By-law 947-2026 "Traffic and Parking By-law'' The Local Government District of Pinawa By-law No. 947-2026 Being a By-law of the LGD of Pinawa for the regulation of traffic and parking to be known as the "Traffic and Parking By-law". WHEREAS a municipality has the direction, control and management of municipal roads within its boundaries; AND ~REAS Section (1) of The Highway Traffic Act provides for a traffic authority to make rules or by-laws to regulate and control vehicular and other traffic and the parking thereof within its jurisdiction; AND WHEREAS Section 90(2) of The Highway Traffic Act provides for the council of the municipality to impose penalties for a violation of any such rule or by-law; AND WHEREAS Section 90(3) of The Highway Traffic Act provides for the council of a city, town or village to make rules or by-laws applicable to any part of a provincial highway within the city; AND WHEREAS Section 236(l)(b)(ii) of the Municipal Act L.M 1996, c.58, Chapter M225 states: "236(1) Without limiting the generality of clause 232(1)(0) (enforcement of by-laws), a by-law passed under that clause may include provisions (b) remedying contraventions of by-laws, including (ii) subject to the regulations, providing for fines and penalties, including the imposition of a penalty for an offence that is in addition to a fine or imprisonment, so long as the penalty relates to a fee, rate, toll, charge or cost that is associated with the conduct that gives rise to the offence, or related to enforcing the by-law." AND WHEREAS it is deemed necessary and expedient to pass a By-law to regulate and control vehicular traffic and the parking thereof within the Local Government District of Pinawa; - NOW THEREFORE, The Council of the Local Government District of Pinawa, duly assembled, enacts as follows: DEFINITIONS WHERE USED IN TIDS BY-LAW 1. "Accessible" means that a parking space or parking area is designed and reserved for people with disabilities or limited mobility, so they can enter, exit, and access nearby buildings safely and easily. 2. "Approved Parking Area" means space designated by signs or pavement markings as being for the sole use of motor vehicles. The approved parking area excludes those areas designated as prohibited parking areas or loading zones pursuant to the Highway Traffic Act or The Local Government District of Pinawa Traffic By-law and amendments. 3. "Boulevard" means that portion of a street not meant for vehicular traffic between the curb lines or the lateral lines of the roadway and the adjoining property line, including the sidewalk and that portion of a street between the curb lines or lateral lines of the roadway of a divided street and includes medians. ~ 4. "By-Law Enforcement Officer" means The Local Government District of Pinawa By-law Enforcement Officer and who is partially or wholly responsible for the enforcement of this by-law. 5. "Council" means the Council of the Local Government District. 6. "Cul-de-Sac" means a street, lane, etc., closed at one end; blind alley; dead end street. 7. "Crossing" means a driveway, curb cut, or other designated area where a vehicle may pass over a sidewalk for the purpose of entering or leaving a property, lane, or parking area. 1 By-law 947-2026 "Traffic and Parking By-law" 8. "Crosswalk" means that portion of a roadway clearly indicated· for pedestrian crossing by lines or other markings on the surface, or, where no such markings exist, that portion of a roadway within the prolongation directly (not diagonally) across such roadway of the lateral boundary lines of a sidewalk on an intersecting street. 9. "Curb" means the lateral boundaries of a roadway whether marked with curb stones or not. 10. "De9al" means the International Symbol of Accessibility Identification Sticker issued by the Province of Manitoba, Department of Highways and Transportation to identify vehicles owned and operated by persons requiring accessible parking. 11. "Decal Vehicle" means a vehicle displaying a Decal affixed to the rear license plate of the vehicle or to a Placard which is visible through the windshield of the vehicle. 12. "Designated Officer" means By-law Enforcement Officer, Special Constable, Parking Attendant, or any other person or agency by or acting for the Local Government District of Pinawa and partially or wholly responsible for the enforcement of this by-law. 13. "Driver" includes the rider and driver of a horse, the rider of a bicycle and the operator of a motor vehicle. 