## MUNICIPALITY OF WESTLAKE-GLADSTONE
## I TRAFFIC BYLAW BY-LAW NO. 2025-13
BEING A BYLAW OF THE MUNICIPALITY OF WESTLAKE-GLADSTONE PROVIDING FOR THE CONTROL AND REGULATION OF TRAFFIC WITHIN URBAN COMMUNITIES IN THE MUNICIPALITY OF WESTLAKEGLADSTONE
WHEREAS section 90(1) of Part IV of Division 1 of the Highway Traffic Act States in Part as follows: 90(1) The traffic authority may classify vehicles according to dimensions, design, weight, kind of weight carries, or otherwise for any class or all classes of vehicles and may make rules or by-law supplementary to or in addition to but not contrary to any provisions of this act or regulations made there under and applicable on highway or within any area over which the traffic authority has jurisdiction with respect
- a. Parking, stopping and standing of vehicles;
- b. Obstruction of traffic;
- c. One way street or one way roadways;
- d. Prescribing routes of travel;
- e. Pedestrian traffic;
- f. Loading zones and bus stops;
- g. Safety zones;
- h. Preventing drivers of motor vehicles from making unnecessary noise in the vicinity of a hospital;
9. Preventing turning otherwise than at intersections and otherwise regulating such turning;
- j. Traffic on streets in the vicinity of public schools;
11. Traffic at intersections;
1. Traffic lanes;
- n. The directions that vehicles must follow on certain streets and roadways and the imposed penalties for a violation of any such rule or by-law.
AND WHEREAS it is deemed expedient and in the best interest of the Municipality of WestLakeGladstone to provide for the control and regulation of traffic within the boundaries of the Town of Gladstone and urban settlement centers of Plumas, Langruth and Westbourne;
NOW THEREFORE the Council of the Municipality of WestLake-Gladstone in a meeting duly assembled, enacts as follows:
## 1. Short Title
This by-law may be referred to as the "Municipality of WestLake-Gladstone Traffic By-Law".
## 2. Definitions
Unless otherwise expressly provided or unless the context otherwise requires, words and expressions in this by-law have the same meaning as the same words and expressions in the Highway Traffic Act of the Province of Manitoba and amendments thereto:
- a. Back lane: a highway other than a street or a provincial trunk road;
- b. Centre lane: means the centre of a roadway measured from the curbs or, in the absence of curbs, from the edges of the roadway;
- c. Commercial truck: a motor vehicle or semi-trailer truck that is not a delivery car and that is constructed or adapted to carry goods, wares and merchandise, freight or commodities but not passengers or luggage;
- d. Designated parking space: means a space designated by signs or pavement markings as being for the sole use of vehicles displaying a permit that is located:
- i. On a highway
- ii. In a public parking lot or facility, or
- e. Driveway (approach): that portion of a curb, sidewalk or boulevard improved or designed for the passage of vehicular traffic;
- f. Emergency vehicle:
- i. A vehicle used by a police force,
- ii. A vehicle used by a fire department,
- ili. A vehicle used by an ambulance service,
- iv. An authorized emergency vehicle,
- v. A vehicle used to respond to emergencies and operated under the authority of a government emergency organization,
- vi. A vehicle used for the purpose of maintaining a public utility and designated as an emergency vehicle by a traffic authority, or

- vii. A vehicle not ordinarily used for emergency purposes that is operated by a volunteer, part- time or on-call firefighter or emergency medical responder for the purpose of responding to a fire, medical or other emergency;
- g. Loading zone: shall mean a designated portion of a street adjacent to the curb or road edge, reserved for the exclusive use of vehicles, during the loading or unloading of passengers or goods and includes an area which a vehicle may be stopped for a 15(fifteen) minute period;
- h. Mobility vehicle: means a device or vehicle which is specifically manufactured or modified for operation by a physically disabled person and which has a maximum speed capability of more than 15 kilometres per hour but not more than 50 kilometres per hour;
4. Motor vehicle: means a vehicle not run upon rails that is designed to be self-propelled, including motorcycles, mopeds, snowmobiles, electric vehicles, golf carts and off-road vehicles, but excluding farm tractors and self-propelled implements;
- j. Peace Officer: means any member of the Royal Canadian Mounted Police and any other police officer, or other person employed for the preservation and maintenance of the public peace, and any person lawfully authorized to direct or regulate traffic, or to enforce this Act or traffic by-laws or regulations;
- k. Permit: shall mean a valid physically disabled person's parking permit issued under Section 124.3 of The Highway Traffic Act;
- I. Stop: as applied to a vehicle whether occupied or not, means when required, to cause the vehicle to cease to move, and when prohibited to case the vehicle to cease to move, except when necessary conflict with other traffic or in compliance with the directions of a peace officer or a traffic control device and "stopping" has a corresponding meaning;
- m. Street: means any public right of way, including a highway or Provincial Highway, providing primary access to abutting property, used as a public thoroughfare for vehicles and pedestrians including streets under construction or repair, and where he context so requires, includes the whole of the area between the boundaries of the streets as recorded in the Land Titles Office and includes all lanes and alleys;
- n. Traffic and traffic control device: means a sign, signal, light, marking or device, consistent with this Act, placed or erected by a traffic authority for the purpose of regulating, warning or guiding traffic.
