R.M. of ELLICE - ARCHIE OIL FIELD INDUSTRY POLICY 1 | P a g e Approved by Resolution #25-18 (Jan 2018) PRINCIPLES: Establishing an Oil Field Industry Policy ensures that the rules and regulations set forth by the council of are portrayed and communicated with any Oil Companies associated with the oilfield industry located within the RM of Ellice - Archie. It also serves to enhance the overall accountability and transparency of the municipality. The purpose of this policy is to outline Council's requirements for any Oil Companies associated with the Oil Field Industry activities within the municipality. PREAMBLE: This policy operates in addition to other policies and by-laws of the municipality. 1. SCOPE: This policy applies to all activities associated with the exploration, establishment, movement, or production of oil wells within the RM of Ellice - Archie. 2. SPRING ROAD RESTRICTIONS: The RM of Ellice - Archie implements Spring Road Restriction coinciding with the onset of Manitoba Infrastructure Spring Road Restrictions each year. The following parameters will govern all municipally owned roads within the municipality: a) Ellice - Archie Spring Road Restrictions will run concurrent with the Manitoba Infrastructure Spring Road Restrictions; b) Gravel Roads: Weight will be limited to 60 kg per 10 mm of tire width on any one axle assembly; c) Paved Roads: Weight will be limited to 45 kg per 10 mm of tire width on any one axle assembly; d) Speed limits on all roads will be reduced to 50 km/h for the entire duration of Spring Road Restrictions. Where the Oil Company / Hauler wishes to haul goods and materials over municipal roads during spring road restrictions, the municipality requires the hauler to enter into a Road Restriction Maintenance Agreement on a yearly basis. The agreement must be signed before spring road restrictions are implemented. Should the Oil Company / Hauler wish to utilize a road not included on the pre-approved route outlined in the Road Restriction Agreement; the hauler can complete a Consent to Use a Road Application. R.M. of ELLICE - ARCHIE OIL FIELD INDUSTRY POLICY 2 | P a g e Approved by Resolution #25-18 (Jan 2018) Anyone who is found to be NOT in compliance with the Spring Road Restriction Policy will have their agreement revoked for the duration of the Spring Road Restrictions. See Schedule "A": Road Restriction Maintenance Agreement See Schedule "B": Consent to Use a Road Application 3. CONSTRUCTION OR UPGRADING OF MUNICIPAL ROAD: The RM of Ellice - Archie requires an Oilfield Road Construction Agreement to be signed in the following situations: (1) Where the Oil Company requires access to haul on municipal roads not currently built to spec for heavy truck traffic; or (2) Where the Oil Company wishes to upgrade a road on a municipal road allowance. The following shall apply where it is necessary to construct or upgrade a road on a municipal road allowance for the purpose of oilfield access: a) Where the Public Works Foreman or the council deem it necessary a municipal road be upgraded prior to the Oil Company utilizing the road allowance for oilfield activity. b) Any request for the construction of a new road or the upgrade of an existing road requires the authority of the council of the municipality, such authority being granted via resolution carried at a duly called meeting. Once authority has been granted, the Administrator or their designate may sign any documents pertaining to this policy on behalf of the municipality. c) The Public Works Foreman shall be the supervising party regarding the construction of a new road or upgrading of an existing road for oilfield access. d) A representative or designate of the company or corporation initiating the construction of a new road or the upgrading of an existing road to access oilfield operations shall be required to sign the attached document entitled "Oilfield Road Construction Agreement" e) Requests for such construction or upgrading shall be made in writing, and where applicable, a copy of the plan of survey shall be submitted with the request. f) Where it is necessary to modify the "Oilfield Road Construction Agreement", or where it is in the best interests of the municipality, the terms of the Agreement may be altered to suit the case. However, this shall only occur upon resolution of council. See Schedule "C": Oilfield Road Construction Agreement 4. APPROACH USAGE OR CONSTRUCTION REQUEST: The RM of Ellice - Archie requires an Oil Company to obtain consent to construct an approach for oilfield activity purposes. All requests must be made in writing and must include a Well Site Plan. Should the R.M. of ELLICE - ARCHIE OIL FIELD INDUSTRY POLICY 3 | P a g e Approved by Resolution #25-18 (Jan 2018) approach require the installation of a culvert, the Oil Company must also include a completed "Municipal Minor Water Control Works" application. The Oil Company agrees to absorb all costs associated with the installation and maintenance of the approach. The Oil Company must also agree to build the approach to the following municipal standards: a) Culverts, if required, are to be placed in the toe of the back slope and must be a length of 11 to 12 meters depending on ditch depth; b) Flares on approaches where it meets the municipal road must be 15 to 18 meters in width; c) A 2 to 1 minimum side slope is required. d) Approach must be tapered from the road to the back slope at a minimum 1% decline. e) Approach surface to be gravelled with a minimum of 10 to 12 yards of crushed or screened gravel. RIGHT OF WAY AGREEMENT: The RM of Ellice - Archie requires the Oil Company to sign a Pipeline Right-of-Way Crossing Policy should the Oil Company wish to construct a pipeline across a municipal road allowance. See Schedule "E": Pipeline Right-of-Way Crossing Policy 6. RIG MOVE NOTIFICATION: The RM of Ellice - Archie requests that the hauler submits a Consent to Use a Road Application for approval before planned Drilling Rig Moves which includes: - proposed travel route (for approval) - Departure location - Destination - Date of proposed move See Schedule "B": Consent to Use a Road Application 7. MUNICIPAL EQUIPMENT REQUEST: Should an Oil Company make a request for the RM Public Works department to provide a service with RM owned equipment, the Oil Company will be charged according to current MHCA rates.
