## TOWN OF NIVERVILLE BY-LAW NO. 856-23 ## A by-law of the Town of Niverville to reduce vehicle speed in the Niverville Middle School Zone WHEREAS section 98.1 of The Highway Traffic Act, C.C.S.M., c.H60 provides for the creation of reduced-speed school zones by by-law; AND WHEREAS clause 3(2)(b) of The Reduced-Speed School Zones Regulation, Manitoba Regulation 136/2013 provides that the by-law must establish the hours of the day at which and days on which the reduced maximum permitted speed is in effect and, if applicable, establish and state the months it is in effect; AND WHEREAS subsection 98.1(3) of The Highway Traffic Act makes it an offence for a person to drive a vehicle at a speed greater than the maximum permitted speed established by the by-law; NOW THEREFORE the Council of the Town of Niverville enacts as a by-law the following: ## Short Title 1. This By-law may be called the "Reduced-Speed School Zone By-law - Middle School". ## Definitions 2. in this By-law 2. "reduced-speed school zone" means a portion of highway that is designated by a traffic authority under section 98.1 of The Highway Traffic Act as a school zone that has a reduced maximum permitted speed at specific times or at all times. "traffic control device" means a sign, signal, light, marking or device approved under the regulations or authorized under subsection 81(3) of The Highway Traffic Act to be used - (a) As a traffic control device, and - (b) For a specified purpose "Town" shall mean the Town of Niverville. "Vehicle" means a device, in, upon, or by which a person or thing is or may be transported or drawn upon a highway but does not include - (a) A device designed to be moved solely by human muscular power or used exclusively upon stationary rails or tracks, or - (b) A motorized mobility aid; ## Reduced speed in school zones 3. No person shall drive a vehicle at a rate of speed greater than 30 kilometers per hour in the reduced-speed school zone identified in the attached Schedule "A". The reduced-speed school zone shall be on the east side of the Niverville Middle School, 161 5t Avenue South, Niverville, Manitoba. The reduced-speed zone shall extend along 5t* Avenue South (PR 622) from the northeast corner of the Niverville Middle School lot line to 150 meters south of the Niverville Middle School southeast lot line. ## Limitations on reduced speed limits 4. The reduced speed limits in section 3 apply during the months of September to June, inclusive, between the hours of 07:00 and 17:30, Monday to Friday. ## Signage - The Town shall identify a reduced-speed school zones by traffic control devices that comply with the Reduced-Speed School Zones identified by traffic control devices that comply with the Reduced-Speed School Zones Regulation, Manitoba Regulation 136/2013.
