R.M. of ELLICE - ARCHIE ROADSIDE MOWING POLICY 1 | P a g e Approved by Resolution #39-22 (Feb 2022) PURPOSE: The purpose of this policy is to outline the conditions of the Roadside Mowing Policy as adopted by the RM of Ellice - Archie. The terms of this Policy are for "Roadside Mowing" for which the Municipality has the direction, control and management under The Municipal Act, and as defined within this Policy. SCOPE: This policy appears to all employees, councillors, contractors, landowners and ratepayers. GUIDELINES: 1. Persons will be required to fill out a Registration form (Schedule A of this Policy) with the locations they are interested in prior to June 1st of each year, prior annual roadside mowing program begins. 2. First come first serve basis regarding registering for locations. 3. Adjacent landowners/lessees have first choice, but are required to register. 4. All roadsides to be cut for hay must be cut and baled, with the bales removed, by August 1st. 5. Any bales remaining in the right-of-way after August 1st will be disposed of by the Municipality. 6. For safety reasons, bales should be removed from the roadsides immediately after baling. 7. The right-of-way must be left in a neat appearance by the person salvaging the hay. 8. In situations where the ditch becomes rutted because of wet conditions, it becomes the responsibility of the individual performing the haying to level and return the ditch to its original state. 9. No person shall cut hay on any portion of road right-of-way within the Municipality so as to obstruct the travelled portion of the road. 10. The Municipality reserves the privilege and right for its employees and/or agents to enter upon the said right-of-way for the maintenance and/or reconstruction of said roadway or for other purposes as may be deemed necessary at no compensation or reimbursement to the party salvaging the hay therefrom. 11. The Municipality assumes no liability for labourers, machinery or bales relating to the salvage of hay operations. Legal Location(s) requested: (Include locations shown on map attached) The Applicant agrees to comply with all guidelines outlined in the Roadside Mowing Policy of the RM of Ellice - Archie. The Applicant agrees that they shall not use the right-of-way for purposes which are unlawful or in contravention of Municipal, Provincial or Federal legislation. The Applicant agrees to Indemnify and save harmless the RM of Ellice - Archie, its officers and employees, for any claims for loss, damages or injury arising out of the Applicant's use of the right-of-way. The Applicant agrees they have no rights or claim to the right-of-way, now or at some point in the future. By the affixing of signatures below, the Applicant, agrees to all above terms of the Application and municipal Roadside Mowing Policy, as of the date signatures are executed.
