## THE RURAL MUNICIPALITY OF ARMSTRONG BY-LAW NO 5/09 ## BEING A BY-LAW OF THE RURAL MUNICIPALITY OF ARMSTRONG TO GOVERN THE USE OF ENGINE RETARDERS WITHIN THE BOUNDARIES OF THE TOWNSITE OF FRASERWOOD AND TO INSTALL SIGNS WHEREAS subsection 232 (1) of the Municipal Act provides in part as follows: "A council may pass by-laws for municipal purposes respecting the following matters: - (a) the safety, health, protection and well-being of people and the safety and protection of property; - (c) subject to section 233, activities and things on private property;" - (b) people, activities and things in, on or near a public place or a place open to the public, including parks, municipal roads, recreation centres, restaurants, retail stores, malls, and private clubs and facilities that are exempt from municipal taxation; AND WHEREAS Council considers it expedient and in the best interest of the Rural Municipality of Armstrong to govern the use of engine retarders in the Townsite of Fraserwood and to install signs; NOW THEREFORE the Council of the Rural Municipality of Armstrong, in open session assembled, enacts as follows: 1. THAT this by-law is applicable to part of the Rural Municipality of Armstrong as follows: NE 15, NW 14, NE 14, SE 22, SW 23 and SE 23-19-2E as per Schedule "A" attached hereto and forming part of this By-Law. 2. THAT the use of engine retarders (jake brakes) is prohibited. 3. THAT the Rural Municipality of Armstrong agrees to purchase from and have installed by Manitoba Highways and Transportation three signs covering the use of engine retarders (jake brakes). 4. THAT two signs are to be installed on PTH No. 7 and one on PR No. 231. 5. THAT the cost and installation of the said signs is to be paid in full by the Rural Municipality of Armstrong. 6. THAT any person violating the provision of this by-law shall upon conviction before the appropriate authority be liable to a penalty not exceeding $500.00 in addition to costs, or, in the case of non-payment of fine and costs inflicted, to imprisonment for a period not exceeding thirty days.
