## TOWN OF NIVERVILLE
## BY-LAW NO. 491-95
· By-law to provide for operations of snowmobile within the limits of the Town of Niverville
WHEREAS the Council of the Town of Niverville deems it necessary and in the best interests of the Town of Niverville to control the use of snowmobiles within the limits of the Town of Niverville;
NOW THEREFORE BE AND IT IS HEREBY ENACTED as follows:
1. THAT snowmobiles are prohibited from travelling on any road in the Town of Niverville.
2. THAT operators of snowmobiles are permitted to operate their snowmobile within the limits of the Town of Niverville for purposes of taking the most direct route in and out of the Town of Niverville from their residence on street boulevards or private property, provided that permission has been obtained from the owner of such private property.
3. THAT snowmobile operators, including those who do not reside within the limits of the Town of Niverville, permitted to enter the limits of the Town of Niverville along the Main Street bouldevard, excluding that portion on which the sidewalks are located thereon, provided that. take the most direct route to a motor station and back. Said route shall be designated by snowmobile operators residing in the Town of Niverville.
4. THAT any person operating a snowmobile within the limits of the Town of Niverville shall be restricted to a speed not more than 10 kilometers per hour.
5. THAT operation of snowmobiles on school property and Niverville parks is prohibited.
6. THAT the operation of any snowmobile within any residential area in the Town of Niverville shall not be permitted the hours of 11 p.m. and 6:00 a.m.
7. All other regulations and restrictions in respect to the operation of snowmobiles shall be those as provided for under The Off-Road Vehicles Act of the Province of Manitoba.
8. any person who violates any provision of this by-law is subject to a fine not exceeding Fifty ($50.00) dollars, or to a period of imprisonment of not more than Thirty 130) days, or both such fine and imprisonment unless otherwise provided for under any other Act of the Province of Manitoba.