14. "Holiday" means New Year's Day, Louis Riel Day, Good Friday, Victoria Day, Canada Day, August Civic Holiday, Labour Day, Thanksgiving Day, Remembrance Day, Christmas Day and Boxing Day. 15. "Highway" means public thoroughfare within the Local Government District of Pinawa. Every highway shall be deemed to include all space between the property lines on either side, and whenever the expression "highway" within the Local Government District of Pinawa is used. Whenever in this by-law any highway is referred to by name or number as a street or avenue such street or avenue so named or numbered shall mean the street or avenue within the Local Government District of Pinawa commonly bearing such name or number. 16. "Horse" includes mule, ox or other beast of burden. 17. "Intersection" or "Street Intersection" means that area within the side lines, real or projected, of two or more streets, or of a street and a lane, which meet at an angle or across each other. In the case of the intersection of two through streets, each street shall be regarded as intersecting the other. Street in this case meaning the travelled portion between curb lines or ditch lines. 18. "Lane" means a highway six meters or less in width. 19. "LGD" means Local Government District of Pinawa. 20. "Loading Zone" means a designated portion of a Street adjacent to the Curb or Road edge, reserved for the exclusive use of Vehicles, including taxicabs, during the loading or unloading of passengers or goods, with a limit 15 minutes. 21. "Motor Vehicle" as defined by the Highway Traffic Act. 22. "Operator" means the owner of and every person who drives or operates a motor vehicle. 23. "Parking" means causing or allowing a vehicle to stand on a highway. For the purposes of any provisions of this by-law restricting parking to any period of time unless a vehicle is moved at least through the nearest intersection it shall be deemed to have remained stationary. The provisions of this by-law with respect to parking shall not apply to vehicles in charge of civic employees while in use in connection with work being done on or in any highway. 2 By-law 947-2026 "Traffic and Parking By-law'' 24. "Parked" means stationary or permitted to remain stationary as the context may require. 25. "Parking stop" means a barrier or the end of a parking spot in a parking lot establishing the furthest boundary of a parking spot. 26. "Paid Parking Area" means any LGD designated parking area where parking fees are payable. ( . 27. "Public Parking Area" means any property or area owned and/or managed by the LGD of Pinawa that is accessible for public parking. 28. "Peace Officer" means any member of the Royal Canadian Mounted Police, By- law Enforcement Officer, Special Constable, or any person lawfully authorized to direct or regulate traffic, or to enforce ¢.is by-law. 29. "Pedestrian" means any person afoot. 30. "Placard" means a sign displaying the International Symbol of Accessibility for mobility challenged persons, being the image of a person in a wheelchair and issued to persons designated in writing by Manitoba Possible. 31. "Placard Vehicle" means a vehicle displaying: i) A Placard which is visible through the windshields of the vehicle; or ii) Out of Province license plates and any card, permit, sticker or license plate issued by any Province or Territory of Canada or State of the United States of America for the purpose of identifying that vehicle as being operated by or for the use of a mobility challenged person. 32. "Public Works" means a Departmental representative of the Local Government District of Pinawa, employed with the Public Works Department and designated by the Public Works Manager or any person to act in his stead. - 3 3. "Reserved Parking Space" means a parking space reserved for Decal Vehicles or Placard Vehicles and identified by the posting of a sign bearing the International Symbol of Accessibility and located in the following parking areas or portions thereof: i) The Community Centre Parking Lot, adjacent to the west entrance of the-Community Centre. ii) The Vanier Community Centre Parking Lot, in the immediate vicinity of the lower end of the wheelchair ramp, as indicated by a sign, or signs. iii) The designated area on the east side of Willis Drive, north of the swimming pool maintenance road. 34. "Roadway" means that portion of a highway intended to be used for vehicular traffic. 3 5. "Street" means a highway more than six meters in width. 36. "Traffic" includes pedestrians, ridden or driven vehicles and other conveyances, either singly or together, while using any highway. 3 7. "Traffic signs" means a sign, marking or device ( other than a traffic light signal) placed or erected by policy authority or by a muajcipal department having jurisdiction for the purposes of guiding, directing, warning or regulating traffic. 38. "Trailer" means a vehicle designed for carrying chattels, and for being towed by a motor vehicle or other vehicle. 