LOCAL GOVERNMENT DISTRICT OF PINAWA
BY-LAW NO. 921-2023
Being a By-law of the Local Government District of Pinawa to set rates for sewer and
water connections.
WHEREAS Section 232(1)(1) of the Municipal Act, S.M. 1996, c.58 provides in part,
that:
"A Council may pass by-laws for municipal purposes respecting the following
matters:
(I) public utilities";
AND WHEREAS the Local Government District of Pinawa encourages the
construction of residential and commercial property;
AND WHEREAS it is deemed expedient and in the best interests of the Local
Government District of Pinawa on behalf of the Municipality that a reasonable rate be
set and levied for the placing, constructing and maintaining private connections from
the main water and sewer lines to the building itself;
THEREFORE BE IT AND IT IS HEREBY ENACTED as a By-Law by the Local
Government District of Pinawa as follows,
1.
That all costs regarding the construction of the sewer and water lines from
the main line to the building itself will be the responsibility of the Developer or
owner.
2.
That any maintenance on the sewer and water lines from the property line
to the building will be the responsibility of the owner.
3.
That the Local Government District of Pinawa shall supervise connections to the
existing service and may recommend material and mechanical connections, if
required.
4.
The rates for sewer and water connections where main lines are not in place will
be subject to a development agreement.
5.
By-Law No. 842-18 is hereby rescinded.
