WHEREAS the Rural Municipality is empowered under Part 7 of The Municipal Act S.M. 1996 ; Parts III, IV and VI of The Highway Traffic Act RSM 1985/86 ; and the Dangerous Goods Handling and Transportation Act RSM 1987, to regulate traffic and parking and the use of Streets and Sidewalks by by-law and to impose penalties for the violation of such by-law; AND WHEREAS it is deemed expedient and in the public interest to regulate traffic and parking and the use of Streets and Sidewalks in the Rural Municipality of Gimli. NOW THEREFORE THE COUNCIL OF THE RURAL MUNICIPALITY OF GIMLI IN OPEN SESSION ASSEMBLED, HEREBY ENACTS AS A BY-LAW AS FOLLOWS: ## INTERPRETATION 1. Title This Bylaw is to be referred to as the Traffic Bylaw. ## 2. Purpose The purpose of this bylaw is to fulfil the statutory responsibilities of the Rural Municipality of Gimli over its street and roads and to promote their safe use by motorists and pedestrians. ## 3. Authority The authority for this bylaw is the Municipal Act, the Highway traffic act, the off Road Vehicles Act, and in particular the Traffic and Transportation Modernization Act. ## 4. Definitions - a) Unless otherwise expressly provided or unless the context otherwise requires, words and expressions in this by-law have the same meaning as the same words and expressions in The Highway Traffic Act of the Province of Manitoba. Including the definition of the following words: highway, median, motor vehicle, parking, peace officer, pedestrian, snowmobile, stop, traffic control device, traffic lane, vehicle  - b) In this By-Law: - 1) "Act" means The Highway Traffic Act of the Province of Manitoba and current amendments thereto unless otherwise indicated. - 2) "All-terrain vehicle" shall have the same meaning as defined by the All-Terrain Vehicle Act, and shall include any and all recreational vehicles that cannot be licences for use upon provincial highways and roads. - 3) "Banner" means any sign, other than a Traffic Control Device, constructed of cloth, plastic or similar material, and erected across or adjacent to a Street for the sole purpose of promoting the Municipality in general or a recognized charitable organization, but shall not include commercial advertising signs. - 4) "Bicycle" means a device having any number of wheels upon which a person sits astride and which is propelled solely by human muscular power through use of pedals. - 5) "Bus" means a free-wheeled Vehicle having a self-contained source of motive power designed and used for transporting more than seven passengers for hire in the City authorized to pick up and deposit passengers, but also includes free-wheeled Vehicles used for transporting less than seven passengers for hire and operated by the Eastern Interlake Handivan Inc. Any Bus which does not meet these requirements shall, for the purpose of this by-law, be considered a Truck as hereinafter defined. - 6) "Bus Stop" means a designated portion of a Roadway adjacent to the Curb or road edge, where there is no Curb, reserved for the loading and unloading of passengers of Buses; and where the Parking, Standing and Stopping by all other Vehicles is prohibited. - 7) "Business" includes every trade, occupation, profession or venture conducted or carried on with a view to profit or gain. - 8) "Chief Administrative Officer" means the Chief Administrative Officer for the Rural Municipality of Gimli as appointed by by-law and anyone acting or authorized to act on his/her behalf. - 9) "Cite" or "Cited" means the issuance of a Traffic Citation in relation to violation of parking offences. - 10) "Council" means The Council for the Rural Municipality of Gimli.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - 11) "Crosswalk" means that part of a Street in an Intersection or elsewhere distinctly indicated for Pedestrian crossing by Traffic Control Device or by lines or other markings on the surface thereof and shall include the area adjacent to an Intersection which is unmarked but has a Sidewalk on both sides of the Roadway. - 12) "Dangerous Goods" means a dangerous good within the meaning of The Dangerous Goods Handling and Transportation Act and any regulations pursuant to that act. - 13) "Flag Person" means a Person authorized by the Public Works Department to direct traffic on a highway to ensure the safe movement of traffic during road construction or other public works. - 14) "Loading Zone" means a designated portion of a Street adjacent to the Curb or road edge, reserved for the exclusive use of Vehicles, including taxicabs, during the loading or unloading of passengers or goods. - 15) "Motorized Mobility Aid" means a device which is specifically manufactured or modified for operation by a physically disabled Person and which has: - i) a maximum speed capability of not more than 15 kilometres per hour; 7. ii) maximum width of not more than 81 centimetres, and 8. iii) a maximum mass of not more than 226 kilograms, and includes a motorized wheelchair. - 16) "Off Street Parking Area" means a parking area owned or operated by the Municipality. - 17) "Officer" means a person appointed or designated under section 130 of The Municipal Act and may include any officer of the municipality or a member of the Royal Canadian Mounted Police. - 18) "Parade" means any procession or body of Pedestrians, excepting members of Her Majesty's Armed Forces, standing, marching or walking anywhere on a Roadway, or any group of Vehicles, except a funeral or wedding procession or Vehicles of Her Majesty's Armed Forces, standing or moving anywhere on a Street and shall include all animal drawn Vehicles used for the conveyance of one or more Persons. - 19) "Park" means to Stand a Vehicle whether occupied or not, except when it is caused to Stand temporarily for the purpose of, and while actually engaged in, loading or unloading, or in obedience to an Officer or a Traffic Control Device, and "Parking" has a corresponding meaning. - 20) "Parking Lane" means an auxiliary Traffic Lane primarily or exclusively for the parking of Vehicles and shall be part of a Roadway as defined hereinafter.