39. "Truck" means a motor vehicle or semi-trailer truck that is not a delivery car. and that is constructed or adapted to carry goods, wares, and merchandise, freight or commodities, but not passengers or their personal luggage and that has more than four wheels in contact with the road . . 40. "Vehicle" means a device in, upon or which by a person or property may be conveyed on a highway, including a bicycle or pushcart. 3 By-law 947-2026 "Traffic and Parking By-law'' SECTION 1 - TRAFFIC Unless otherwise specified or unless the context otherwise requires, the provisions of this by-law shall apply to persons, and vehicles only while upon a highway or a designated paid parking area. GENERAL REGULATIONS 1. No person shall deliver any goods from a vehicle in such manner as to interfere with pedestrian traffic or cause annoyance to the general public. 2. No animal or vehicle shall be driven or backed or allowed to stand on any sidewalk but may be driven over a crossing. 3. No person shall drive, operate, or have on a highway a vehicle in such condition, so constructed-or so loaded to be likely to cause unnecessary delay to traffic or acQident or injury to human or property. 4. No bicycle shall be equipped with, nor shall any person use upon a bicycle, any siren horn or any device produ~ing a sound which resembles that produced by a siren horn. 5. No person shall hold, take part in or be a member of a special event on any street, including parades, marches, rallies, block parties, street closures and any other event unless: a) The special event is under the direction or control of someone as organizer who directs people, vehicles, or participants at events responsible for enforcing safety rules, and b) The special event has been duly permitted by the Resident Administrator of the LGD I ofPinawa. Persons wishing to hold a special event on any street(s) in the Local Government District of Pinawa, including parades, marches, rallies, block parties, street closures and any other event shall make application in writing for a permit not less than forty-eight ( 48) hours before the time set for the commencement of the special event, and shall when making the request, specify the nature of the special event, the day and hour at which it is to be held the places of formation and dispersal, the exact route to be followed, the estimated time and pay such sums of money as the Resident Administrator shall require for the purpose of publishing due notice of the special event and such diversion of traffic as they shall deem necessary as a result thereof. The Resident Administrator, on receipt of an application made in accordance with the ' . provisions of this section, shall, as they may deem necessary, make the arrangements to properly police the streets to divert traffic and barricade or obstruct streets or lanes, or portions thereof. c) Tp.e driver of a vehicle shall not drive between the vehicles comprising an authorized parade or procession while they are in motion provided that the said vehicles are conspicuously so designated. This provision shall not apply to emergency vehicles travelling in emergencies. 6. The provisions of this By-law prohibiting standing and parking shall not apply to police vehicles, vehicles of or employed by the LGD of Pinawa while in use in connection with work being done on or near a highway, and vehicles _of Her Majesty's Mail or Armed Forces, of the Manitoba Government, and of any public utility if such vehicles have the owner's name painted thereon and are actually engaged in works of necessity on or near a highway requiring them to stand or be parked in contravention of any such provisions. GENERAL PARKING REGULATIONS 1. No vehicle shall be parked on a street in front of or within one meter of a driveway or approach leading into private premises. 4 By-law 947-2026 "Traffic and Parking By-law" 2. Parking is restricted between the two F.W. Gilbert School access walks between the hours of 8:00 a.m. - 5:00 p.m., while school is in session. This area is for loading and unloading of students only. 3. No person shall park within nine (9) meters of an intersection contiguous to any school ground at any time between the hours of 8:00 a.m. and 5:00 p.m. on any day excepting Saturdays, Sundays and School Holidays, if a traffic sign so indicates. 4. As authorized by Section 122(1 )( c) of The Highway Traffic Act, no person shall stop, stand or park a vehicle within an intersection or within three (3) meters thereof. 5. No vehicle shall stand backed up to the curb except when loading or unloading and must stand parallel with the curb and face in the direction of the going traffic, but no vehicle shall stand so backed up if it interferes with or interrupts the passage of other·. vehicles. 