<!-- image --> ## Rural Municipality of De Salaberry By-law No. 2324 -14 ## BEING A BY-LAW TO ESTABLISH THE OPERATION OF DESIGNATED OFF ROAD VEHICLES IN ST.MALO PROVINCIAL PARK WITHIN THE RURAL MUNICIPALITY OF DE SALABERRY WHEREAS Section 232(1) of The Municipal Act, S.M. 1996, and c.58 in part states: "A Council may pass by-laws for municipal purposes respecting the following matters: - a) The safety, health, protection and well-being of people, and the safety and protection of Property." AND WHEREAS Section 45(1) of the Off-Road Vehicle Act, C.C.S.M. c031 in part states: The traffic authority of a highway may make by-laws and the minister may make rules supplementary to, or in addition to, but not contrary to any provision of this Act or the regulations made under this Act - (a.1) permitting the operation of designated off-road vehicles upon a roadway or the shoulder of a roadway AND WHEREAS the Municipal Council of the Rural Municipality of De Salaberry deems it in the best interest and safety of the residents of the Municipality to regulate off road vehicles operating on park roads within St. Malo Provincial Park in the Municipality; NOW THEREFORE the Council of the Rural Municipality of De Salaberry, in open session assembled, hereby enacts as a by-law as follows: 1. This By-law shall be known as the "THE OPERATION OF DESIGNATED OFF ROAD VEHICLES IN ST.MALO PROVINCIAL PARK BY-LAW". 2. Definitions: - a. The words used in this By-law have the same meaning as defined in the Off- Road Vehicles Act unless otherwise provided <!-- image --> <!-- image --> - b. Park Road means a road as defined in the Highway Traffic Act, and includes a road and road allowance maintained by the Province of Manitoba within St. Malo Provincial Park. - c. A designated person means an employee of the Province of Manitoba or the Royal Canadian Mounted Police during the course of their duties. - d. Designated off road vehicle as those off road vehicles owned, licensed and operated by Conservation and Water Stewardship or the Royal Canadian Mounted Police. - e. Officer - includes Resource Officers or members of the Royal Canadian Mounted Police. 3. The Municipality authorizes designated persons to operate designated off road vehicles on St. Malo Provincial Park roads within the Municipality. - a. A designated vehicle shall be indentified with one or more of the following: - i. Officer in uniform - ii. Highly reflective flag and or slow moving vehicle sign - ili. Employees wearing reflective vests DONE, PASSED AND ENACTED by Council duly assembled at the Council Chambers of the Rural Municipality of De Salaberry, this 10th day of June, 2014.