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - 21) "Physically Disabled Parking Authorization" means a decal, placard, or permit issued to a Person or organization by the Province of Manitoba or its delegate under Section 124.3 of the Act. - 22) "Reduced-speed school zone" means a portion of highway that is designated by a traffic authority under section 98.1 of the Act as a school zone that has a reduced maximum permitted speed at specific times or at all times. - 23) "Skateboard" means any platform or similar object suspended over two or more wheels and designed to be propelled by human power, this includes motor less scooter boards. - 24) "Snowmobile/snow vehicle" shall have the same meaning as defined in the All-Terrain Vehicle Act. - 25) "Travel Trailer/camper" means a vehicular portable structure designed to be used as temporary accommodation for travel, recreational and vacation purposes and which; is built on a chassis. is constructed as an integral part of a self-propelled vehicle or is designed primarily to be mounted on a pick-up or other truck chassis or is constructed of a canvas folding structure mounted on wheels and is designed to be independent of municipal sewer and electrical services ## II TRAFFIC CONTROL AND TRAFFIC CONTROL DEVICES ## 5. Traffic Authority - a) Until this by-law is amended to state otherwise, the Rural Municipality of Gimli Council shall be the Traffic Authority for all Streets, Lanes, and roadways, within the borders of the Rural Municipality of Gimli, with the exception of the following Provincial Highways; 8, 9, 222,229,231,324, 519. - b) The Traffic Authority shall exercise all the powers authorized by The Municipal Act, The Highway Traffic Act and The Dangerous Goods Handling Act, and the Traffic and Transportation Act and all powers as designated in this bylaw. - c) The Traffic Authority may, from time to time, enter into agreements with other parties to provide for the enforcement of some or all of the provisions of this By-Law within specific geographical areas by the Private Parties, their employees or agents, subject only to the limitation that the Private Parties may only exercise those powers of an Officer which are set out in Section 53.  ## 6. Traffic Control Devices The location of all Traffic Control Devices other than those Traffic Control Devices located on Provincial Highways, and designated Highways by the Province of Manitoba Department of Highways shall be approved by the Traffic Authority. - a) The Public Works Manager of the Rural Municipality of Gimli shall place and maintain or cause to be placed and maintained, all traffic signs authorized by the Traffic Authority. - b) With the exception of temporary Traffic Control Devices referred to in Section 7, no Traffic Control Device shall be installed on a Street within the jurisdiction of the Municipality without the prior approval of the Traffic Authority as evidenced by a resolution that has been passed by majority vote during a duly constituted Council meeting. - c) Subsection b) above shall not apply to the Department of Highways, its agents or employees with respect to Provincial Highways. - d) Those private properties with an internal Street system shall have installed, at the owner's expense, Traffic Control Devices at each point where the internal Street system interconnects with a Municipal Street or Road. - e) The location of Traffic Control Devices on Provincial Highways is not subject to this by-law. - f) The placement of any Traffic Control Device in contravention of this by-law by any Person, shall be an offence and such Traffic Control Device(s) shall be removed. ## 7. Temporary Traffic Control Devices - a) The Manager of Public Works shall place and maintain, or cause to be placed and maintained, temporary Traffic Control Devices for the purpose of prohibiting or regulating traffic where a Parade, Street/Road construction, repair, painting, snow removal or emergency occurs. - b) The Minister of Highways and Transportation, or his designate shall have the same authority as the Manager of Public Works as referred to in subsection a) above over Provincial Highways and Designated Highways. - c) When employees of Electric, Telephone, or Gas Utilities, or Private Firms are authorized, in accordance to do work in, upon, or under any Roadway within the jurisdiction of the Municipality, they shall, at their own expense, supply and place Traffic Control Devices in the manner approved by the Minister. Such signs shall be cleaned, maintained, repaired and replaced as often as is necessary to provide protection to the public to the satisfaction of the Minister.  ## Rural Municipality of Gimli Traffic By-Law # 18-0022 ## Rural Municipality of Gimli Traffic By-Law # 18-0022 ## III GENERAL USE PROVISIONS 8. Vehicles in Funeral Processions - a) The lead Vehicle in a procession shall use flashing yellow lights. - b) The Driver of every Vehicle in a funeral procession, indicated as such by the headlamps and four-way flashers of all Motor Vehicles therein being lighted, upon approaching a Traffic Control Signal showing a red Traffic Control Light, or a Stop Sign shall cause the Vehicle to slow down or Stop as may be necessary for safety, but may then proceed cautiously past the Traffic Control Signal or Stop sign. - c) The Driver of each of the Vehicles in the procession shall have the right of way over all other Vehicles upon the Street at the Intersection or place where the signal or Stop Sign is situated. - d) In the event any Vehicle is separated from the procession the four way flashers should be disengaged and normal driving