R.M. of ELLICE - ARCHIE CEMETERY POLICY 1 | P a g e Amendments Approved by Resolution: #278-20 (Nov 2020); #270-19 (Oct 2019); #159-17 (Aug 2017); #135-17 (June 2017) PRINCIPLES: The purpose of this policy is to outline Council's requirements in regards to all cemeteries located within the Rural Municipality of Ellice - Archie. There are 11 cemeteries located within the RM, they include: - McAuley Cemetery (NW 2-15-29 W) - Manson Cemetery (NW 27-13-29 W) - McKenzie / Willen / Rose Lea Cemetery (NW 24-14-28 W) - Swedish (SE 19-13-29 W) - St. Lazare Cemetery (SE 7-17-28 W) - St. Lazare Town Cemetery (SE 17-17-28) - Ste-Madeleine Cemetery (SE 32-18-29) - Beaver Rapids Cemetery (NE 10-15-29) - Zion Cemetery (NE 25-17-28) - Balmerino Cemetery (SE 14-18-28) 1. INSTALLATIONS: The Municipal Office located in McAuley or St. Lazare must be notified prior to any person digging, planting, or installing any object within any of the above listed cemeteries. Any installations made without permission may be removed. 2. PLOT RATES: No lot is reserved until payment in full is received for the selected lot. Cost of plots is as follows: Standard 4' x 8' plot $ 50.00 Standard 8' x 8' $ 100.00 (McAuley & St. Lazare) (2 plots) 3. BURIAL MAXIMUM: The number of remains permitted to be within each 4' x 8' plot is: - 1 casket and 3 cremations o Exemption: if all cremations are done at the same time, a maximum of 5 can be placed in each plot. o Note: if cremation is the first burial, a maximum of 3 cremations and 0 caskets can reside in each plot. 4. DIGGING - Allan Webb (subcontracted) - Canarts (subcontracted) - RM Employee 5. FEES St. Lazare cemetery: Casket: At such time as lot is used for interment, a onetime lump sum fee will be paid to the RM of Ellice-Archie for the opening and closing of the grave. The cost is 375.00. These fees will be reviewed periodically by council. (existing BL# 08-14) R.M. of ELLICE - ARCHIE CEMETERY POLICY 2 | P a g e Amendments Approved by Resolution: #278-20 (Nov 2020); #270-19 (Oct 2019); #159-17 (Aug 2017); #135-17 (June 2017) Cremation: At such time as lot is used for cremation interment, a onetime lump sum fee will be paid to the RM of Ellice-Archie for the opening and closing of the grave. The onetime lump sum fee is 175.00. (100.00 for opening/closing - & 75.00 for perpetual care). A cement pad for foundation of monuments, covering 3 lots must be poured and cured before any monument is placed. A cement pad must be paid in full upon ordering. A fee of $200.00 is charged. Payment for above is due before commencing digging of the grave, unless payment is being made by funeral home. All other cemeteries within the municipality: At such time as lot is used for interment, a onetime lump sum fee will be paid to the subcontractor. 6. GENERAL a. The Cemetery shall be closed to public vehicles unless authorized by municipality. b. All persons are prohibited from writing upon, scratching, defacing or injuring any monument, fence or other structure in or belonging to the Cemetery. c. No unauthorized person shall drive a vehicle over any part of the Cemetery except on the roadways, and no person shall ride a bicycle over any grave, nor lean same against any monument or marker, nor leave same on any lot for any period of time d. No dogs or animals shall be allowed in the Cemetery. e. No person is permitted to enter the Cemetery except through the regular entrances. f. No liquor shall be permitted in the Cemetery, except for religious ceremony. g. No person shall engage or play at any game or sport, or discharge any firearms (except at a military funeral) in the Cemetery, or unlawfully disturb persons assembled for the burial of the dead, or commit a nuisance, or behave in any indecent or unseemly manner at the Cemetery. h. No all-terrain vehicles or snowmobiles shall be allowed within the limits of the Cemetery. i. The Chargehand, or other authorized employees, shall have the power to remove from the Cemetery any person disturbing the quiet or good order of the Cemetery by noisy or improper conduct or language, or any person violating any of the provisions of this by-law. j. The Director, in his sole discretion, shall have other powers as such arise by necessary implication from this policy or other statutes to make administrative decisions for the conduct and operation of the cemetery. k. The owner of any lot shall not plant trees or shrubs, install any enclosures or grave covers of concrete or any other material. Any flowers (plastic or real) that are put on any grave when in R.M. of ELLICE - ARCHIE CEMETERY POLICY 3 | P a g e Amendments Approved by Resolution: #278-20 (Nov 2020); #270-19 (Oct 2019); #159-17 (Aug 2017); #135-17 (June 2017) dilapidated or such poor condition in the opinion of the caretaker that it impacts on the overall appearance of the cemetery will be removed. The caretaker or RM will not be responsible for any plants of a perennial nature placed on any lot. l. No person shall dig or open any grave or cause any graves to be dug or opened in any place within the municipality other than that now used and/or hereinafter appropriated for the purpose of a cemetery; nor shall any person inter or deposit or cause to be interred or deposited any human remains in any grave within the RM of Ellice-Archie other than as aforesaid. m. No cremated remains shall be interred or scattered on any public property other than approved locations. n. All interments and disinterment of a deceased person must be conducted in strict compliance with provincial and/or federal legislation. o. Any applicant for interment who does not own the lot must obtain a written order from the owner and presented to the RM of Ellice-Archie. p. A permit for burial must be provided to the RM of Ellice-Archie for any burial. q. All foundations for monuments shall be laid by the RM of Ellice-Archie. r. The RM of Ellice-Archie shall not be responsible for any maintenance to the foundation after installation including damage caused from natural ground settlement. s. The RM of Ellice-Archie shall not assume any responsibility or costs incurred as a result of vandalism to monuments located in the cemetery. t. After the passing of this policy; grave coverings, borders, fences, railings, trellises, copings, hedges, iron posts or any ornamental material shall not be constructed in or around any grave or lot. u. After the passing of this policy, the RM of Ellice-Archie may remove any grave covering, border, fence, railing, coping, hedge or any other bounding or enclosing material erected before the passing of this policy which by reason of neglect or age becomes in a state of disrepair and the owner neglects or refuses to repair or remove same within thirty (30) days after written notice has been forwarded to him at his last known address.