6. No person shall park any vehicle on any street in the LGD, other than parallel with the curb and headed in the direction of traffic with the right hand wheels of the vehicle within three hundred (300) millimetres of the curb or boulevard or grass strip, whichever may border the roadway on the side of the street whereon the vehicle be parked and with a clear space of one (1) meter both in front and behind the vehicles so parked. 7. No person shall park any tractor or detached vehicle known as a truck and trailer or a semi-trailer on any highway or public parking area. 8. No person shall stop, stand or park vehicles of the type known as a tractor, truck and trailer, semi-trailer, including all commercial vehicles on any residential street in any one location for a period of time longer than two hours except for the purpose of and while actually engaged in unloading and loading, or in the case of a vehicle used by a tradesperson working on premises in the immediate area. 9. No person shall park or leave any recreational trailer, including a motor home, a bus which has been converted into a motor home, a fifth wheel whether or not it is connected to a motor vehicle, or any other recreational vehicle, on any street for more than 48 hours. 10. Commercial vehicles are not ancillary to residential use; such vehicles are only permitted to park on private property in residential areas once per seven days for no more than 48 hours and shall in no circumstances be permitted to idle for more than 15 minutes. (e.g.: hot dog or ice cream truck) 11. No person shall stop, stand or park vehicles on any street or public parking area, a vehicle displayed for sale. 12. No person shall stop, stand or park vehicles for the principal purpose of washing, greasing or repairing such vehicle, except the immediate repair necessitated by an emergency. 13. No person shall stop, stand or park vehicles of the type on any portion of a street which the LGD is engaged in removing snow and upon which is placed, on or before snow and upon which is placed, on or before seven (7:00) p.m. on the preceding day, "no parking" signs indicating the portion of the street upon which parking is so prohibited. 14. No person shall stop, stand or park vehicles other than an emergency vehicle, anywhere on the approach ramp to the police bay, or the fire hall, within six (6) meters of the building where the Royal Canadian Mounted Police (RCMP) patrol car is housed. 15. No person shall stop, stand or park vehicles in the school, arena, community centre, Lewis Centre or Teen Centre or any LGD public facility when not doing business there. 16. No person shall park a vehicle on any street or enter that street in the block of a fire scene, except on direction or order of a member of the Police or Fire Department. 17. No person shall leave a vehicle parked at one place on any street or public parking area in the LGD for a period longer than forty-eight ( 48) hours. 5 By-law 947-2026 "Traffic and Parking By-law'' 18. No person shall park a vehicle that does not have a current and valid registration with Manitoba Public Insurance on any street or designated parking area in the LGD. 19. No person shall park a vehicle on any portion of a municipal right of way that is not intended for vehicular travel, including but not limited to boulevards, ditches, or other non-travelled areas, except in areas designated or marked for parking. 20. No parking is allowed on the even numbered side of any roadway/street, unless otherwise noted in this by-law. No parking is allowed on any cul-de-sac within 6 meters of the circular portion. 21. No parking shall take place on the follo~g streets and/or sections of streets in the LGD: 1. On the East side of Willis Drive from PR 211 to Alexander South and the South side of Willis Drive from Alexander A venue to Aberdeen A venue. (Parking is permitted on the opposite side of the road). 11. At the Boat Launch sites. m. On either side of Vanier from Burrows to Willis anytime. 1v. On either side ofLisgar Place. 22. Forty-eight (48 hr) provisions in this section do not apply to snow clearing operations or when temporary restrictions are in place. DESIGNATED PAID PARKING AREAS 1. The LGD has designated the following municipal parking lots, various off-street parking pads, and streets as pay for parking areas as follows: (a) Alice Chambers Trail Parking lots; (b) Diversion Dam ~arking Lot including former PR 211 from Willis Road East to the parking lot; ( c) Willis Road East variqus off-street parking areas; ( d) Willis Road from McDiarmid Road to 100 meters past the 2 Willis Drive driveway; ( e) and Sundial Parking lot. 2. Paid Parking areas will be in effect from Saturday of the long weekend in May to the Tuesday after the first long weekend in September of each year. 3. When paid parking applies to a parking space, a vehicle must have a valid paid parking pass displayed and/or registered according to the LGD of Pinawa's current Paid parking system and Parking Pass Policy. 