THE TOWN OF NEEPAWA
BY-LAW NO. 3155-16
BEING A BY-LAW OF THE TOWN OF NEEPAWA PROVIDING FOR THE CONTROL AND REGULATION
OF TRAFFIC WITHIN THE TOWN OF NEEPAWA
WHEREAS SECTION 90 (1) of Part IV of Division 1 of the Highway Traffic Act States in Part as follows:
90 (1) The Traffic Authority may classify vehicles according to dimensions, design, weight, kind of weight carried, or
otherwise for any class or all classes of vehicles and may make rules or by-law supplementary to or in addition to but not
contrary to any provisions of this act or regulations made there under and applicable on highways over which the traffic
authority has jurisdiction or within any area over which the traffic authority has jurisdiction with respect to:
a. Parking, stopping and standing of vehicles;
b. Obstruction of traffic;
c. One way street or one way roadways;
d. Prescribing routes of travel;
e. Pedestrian traffic;
f.
Loading zones and bus stops;
g. Safety zones;
h. Preventing drivers of motor vehicles from making unnecessary noise in the vicinity of a hospital;
i.
Preventing turning otherwise than at intersections and otherwise regulating such turning;
j.
Traffic on streets in the vicinity of public schools;
k. Traffic at intersections;
l.
Traffic lanes;
m. The directions that vehicles must follow on certain streets and roadways and the imposed penalties for a
violation of any such rule or by-law by by-law.
AND WHEREAS it is deemed expedient and in the best interest of the Town of Neepawa to provide for the control
and regulation of traffic within the boundaries of the Town of Neepawa;
NOW THEREFORE BE IT AND IT IS HEREBY ENACTED AS A BY-LAW OF THE TOWN OF NEEPAWA IN
COUNCIL DULY ASSEMBLED AS FOLLOWS:
I.
Short Title
This By-law may be referred to as the "Town of Neepawa Traffic By-Law"
II.
Definitions
1. Unless otherwise expressly provided or unless the context otherwise requires, words and expressions in
this By-law have the same meaning as the same words and expressions in the Highway Traffic Act of the
Province of Manitoba and amendments thereto:
a. Back lane - a highway other than a street or a provincial trunk road
b. Centre lane - means the centre of a roadway measured from the curbs or, in the absence of
curbs, from the edges of the roadway;
c. Chief Administrative Officer - shall mean the Chief Administrative Officer of the Town of
Neepawa or their designate.
d. Commercial truck - a motor vehicle or semi-trailer truck that is not a delivery car and that is
constructed or adapted to carry goods, wares and merchandize, freight or commodities but not
passengers or luggage.
e. Designated parking space - means a space designated by signs or pavement markings as
being for the sole use of vehicles displaying a permit and that is located:
i. On a highway
ii. In a public parking lot or facility, or
iii. In a private parking lot or facility to which the public has access
f.
Driver - a person who drives or is in actual physical control of a vehicle and includes any body
corporate in respect of vehicles driven by its officers, employees, or agents in the course of
their employment, and the expression "driver" and "driving" have a corresponding meaning.
g. Driveway (approach) - that portion of a curb, sidewalk or boulevard improved or designed for
the passage of vehicular traffic.
h. Drop-off zone - shall mean the area in which a vehicles may be stopped to discharge or pickup
passengers during which time the vehicles shall remain occupied
i.
Emergency vehicle
i.
a vehicle used by a police force,
ii.
a vehicle used by a fire department,
iii.
a vehicle used by an ambulance service,
iv.
an authorized emergency vehicle,
v.
a vehicle used to respond to emergencies and operated under the authority of a
government emergency organization,
vi.
a vehicle used for the purpose of maintaining a public utility and designated as an
emergency vehicle by a traffic authority, or
vii.
a vehicle not ordinarily used for emergency purposes that is operated by a volunteer,
part-time or on-call fire-fighter or emergency medical responder for the purpose of
responding to a fire, medical or other emergency;
j.
