## RURAL MUNICIPALITY OF COLDWELL BY-LAW 06/08
BEING A BY-LAW OF THE RURAL MUNICIPALITY OF COLDWELL TO REGULATE BURNING WITHIN THE MUNICIPALITY.
WHEREAS Section 232(1) of The Municipal Act provides that a Council may pass by-laws for municipal purposes respecting the following matters:
- a) The safety, health, protection and well being of people and the safety and protection of property
- 0) Enforcement of by-laws
- i) Preventing and fighting fires
NOW THEREFORE BE IT RESOLVED that the Council of the Rural Municipality of Coldwell in session assembled enacts as follows:
1. The Authority having jurisdiction means the Municipal Council (and duly appointed agents thereof)
2. To keep fires under control at all times
2. Burning is permitted in the Rural Municipality of Coldwell subject to the following conditions and provisions of "The Fire Prevention Act" and Manitoba Burning of Crop Residue Regulations:
4. To bear responsibility for all property damage which may result
- c. To fireguard the area as required under the terms of "The Fire Prevention Act"
- d. No fire to be set and left unattended
- e. With the issuance of a burning permit
4. That any person convicted of a violation or infraction of any of the provisions of this by-law shall upon conviction be liable for each offence to a penalty not exceeding $500 and costs.
3. Council may, by resolution, ban all burning within the municipality if conditions exits where, in the opinion of council, open fires are of extremely high risk.
THAT this by-law shall come into force and take effect on the passing thereof.