4. Vehicles parked in a Paid Parking Area cannot remain in the parking area for longer than 24 hours and must follow all applicable parking rules in this by-law and highway traffic act: - DESIGNATED PARKING RESTRICTED AREAS: 1. The LGD has designated the following streets as areas where no parking is permitted unless the vehicle has a valid Resident Parking Pass and/or registered according to the LGD of Pinawa's current Paid parking system and Parking Pass Policy. (a) McDiarmid Road- from Willis to Alexander (b) Alexander A venue - from McDiarmid to Athlone ( c) McGregor Crescent ( d) Burrows Road from Willis to Alexander ( e) Athlone Crescent ACCESSIBLE PARKING & TEMPORARY TRAFFIC SIGNS: 1. No person shall park a vehicle other than a Decal Vehicle or a Placard Vehicle in a Reserved Parking Space. 6 By-law 947-2026 "Traffic and Parking By-law" (f) The Local Government T"'\istrict of Pinawa is to place and maintain or caused to be placed, and maintained, teI.L..._ Jrary traffic control devices for t:b,e purpose of prohibition or regulating traffic where highway construction, repair, painting, snow removal, street cleaning or any emergency occurs. (g) Unless otherwise directed by a Peace Officer, no person shall drive a vehicle or bus on any portion of a street or lane roped, public parking area, barricaded or otherwise indicated as prohibited by the proper authority, as being closed to traffic for the time being. TRAFFIC SIGNS: 1. The Local Government District of Pinawa is authorized to place and maintain or cause to be placed and maintained, all traffic control devices for the purpose of . prohibiting or regulating traffic in accordance with the provisions of The Local Government District of Pinawa By-laws and/or The Highway Traffic Act, C.C.S.M. c. H60 and amendments thereto. SPECIAL PARKING PROVISIONS: 1 . The Local Government District of Pinawa notwithstanding any traffic rules under this by-law to conduct and carry out snow removal and/or cleaning of streets and when such measures are being carried out, no person shall rely on or be governed by the ordinary rules in the area of such measure. AUTHORITY TO MOVE VEIDCLES UNDER CERTAIN CONDITIONS: 1 . Where any vehicle is standing or parked: (a) Contrary to any section of this by-law; . (b) In a position that causes it to interfere with the movements or operating of any firefighting, ambulance or other emergency equipment by an LGD representative, any member of the Royal Canadian Mounted Police, the Fire Chief of the LGD, or any LGD Constable under contract to the LGD, may move the said vehicle or cause it to be moved, or may require the driver or person in charge of the vehicle to move it to a position determined by the aforesaid party or parties, or may authorize the removal and detention of the violating vehicle by a garage keeper and any such vehicle and the owner thereof shall be subject to the provisions of "The Garage Keepers Act" Chapter G 10, and all amendments thereto. SNOW OR ICE - ALL PROPERTIES: SECTION 1 - DECLARED PARKING RESTRICTIONS 1. The Local Government District of Pinawa may, at its discretion, declare a Snow Clearing Event for the purpose of facilitating snow removal operations on municipal streets. 2. Upon declaration of a Snow Clearing Event, no person shall park or leave a vehicle on any street or portion thereof identified by the LGD for snow clearing operations. 3. Notice of a Snow Clearing Event may be provided to the public by any reasonable means, including but not limited to the LGD website, social media, local media, or other communication methods deemed appropriate by the LGD. 4. Any vehicle parked in contravention of this Section may be ticketed and/or towed without notice at the owner's expense. 5. Public Works, or its designate, is authorized to determine the streets or areas affected and to carry out enforcement of this Section in coordination with a Peace Officer or By-law Enforcement Officer. 6. No person shall park or leave a vehicle on any street in such a manner that interferes with or obstructs snow clearing operations, whether a Snow Clearing Event has been declared or not. 7 SECTION2 By-law 947-2026 "Traffic and Parking By-law" 1. It shall be an offence for any person to remove from any" private property, public property, street, boulevard or sidewalk any snow or ice and deposit same on any street, boulevard or sidewalk in such a manner that could create a hazardous condition for either vehicular or pedestrian traffic. 2. Section (1) shall not apply to the LGD employees who are actively engaged in snow removal from streets, boulevards or sidewalks in the course of their employment. 