## Purpose of the Policy:
The purpose of this policy is to ensure public safety and provide guidelines for the Municipality and property owners/occupants with respect to the care of trees that are located along public streets and other rights of way within the urban and cluster areas of the Municipality of Roblin.
## Responsibilities:
## Administrative Staff:
To ensure that notification is provided to property owners of the requirement to trim or remove trees/tree branches from Municipal Property.
## Public Works Staff:
To remove any trees/tree branches that impede vehicular/pedestrian traffic, signage and intersection sight lines immediately.
## Procedure:
## Municipal Property:
The Municipality is responsible for the ongoing maintenance of all trees/shrubs that are located on Municipal property including trimming of any projections over public sidewalks, walkways, or any public street or lane way beyond the property line. All branches that interfere with sight lines at stop signs or roads will be removed by the Municipal Staff.
## 2. Private Property:
The owner or occupant of property with private trees or shrubs is responsible for all trimming of branches that overhang onto private property or Municipal property.
Where there are obstructions caused by the growth of trees/shrubs that are located on private property which abuts Municipal property including any impediment to street lighting, vehicular/pedestrian traffic, signage, and intersection sight lines, the property owner will be responsible for trimming. This maintenance will also apply to those private trees/shrubs whose roots may damage sidewalks, public streets and any infrastructure related to the provision of public utilities.
3. The property owner may be notified by the Municipal Office to rectify these impediments and the property owner will have 10 days to be in full compliance. The Municipality reserves the right to take immediate action to trim and/or remove any impediments to vehicular/pedestrian traffic, signage and intersection sight lines.
4. Trees/shrubs will only be removed if they are deemed to be an impediment to public safety or property due to:
- Location,
- Physical condition (i.e. broken limbs), and/or
- Health (i.e. diseased)
6. In instances where the Municipality has to complete the work, there will be a minimum charge of $80.00 for the first hour, or part thereof, with an additional charge of $25.00 per hour for any work over one hour, plus GST. If the Municipality has to arrange to have the work completed, all associated costs will be the responsibility of the property owner. Costs may be collected by the Municipality in the same manner as a tax may be collected.