Loading zone - shall mean a designated portion of a street adjacent to the curb or road edge,
reserved for the exclusive use of vehicles, during the loading or unloading of passengers or
good and includes an area in which a vehicle may be stopped for a 15 (fifteen) minute period.
k. Mobility vehicle - means a device or vehicle which is specifically manufactured or modified for
operation by a physically handicapped person and which has a maximum speed capability of
more than 15 kilometres per hour but not more than 50 kilometres per hour
l.
Motorized mobility aid - means a device which is specifically manufactured or modified for
operation by a physically handicapped person and which has
i.
a maximum speed capability of not more than 15 kilometres per hour,
ii.
a maximum width of not more than 81.2 centimetres, and
iii.
a maximum mass of not more than 226 kilograms,
iv.
and includes a motorized wheel chair;
m. Motor Home - means a motor vehicle that is designed and constructed as an integral unit to
provide permanent living accommodation, and is equipped with one or more beds and a stove
or refrigerator, or washing and toilet facilities, and is designed so that there is direct access
from the living quarters to the driver's seat;
n. Motor vehicle - means a vehicle not run upon rails that is designed to be self-propelled,
including motorcycles, mopeds, snowmobiles and off-road vehicles, but excluding farm tractors
and self-propelled implements of husbandry.

a
vehicle
whether
occupied
or
not,
except
when it is caused to stand temporarily for the purpose of, and while actually engaged in,
loading or unloading, or in obedience to a peace officer or a traffic control device, and
"parking" has a corresponding meaning;
p. Passenger vehicle - means a motor vehicle classified by a manufacturer as a passenger car
or which is designed, constructed or adapted for the principal purpose of transporting
passengers and includes a delivery car but does not include a motorcycle, moped or motor
vehicle which is designed, constructed or adapted for the purpose of carrying goods or
commodities;
q. Peace officer - means any member of the Royal Canadian Mounted Police Force and any
other police officer, or other person employed for the preservation and maintenance of the
public peace, and any person lawfully authorized to direct or regulate traffic, or to enforce this
Act or traffic by-laws or regulations;
r.
Pedestrian - means a person afoot, or a person in a wheelchair or a child's carriage or
physically handicapped person operating a motorized mobility-aid;
s. Pedestrian control signal - means a traffic control signal directed to pedestrians;
t.
Pedestrian corridor - means a crosswalk, at an intersection or elsewhere, that has been
designated as a pedestrian corridor by the proper traffic authority and that is illuminated and
distinctly indicated for pedestrian crossing by such lights and other traffic control devices on
the highway, and such lines or other markings on the surface of the roadway, as are
prescribed in regulations made by the traffic board;
u. Permit - shall mean a valid physically disabled person's parking permit issued under Section
124.3 of The Highway Traffic Act.
v. Special Permit - shall mean a permit issued at the discretion of the office of the Town of
Neepawa, allowing for special parking consideration according to the terms set out in the
permit, notwithstanding other provisions of this By-law. (Schedule B)
w. Stand - as applied to a vehicle, whether occupied or not, means when required, to cause the
vehicle to remain motionless in one place, and when prohibited, to cause the vehicle to remain
motionless in one place, except when necessary to avoid conflict with other traffic or in
compliance with the directions of a peace officer or a traffic control device, standing has a
corresponding meaning.
x. Stop - as applied as applied to a vehicle whether occupied or not, means when required, to
cause the vehicle to cease to move, and when prohibited, to cause the vehicle to cease to
move, except when necessary to avoid conflict with other traffic or in compliance with the
directions of a peace officer or a traffic control device,
and "stopping" has a corresponding meaning
y. Street - means any public right-of-way, including a highway or a Provincial Highway, providing
primary access to abutting property, used as a public thoroughfare for vehicles and pedestrians
including streets under construction or repair, and where the context so requires, includes the
whole of the area between the boundaries of the streets as recorded in the Land Titles Office
and includes all lanes and alleys.
z. Traffic and traffic control device - means a sign, signal, light, marking, or device, not
inconsistent with this Act, placed or erected by a traffic authority for the purpose of regulating,
warning or guiding traffic.
aa. Trailer - means a vehicle designed for carrying chattels, and for being towed by a motor vehicle
or other vehicle.