3 . Any person occupying a property where a building abuts the property line adjacent to a street in such a manner that snow cannot be cleared onto the property, may pile the snow at the curb line of the street in such a manner that both vehicular and pedestrian traffic can pass and only permitted provided it does not interfere with drainage or snow. clearing operations, or create hazardous conditions. 4. No vehicle shall remain parked on any street during snow-clearing operations. Any vehicle parked in violation of this section may be ticketed and, if not removed may be towed at the owner's expense. 5. Snow clearing will normally occur during the period Monday to Friday between the hours of7:00 a.m. and 4:00 p.m,, except that in extenuating circumstances, as described in the LGD of Pinawa Policy, snow clearing may occur at any time as required. 6. Any towing and impound charges accruing from the towing away of a vehicle parked in contravention of this Section shall be the responsibility of the owner of the vehicle in question. 7. The LGD has the authority to initiate towing during snow clearing operations. The owner of an impounded vehicle may retrieve the impounded vehicle by prior payment of the relevant towing and impoundment charges together with an administration fee under By-law 908-2023 Provincial Offences Act. Retrievable costs shall be paid at the Municipal Office of the LGD of Pinawa, except as otherwise provided in this Section. 8. The Resident Administrator or their designate shall then arrange to give the owner of an impounded vehicle access to retrieve the vehicle in question, during regular business hours. 9. Each day that a contravention of this Section continues shall be considered a separate offence. AREAS CLOSED TO TRAFFIC: 1. No person shall drive any vehicle through, over or upon any street or portion of street which has been closed for the purpose of repairs or regular maintenance, or during a fire, and that has been roped off or barricaded, or where any sign has been erected by authorized traffic control devices or the Public Works h,.uthority indicating by words or writing that the street or section of the street is closed. SECTION 2 - PARKING SIGNAGE: The LGD of Pinawa will make reasonable efforts to install signage or pavement markings to indicate parking regulations under this by-la.w. However, the absence, temporary removal, or obscuring of such signage or markings does not invalidate a parking restriction where the regulation is otherwise established under this by-law. PROHIBITIONS AND OFFENCES: 1. No operator shall park a vehicle at any portion of an approved parking area when parking there has been prohibited pursuant to subsection 2 (below) hereof. 2. Notwithstanding any other provision of this by-law which permits the parking of vehicles on streets, no person shall park or stand a vehicle on a street or highway in such a manner as to interfere with the clearing (ploughing/removal) of snow from the streets or highways. 8 By-law 947-2026 "Traffic and Parking By-law'' 3. Notwithstanding any other provision of this by-law, where a vehicle is parked or left standing on any street, in such a manner that it interferes with or obstructs the clearing (plowing/removal) of snow from the streets, a peace officer or designated officer may cause such vehicle to be moved or towed at the owner's expense. TEMPORARY CLOSING OF PARKING SPACES: 1. When~ver due to any special circumstances, the Royal Canadian Mounted Police Commander or the Local Government District of Pinawa considers that any approved parking areas should be temporarily discontinued as a parking area, Public Works may cause to be placed or erected, a sign or signs directing "no parking" at such approved parking area. OFFENCES AND PENAL TIES: 1. Whenever a vehicle is found parked or left in violation of any provision of this By- law, any Peace Officer, on fmding such vehicle shall affix a notice hereinafter referred to as a "LGD of Pinawa Parking Ticket", to such vehicle, and such notice shall state the vehicle license plate number, the date and time and place of violation, briefly describe the alleged violation, details on payment options and appeal process. 2 . Fees for violations are set forth as shown on Schedule 'A' of this By-law. 3. By-law 907-2023 or any subsequent by-law replacing it, is the Municipal By-law Enforcement Act and sets out the procedures for appealing an LGD of Pinawa Ticket. 4. By-law 908-2023 or any subsequent by-law replacing it, is the Provincial Offences by-law and establishes enforcement and sets out the administrative fee for unpaid LGD of Pinawa Tickets. RESCIND By-law No. 943-2025 is hereby rescinded. This by-law shall come into force and effect upon the passing thereof.
