BY-LAW 2025-05

BEING A BY-LAW OF RIVERDALE MUNICIPALITY TO ESTABLISH TIPPING FEES
AND REGULATIONS FOR THE WASTE DISPOSAL GROUNDS
****************************************************************************************************
WHEREAS Section 232(1) of The Municipal Act authorizes a council to pass by-laws for
municipal purposes, including the operation and management of waste disposal grounds;
and
WHEREAS it is deemed necessary and expedient to establish fees, definitions, and rules
for the disposal of waste at Riverdale Municipality's landfill site(s);
NOW THEREFORE the Council of Riverdale Municipality, in open session duly
assembled, enacts as follows:
1. TITLE
This by-law may be referred to as the "Landfill Tipping Fee By-law."
2. DEFINITIONS
"Residential Waste" means waste generated from a dwelling or residential accessory
building owned or occupied by a Riverdale resident, and not generated as part of a
business, contractor, or commercial operation.
"Construction, Renovation, and Demolition (CRD) Waste" means waste resulting from the
construction, alteration, renovation, or demolition of buildings or structures.
"Commercial/Contractor Waste" means waste generated by a contractor, business, farm,
or other enterprise as part of its operations, or waste hauled on behalf of third parties for
a fee.
"Resident" means a taxpayer or occupant of property within Riverdale Municipality.
"Non-Resident" means all others.
"Mixed Load" means a load containing more than one type of waste stream that requires
different handling.
"Highest Applicable Rate Rule" means that mixed loads will be charged at the highest
category fee represented in the load.
"Load" means a quantity of waste brought to the landfill in a single vehicle or vehicle/trailer
combination.
3. GENERAL REGULATIONS
(1) All waste delivered to the landfill must be sorted and disposed of in the designated
area as directed by landfill staff.
(2) The Municipality reserves the right to refuse any load containing prohibited materials.
(3) Residents hauling CRD Waste in a commercial or farm vehicle may qualify for
residential rates by completing a Residential Source Declaration Form attesting that the
waste originated from their own property.
(4) Vehicle type shall not, on its own, determine the classification of a load.
(5) Mixed Loads will be charged according to the Highest Applicable Rate Rule.
(6) Non-residents and commercial/contractor users shall pay according to the Non-
Resident/Commercial schedule.
4. ACCESS KEYS
(a) Contractors or local businesses utilizing municipal landfill access keys shall be charged
$250.00 + GST for lost keys or keys not returned within two (2) business days of request
or project completion.

(b) The Municipality may suspend access privileges until keys are returned or replacement
fees are paid.

Contaminated / Prohibited Materials (e.g., asbestos, hazardous waste): Accepted
only by prior arrangement and subject to surcharge determined by Council.
6. EXEMPTIONS
Household garbage in small quantities (bagged and delivered by resident in
car/SUV/pickup) shall remain free of charge.
7. REPEAL
By-law 2022-07 are hereby repealed.
8. EFFECTIVE DATE
This by-law shall come into force and take effect on the day it is passed.
DONE AND PASSED as a by-law of Riverdale Municipality at Rivers in the Province of
Manitoba this 7th day of October, 2025.
