEREAS The Municipality of Rhineland is the traffic authority for streets and certain highways within its boundaries; AND WHEREAS it is deemed to be in the best interest of the inhabitants of The Municipality of Rhineland that "stop"," yield", "pedestrian crossing" and "traffic control" signs be erected at certain intersections; NOW THEREFORE the Council of The Municipality of Rhineland in regular session assembled hereby enacts as follows: 1. That the Municipality of Rhineland agrees to erect "stop"," yield", "pedestrian crossing" and "traffic control" signs at intersections and on roads as indicated and set out in Schedule "A" as amended and attached hereto. 2. That all "stop"," yield", "pedestrian crossing" and "traffic control" signs erected shall be reflectorized pursuant to the requirements of The Highway Traffic Act. 3. That the Reeve and Chief Administrative Office of The Municipality of Rhineland are hereby authorized, empowered and directed to do all acts as may be necessary to enact the terms of this by-law. That the Municipality of Rhineland By-Law 2020-08 be rescinded. DONE AND PASSED by the Council of The Municipality of Rhineland in regular session assembled this 22nd day of February, 2023 A.D.