bb. Truck - means a motor vehicle or semi-trailer truck that is not a delivery car and that is
constructed or adapted to carry goods, wares and merchandise, freight or commodities, but not
passengers or luggage.
cc. Truck tractor - means a motor vehicle having a net weight of more than 4,000 kilograms,
equipped with the lower half of a fifth wheel coupler designed to be used to pull a semi-trailer
by coupling to the king pin attached to the semi-trailer
dd. Vehicle - means a device, in, upon, or by which a person or thing is or may be transported or
drawn upon a highway but does not include a device designed to be moved solely by human
muscular power or used exclusively upon stationary rails or tracks, or a motorized mobility aid;
III.
TRAFFIC AT INTERSECTIONS
1. THAT all traffic at intersections shall be controlled in accordance with the traffic control devices set out in
Schedule "A" attached hereto.
2. THAT except where otherwise directed by a peace officer, every person shall obey the instructions or
directions on, or conveyed by means of, an applicable traffic control device.
IV.
PARKING, STOPPING AND STANDING OF VEHICLES
1. Parking of vehicles within the Town of Neepawa is prohibited as follows:
a. From one a.m. to six a.m. during the period November 1 to April 30 inclusive on the following streets:
i. Mountain Avenue between Main Street and Commerce Street;
ii. Hamilton Street between Brown Avenue and Second Avenue;
iii. Hospital Street;
iv. First Avenue between Main Street and Brydon Street;
v. Brown Avenue between Main Street and Davidson Street;
vi. Mill Street between First Avenue and Mountain Avenue;
vii. Ellen Street between First Avenue and Brown Avenue.
viii. Davidson St between Mountain Av and Brown Avenue
b. On the South side of Brock Street.
c. On the North side of Hospital Street.
d. On the East side of Mountain Avenue from its intersection at Main Street to its intersection at Emma
Street.
e. On the South side of Ellen St from its intersection at 5th Av to its intersection at Mountain Av.
f. On the West side of Walker Av from the intersection at Ellen St to the intersection at Hamilton St.
g. On the North side of Isabel Street from its intersection at Mountain Avenue to its intersection at Brown
Avenue.
h. On the East side of Brown Avenue from its intersection at Hospital Street to its intersection at
Davidson Street.
i. On the West side of Brown Avenue from its intersection at Brock Avenue to the intersection at
Davidson Street.
j. On the North side of Davidson Street for area of 5 (five) metres at the entrance to the Kinsmen Kourts
as designated by signs.
k. On the North side of Elizabeth Street from its intersection at Mountain Avenue to its intersection at
Smith Drive.
l. On Whitmore Crescent as follows:
i.
On that part of Whitmore Crescent that proceeds in a north-south direction, on the West side of
Whitmore Crescent;
ii.
On that part of Whitmore Crescent that proceeds in a general East-West direction, on the South
side of Whitmore Crescent.
m. On Adams Bay as follows:
i.
On that part of Adams Bay that proceeds in a North West - South East direction on the East side;
ii.
On that part of Adams Bay that proceeds in an East-West direction on the North side.
n. On Commerce Street between Third Avenue and Provincial Trunk Highway No. 5.
o. On the South side of Isabel Street at its intersection with Mountain Avenue as designated by signs.
p. On both sides of McGillivray Drive from Hospital Street to Commerce Street East
q. On the West side of McGillivray Drive from Commerce Street East to William Street
r. On the East side of Smith Dr from its intersection at Elizabeth Street to its intersection at Hurrell
Road.
s. On Hamilton Street between Tupper Avenue and Broadway Avenue. On the East side of Broadway
Avenue between Main Street and Phoenix Drive.
t. On the west side of Dominion Road from Main Street south to Veteran's Walk.
u. For over 2 (two) hours of all truck/motor home classifications with the capacity of over one ton pick-up
style within the Town of Neepawa excepting where designated by signs, unless a special permit has
been granted by the Town of Neepawa.
