RURAL MUNICIPALITY OF DE SALABERRY
BY-LAW NO. 2379-19
Being a by-law of the Rural Municipality of De Salaberry to reduce the speed limit
within a school zone on certain municipal highways.
WHEREAS Section 98.1(1) of The Manitoba Highway Traffic Act allows the council of a
municipality, by by-law, to designate the rate of speed within a portion of a highway under its
jurisdiction that adjoins the entrance to or exit from a school and that is within 150 meters
along the highway in either direction beyond the limits of the land used for the purposes of the
school as a school zone; and for motor vehicles driven, on days on which school is regularly
held, on the portion of a highway so designated, prescribed a rate of speed that is lower than
the rate of speed otherwise prescribed for that portion of highway, and prescribe the time or
times at which the speed limit is effective.
AND WHEREAS the Council of the Rural Municipality of De Salaberry deems it prudent and in
the best interests of the municipality to reduce the speed limit on portions of highway as
described herein;
NOW THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of De Salaberry
hereby enacts as a By-Law the following:
1. This By-Law may be called the "Reduced-Speed School Zone By-Law".
Interpretation
2. For the purposes of this By-Law, "highway", "reduced-speed school zone", "school",
"school property", "traffic control device", and "vehicle" shall have the same meaning as
set out in The Highway Traffic Act and the Reduced-Speed School Zone Regulation No.
136/2013.
Establishment of Reduced-Speed School Zones
3. The following portion of highway is designated as a reduced-speed school zones with
reduced maximum permitted speed:
a. Name of School: École St. Malo School, 189A St. Malo Street
Highways included in the reduced-speed zone:
i. That portion of St. Malo Street beginning 41 meters North of De L'Eglise
Avenue, being 133 meters from the Northwest corner of the school
property, and continuing in a Southerly direction and ending at the point
where St. Malo Street meets Benoit Avenue, being 110 meters from the
Southwest corner of the school property.
4. That Schedule "A" form part of this By-Law, being a map indicating the reduced-speed
school zone location.
Maximum Permitted Speed Within Reduced-Speed School Zones
5. The maximum permitted speed for vehicles being driven in a reduced-speed school zone
on a highway is 30 km/h.
Times When Reduced-Speed School Zones Apply
6. The reduced maximum permitted speeds established under section 4 apply in the
months of September to June (inclusive) from Monday to Friday between the hours of
08:00 to 17:00 within a reduced-speed school zone.
Traffic Control Devices
7. The Rural Municipality of De Salaberry shall identify a reduced-speed school zone with
traffic control devices that comply with the Reduced-Speed School Zones Regulation no.
136/2013.
THAT this By-Law shall come into force and effect on third reading.
THAT By-Law No. 2342-16 is hereby repealed, effective third reading of this By-Law.
DONE AND PASSED as a by-law of the Rural Municipality of De Salaberry, in St-Pierre Jolys,
Manitoba, this 9th day of April, 2019.
