## THE RURAL MUNICIPALITY OF ARMSTRONG BY-LAW NO 4/09
## BEING A BY-LAW OF THE RURAL MUNICIPALITY OF ARMSTRONG TO GOVERN THE USE OF ENGINE RETARDERS WITHIN THE BOUNDARIES OF THE TOWNSITE OF INWOOD AND TO INSTALL SIGNS
WHEREAS subsection 232 (1) of the Municipal Act provides in part as follows:
"A council may pass by-laws for municipal purposes respecting the following matters:
- (a) the safety, health, protection and well-being of people and the safety and protection of property;
- (b) people, activities and things in, on or near a public place or a place open to the public, including parks, municipal roads, recreation centres, restaurants, retail stores, malls, and private clubs and facilities that are exempt from municipal taxation;
- (c) subject to section 233, activities and things on private property;"
AND WHEREAS Council considers it expedient and in the best interest of the Rural Municipality of Armstrong to govern the use of engine retarders in the Townsite of Inwood and to install signs;
NOW THEREFORE the Council of the Rural Municipality of Armstrong, in open session assembled, enacts as follows:
1. THAT this by-law is applicable to part of the Rural Municipality of Armstrong as follows: NE 34, NW 35, NE 35 & NW 36-17-1W and SW 1, SE 2, SW 2 & SE318- as per Schedule "A" attached hereto and forming part of this By-Law.
2. THAT the use of engine retarders (jake brakes) is prohibited.
3. Installed by at a lighliay of mansportaires our surn a from and sa ve engine retarders (jake brakes)
4. THAT two signs are to be installed on PTH No. 17, one on PR No. 416 and one on the municipal road named Transfer Station Road.
5. . THAT the cost and installation of the said signs is to be paid in full by the Rura Municipality of Armstrong
6. THAT any person violating the provision of this by-law shall upon conviction mprisonment for a period not exceeding thirty day
DONE AND PASSED as a By-Law of The Rural Municipality of Armstrong at Inwood, in the Province of Manitoba, this 8'h day of September, 2009.