Such special permits shall be reviewed and approved on a case by case basis and if approved, shall
be attached to the permit holder's vehicle
v. All truck/motor home classifications with the capacity of over one ton pick-up style within the Town of
Neepawa are prohibited from parking in all designated angle parking zones.
w. Angle parking zones at designated intersections shall be identified and restricted with "small vehicle
parking only" signs or markings.
x. On the West side of Mountain Avenue opposite Davidson Street, so designated as the "Pocket Park".
Said designated area may be used only as a drop-off zone as defined in Section I of this By-Law.
y. Restricted parking to one side only for all roadways that are less than 8.5m wide. Signs to be erected
indicating restrictions.
2. Parking, stopping and standing of vehicles within the Town of Neepawa is prohibited as follows:
a. In front of the entrance to a back lane or driveway;
b. On any sidewalk;
c. Beside any vehicle which is stopped, standing or parked parallel to the edge or curb of that street;
d. Within 3 (three) metres from the point on the curb or edge of the roadway immediately opposite a fire
hydrant;
e. On the East side of First Avenue between the Southern and Northern boundaries of the Fire Hall
property which said property is described as follows:
THAT PARCEL OR TRACT OF LAND AND PREMISES SITUATE LYING AND BEING LOT
TWENTY-ONE, EXCEPTING THE MOST SOUTHERLY TWENTY-FEET, ALL OF LOTS TWENTY-
TWO, TWENTY-THREE AND TWENTY-FOUR AND LOT TWENTY-FIVE, EXCEPTING THE MOST
NORTHERLY SEVENTEEN FEET OF SAID LOT, IN BLOCK D ACCORDING TO A MAP OR PLAN
OF THE TOWN OF NEEPAWA, WHICH SAID MAP OR PLAN IS DULY FILED IN THE NEEPAWA
LAND TITLES OFFICE AS NO. 1878;
f. On Provincial Trunk Highway No. 16 between the East and West Intersections of Provincial Trunk
Highway No. 5.
g. On the East side of Third Avenue from its intersection with Brydon Street to its intersection with Mill
Street from 8:30 a.m. to 4:30 p.m. when Hazel M. Kellington School is in session, with the exception
of school buses;
h. For more than fifteen minutes on the West side of Brown Avenue from its intersection with Ellen
Street to its intersection with Hamilton Street.
i. For more than fifteen minutes on the West side of Second Avenue from its intersection at Brydon
Street to its intersection at Mill Street from 8:30 a.m. to 4:30 p.m.in the afternoon when Hazel M.
Kellington School is in session.
j. For more than15 (fifteen) minutes as designated by "Loading Zone" signs on the South side of
Hospital Street on all that part of the said street fronting on Parcels 1, 3 and 4, Plan No. 4337 as
registered in the Neepawa Land Titles Office.
k. On the South side of Brydon Street between Second Avenue and Third Avenue in a pocket parking
area designated for a "Special Needs Van Only". Parking shall only be permitted from 8:00a.m. to
4:30p.m. while Hazel M. Kellington School is in session.
l. No person shall stop, stand or park a motor vehicle in a designated disabled persons parking space
or in any manner that makes a designated parking space inaccessible, unless the vehicle displays a
permit in accordance with the Highway Traffic Act and the regulations under that act.
3. Parking of large trucks, buses, trailers and recreational vehicles
a. No person shall park or leave a semi-trailer detached from the truck tractor on any street within the
Town or a Town parking lot.
b. No person shall park or leave any recreational trailer, including a motor home, a bus which has been
converted into a motor home, a fifth wheel whether or not it is connected to a motor vehicle, or any
other recreational vehicle on any street for more than 72 (seventy two) hours, unless a special permit
(Schedule "B") has been granted by the Town of Neepawa.
Such special permits shall be reviewed and approved on a case by case basis and if approved, shall
be attached to the permit holder's vehicle.
