THE LOCAL GOVERNMENT DISTRICT OF PINAWA · BY-LAW NO. 819-16 Being a By-law of The Local Government District of Pinawa to prohibit smoking in certain: outdoor locations. WHEREAS Section 232(1) of the Municipal Act provides that a council may pass by­ laws fqr municipal purposes respecting the following matters: '(a) the safety, health protection and well-being of people and the safety and protection of property; (b) People activities and things in on or near a public place or a place open to the public, including parks municipal roads recreation centres, restaurants, facilities, retail stores, malls, and private clubs and facilities that are exempt .from municipal taxation; AND WHEREAS scientific studies confirm that negative health consequences can result from any exposure to tobacco smoke; NOW THEREFORE THE COUNCIL of The Local Government District of Pinawa enacts as follows: 1. No person shall smoke: a) within 30 metres of the playing surface of an athletic field or a hockey rink owned or operated by the LGD of Pinawa; b) on a playground; . c) within 30 metres of a swimming pool, wading pool, or beach owned or operated by the LGD of Pinawa; . d) on the premises of a primary school, middle school or secondary .school, whether or not it is during school hours; 2. A person who contravenes this by-law is guilty of an offence and is liable on summary conviction to a fine of not more than $500.00.