## 3. Traffic at Intersections
- a. That all traffic at intersections shall be controlled in accordance with the installed traffic control devices.
- b. That except where otherwise directed by a peace officer, every person shall obey the instructions or directions on, or conveyed by means of, an applicable traffic control device.
## 4. Parking, Stopping and Standing of Vehicles
Parking, stopping and standing of motor vehicles within the Town of Gladstone and urban settlement centres of Plumas, Langruth and Westbourne is prohibited as follows:
- a. In front of the entrance to a back lane or driveway;
- b. On any sidewalk;
- c. Beside any vehicle which is stopped, standing or parked parallel to the edge or curb of that street;
- d. Within 3 (three) metres from the point on the curb or the edge of the roadway immediately opposite a fire hydrant;
- e. No person shall stop, stand or park a motor vehicle in a designated disabled persons parking space or in any manner that makes a designated parking space inaccessible, unless the vehicle displays a permit in accordance with The Highway Traffic Act and the regulations under that act.
- f. In a designated loading zone for more than a 15 minute period.
- g. On all streets during active snow removal operations.
## 5. Parking of large trucks, buses, trailer and recreational vehicles
- a. No person shall park or leave a semi-trailer detached from the truck tractor on any street within the Town of Gladstone, urban settlement centres of Plumas, Langruth and Westbourne or a Municipal parking lot.
- b. No person shall park or leave any recreational trailer, including a motor home, a bus which has been converted into a motor home, a fifth wheel whether or not it is connected to a motor vehicle, or any other recreational vehicle on any street for more than 72 (seventy two hours.

## 6. Golf carts and other small electric motor vehicles
- a. A minimum of a Class 5 driver's license is required. Proof of license and liability insurance must be carried and provided to an officer upon request;
- b. Golf carts and other small electric motor vehicles are allowed on roadways with speed limits of 50km/hr or less. They cannot operate on roadways with higher speed limits, except to cross them;
- c. Must be operated during daylight hours (half hour before sunrise to half an hour after sunset). They must also be equipped with a slow-moving vehicle sign;
- d. Must be operated in a safe and responsible manner, adhering to all rules of the road Impaired and reckless driving laws apply to golf carts and other small electric motor vehicles.
## 7. Engine Retarder Breaking System
The use of engine retarder breaking system is prohibited within described limits in the Municipality of WestLake-Gladstone except in an emergency where it is necessary in the circumstances to use such brakes:
- a. Within Town of Gladstone limits;
- b. PTH #16 in the vicinity of Gladstone, being from the easterly limit of the NW ¼ OF Section 20, Township 14, Range 11, to the westerly limit of NW ¼ of Section 30, Township 14, Range 11 (Schedule "A");
- c. Within LUD and/or settlement centre of Plumas limits;
- d. PR260 in the vicinity of Plumas, being from the southerly limit of NE ¼ of Section 20, Township 16, Range 12, to the northerly limit of NE ¼ Section 20, Township 16, Range 12 (Schedule "A");
- e. Within settlement centre of Langruth limits;
- f. PTH 50 in the vicinity of Langruth, being from the southerly limit of NW ¼ of Section 20, Township 16, Range 9, to the northerly limit of NE ¼ Section 20, Township 16, Range 9 (Schedule "A");
- g. Within settlement centre of Westbourne limits;
- h. PTH 16 in the vicinity of Westbourne, being from the easterly limit of SW ¼ of Section 25, Township 13, Range 13, to the westerly limit of NE ¼ Section 26, Township 13, Range 9 (Schedule "A");
- i. In the vicinity of a hospital, personnel care home, school or within urban area limits previously listed.
## 8. Penalties
Any person who contravenes, violates, disobeys or refuses, omits, neglects or fails to comply with any provision of this by-law is guilty of an offence and is liable on summary conviction, to a fine not exceeding $500 (five hundred dollars). Where the violation of any of the provisions of this by-law continue for more than one day, the person or firm is guilty of a separate offence for each day that it continues.
## 9. Repeal
THAT Town of Gladstone By-Law No. 9-2007 be hereby repealed upon the passing of this by-law.
THAT Rural Municipality of Westbourne By-Law No. 1972 be hereby repealed upon the passing of this by-law.