4. Parking, Stopping and standing of vehicles is permitted on all other streets within the Town of Neepawa
provided that:
a. Where white lines have been painted on the street at an angle from the curb, each vehicle shall park
parallel to and fully within the said white lines and the front of the vehicle within 150 mm of the curb;
b. In all other places parallel to the right side of the street with the right hand wheels with 450 mm of the
curb or the edge of the street as the case may be;
c. On any street, or portion thereof where due to any emergency or special circumstances as
determined by the Royal Canadian Mounted Police parking, stopping and standing is otherwise
permitted, it may be prohibited and signs to that effect shall be placed or erected to notify the public
accordingly.
d. On any street, or portion thereof, where due to circumstances including but not limited to snow
removal, street cleaning, leaf removal and parade routes as determined by the Chief Administrative
Officer; and where parking, stopping and standing is otherwise permitted, it may be prohibited and
signs or notice to that effect shall be placed or erected to notify the public accordingly
e. Where a vehicle is parked in contravention of Sections 1, 2 or 3 herein and the owner or operator of
such vehicle is not immediately available or fails to co-operate in moving said vehicle. The Royal
Canadian Mounted Police or the Town's Chief Administrative Officer are hereby authorized to remove
such vehicle and any damages or expenses incurred in the removal of said vehicle shall be at the
owner's expense.
V.
PARKING FOR DISABLED PERSONS
1. In this Section:
a. "permit" means a valid physically disabled person's parking permit issued under The Highway Traffic
Act.
b. "Designated Parking Space" means a space designated by signs or pavement markings as being for
the sole use of Vehicles displaying a Physically Disabled Person's Parking Permit and that is located:
i. On a highway or municipal street or road
ii. In a public parking lot or facility, or
iii. In a private parking lot or facility to which the public has access
c. "motor vehicle" means a motor vehicle as defined in The Highway Traffic Act.
d. "Physically Disabled Person's Parking Permit" means a valid Physically Disabled Person's Parking
Permit issued under Section 124.3 of The Act.
2. No Person shall Stop, Stand or Park a Motor Vehicle in a Designated Parking Space, or in a manner that
makes a designated parking space inaccessible, unless the Vehicle displays a Physically Disabled
Person's Parking Permit in accordance with The Highway Traffic Act and the regulations under that Act.
VI.
MISCELLANEOUS PROVISIONS
1. No person shall turn a vehicle so as to proceed in the opposite direction at the intersection of First
Avenue and Hamilton Street, Brown Avenue and Hamilton Street, Brown Avenue and Davidson Street,
First Avenue and Mill Street, and on Mountain Avenue at any of its intersections with the following streets:
a. Boundary Street
b. Brock Street
c. Burke Street
d. Brydon Street
e. Cameron Street
f.
Davidson Street
g. Ellen Street
h. Hospital Street
i.
Isabel Street
j.
Mill Street
2. All prohibitions in this by-law respecting parking, stopping or standing may be designated to drivers by the
use of traffic control devices consisting of a sign containing a verbal or symbol notice, command, caution
or warning by the painting of the curb in any such area in the colour yellow or similar device.
3. No person shall ride, lead or herd livestock on the sidewalks or boulevards or the streets of the Town of
Neepawa without first having obtained prior permission from the Town of Neepawa.
4. No person shall ride a bicycle on any sidewalk in the Town of Neepawa or park or abandon any bicycle in
such a manner so as to create a hazard on any sidewalk, boulevard or street in the Town of Neepawa.
5. The use of ENGINE RETARDER BREAKING SYSTEM is prohibited within Town limits; drivers of motor
vehicles are prohibited from making unnecessary noise in the vicinity of a hospital, personnel care home,
school or within town limits.
VII.
PENALTIES
1. Any person who contravenes, violates, disobeys or refuses, omits, neglects or fails to comply with, any
provision of this by-law (excluding Section IV) is guilty of an offence and is liable on summary conviction,
to a fine not exceeding $500.00 or to imprisonment for a term not exceeding three months, or to both
such a fine and such an imprisonment.
2. Any person who contravenes, violates, disobeys or refuses, omits, neglects or fails to comply with any
provision of Section IV of this by-law is guilty of an offence and is liable for fines and costs which may be
set out in the offence notice pursuant to Section 13(3) of the Summary Convictions Act in the amount of
$100.00.
PRIOR BY-LAWS
3. By-Law No. 3121 is hereby repealed.
