3174-17 Reduced-Speed School Zones.doc TOWN OF NEEPAWA BY-LAW NO. 3174-17 BEING A BY-LAW OF THE TOWN OF NEEPAWA TO REDUCE THE SPEED LIMIT WITHIN A SCHOOL ZONE ON MUNICIPAL HIGHWAYS AND PROVINCIAL HIGHWAYS IN THE TOWN OF NEEPAWA WHEREAS Section 98.1(1) of The Highway Traffic Act and the Reduced-Speed School Zones Regulation No. 136/2013 states a council may pass by-laws establishing the reduced maximum permitted speed for vehicles being driven in a school zone on a highway, including a provincial highway, which is within the geographic boundaries of a municipality. AND WHEREAS the Council of the Town of Neepawa deems it advisable and in the best interests of the Town of Neepawa to establish school zones with a reduced maximum speed for vehicles. NOW THEREFORE the Council of the Town of Neepawa hereby enacts as follows: 1. This by-law may be cited as "Reduced-Speed School Zone By-Law" of the Town of Neepawa; Interpretation 2. For the purpose of this By-Law, "highway", "reduced-speed school zone", "school", "school property", "traffic control device", and "vehicle" have the same meanings as set out in The Highway Traffic Act and the Reduced-Speed School Zones Regulation No. 136/2013. Establishment of reduced-speed school zones 3. The following portions of highway are designated as reduced-speed school zones with reduced maximum permitted speed: a. Name of School: Neepawa Area Collegiate Institute (NACI) i. That portion of Mountain Avenue from the corner of Boundary Street and Mountain Avenue, continuing North to the corner of Mountain Avenue and Commerce Street. ii. That portion of Hospital Street from the corner of Mountain Avenue to the southernmost corner of Hospital Street. b. Name of School: Hazel M. Kellington (HMK) i. That portion of Brydon Street from the corner of Brydon Street and Second Avenue and continuing to the corner of Brydon Street and Third Avenue. ii. That portion of Third Avenue from the corner of Third Avenue and Brydon Street and continuing to the corner of Third Avenue and Mill Street. iii. That portion of Mill Street from the corner of Mill Street and Third Avenue continuing to the corner of Mill Street and Second Avenue. iv. That portion of Second Avenue from the corner of Second Avenue and Mill Street to the corner of Second Avenue and Brydon Street. c. Reduced-speed school zones established under 3(a) and (b) as outlined in Schedule "A". Maximum Permitted Speed within Reduced-Speed School Zones 4. The maximum permitted speed for vehicles being driven in a reduced-speed school zone is thirty (30) km/h. Times when Reduced-Speed School Zones Apply 5. The reduced maximum permitted speeds established under Section 4 apply as follows: a. From September 1st to June 30th of each school year, and b. Between the hours of 07:30 to 17:00 hours (7:30am to 5:00pm) Monday to Friday. 2 3174-17 Reduced-Speed School Zones.doc Traffic Control Devices 6. The Town shall identify a reduced-speed school zone with traffic control devices that comply with the Reduced-Speed School Zones Regulation No. 136/2013. 7. That this by-law shall come into force and take effect on January 1, 2018.