practices resumed unless and until such Vehicle is again in direct line with the procession at which time the four-way flashers should again be lighted. - e) The driver of a vehicle shall yield the right-of-way to vehicles in a funeral procession, when such vehicles are identified as noted in b and shall not drive between the vehicles comprising a funeral procession while they are in motion, unless otherwise directed by a peace officer. ## 9. Horses and Domestic Animals - a) It shall be an offence for any Person to ride, lead or drive a Horse on, across, or along any Street, Boulevard or Sidewalk unless Written Permission to do so has first been obtained from the Traffic Authority. On Roadways situated in undeveloped areas within the Municipality, and where in the opinion of an Officer such action does not constitute a hazard to Pedestrian or vehicular traffic, the Officer, in his sole discretion, may choose not to compel compliance with this Section. - b) Notwithstanding subsection a), any Person who takes part in a Parade as authorized in accordance with Section 23, may ride or lead a Horse along the Parade route. - c) Any person who brings a domestic animal onto any Street, Boulevard or Sidewalk shall be solely responsible to keep it under control and to avoid it causing injury to any person or property. Such person shall immediately clean up and remove any fecal or other waste material deposit by his/her animal. - d) Any person who brings a horse or horses and sleigh or wagon onto any Street, Road, Boulevard or Sidewalk shall be responsible to ensure adequate safety measures are taken.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - e) Where a vehicle is towed by any animal, reflectors shall be placed on the animal's harness in such a manner as to be seen by oncoming traffic. Every Person riding, leading or driving a Horse shall be subject to all of the provisions of this by-law relating to the operation of Vehicles. - f) Where a vehicle is towed on the highway at a time when lamps on vehicles are required to be lighted, if it is being towed by an animal and has a width in excess of 2.05 metres (6.7 feet) at any part, it shall carry at least four clearance lamps or reflectors in a conspicuous position, one of which shall be placed at each side of the front of the vehicle and shall cast or reflect only a green or amber light forward, and one of which shall be placed on each side on the back of the vehicle, and shall cast or reflect only a red light rearwards. At least one of the reflectors shall be placed on the part of the vehicle that projects farthest to the right, and at least one shall be placed on the part of the vehicle that projects farthest to the left. 10. Farm Machinery and Heavy Equipment - a) The driver of a vehicle who is proceeding at less than the normal speed of traffic shall drive in the right hand lane then available for traffic, or as close as practicable to the right-hand curb or edge of the roadway. - b) No person shall drive or operate any vehicle on a roadway traveling at a speed less than 40 kilometers per hour unless, there is displayed on the back thereof a reflectorized warning device of a type approved by the traffic board indicating that it is a slow moving vehicle, or the vehicle is permitted to be equipped with, and is equipped with, a lamp that emits an amber light and that light intermittently flashes, and the lamp is in operation and the light therefrom is visible from the rear. - c) No person shall drive or tow agricultural equipment on a roadway at a speed greater than the lesser of, the lowest maximum rated speed set out on the sidewall of a tire of the agricultural equipment; or 70 km/h. - d) No person shall drive self-propelled infrastructure equipment on a roadway at a speed greater than 50 km/h. - e) No person shall drive agricultural equipment or infrastructure equipment on a provincial highway, or an urban municipality or a restricted speed area, while 9. (i) the person's driver's licence is suspended or cancelled; 10. (ii) the person is disqualified from holding a driver's licence; 11. (iii) the person is otherwise prohibited from driving a motor vehicle on a highway; or 12. (iv) the person is disqualified or prohibited from operating an off-road vehicle.  ## 11. Bicycles - a) Every Person riding a Bicycle shall be subject to all of the provisions of this by-law, insofar as they can be made applicable thereto. - b) The erection and use of Bicycle parking racks on Public Property may be authorized by the Manager of Public Works. - c) A person who is operating a bicycle shall not ride on a sidewalk in any way that interferes with the unencumbered movement of pedestrian traffic. He/she shall ride as closely as practicable to the right hand edge or curb of the street/Road. Persons operating a bicycle shall ride in single file. - d) Any person operating a bicycle shall obey the instructions of traffic signs and devices applicable to vehicles, and use hand signals to notify other drivers of his/her intent on the street/road. ## 12. Motorized Wheelchairs and Devices - a) Persons using motorized wheelchairs, medical scooters, segways or similar motorized mobility devises are considered to be pedestrians; and - b) May use the sidewalk or where no sidewalk is available, the curb lane of residential streets; and - c) Shall show reasonable consideration for other pedestrians including slowing when overtaking pedestrians to avoid collision. ## 13. Pedestrian Rights - a) Pedestrians have the right to safely use sidewalks, crosswalks and boulevards without hindrance or undue hardship from protrusions and blockages. - b) Where there is a sidewalk on either or both sides of a street, highway/road, pedestrians shall not walk on the roadway. - c) No vehicle, snowmobile, motorcycle, minibike, all-terrain vehicle, moped or any motorized vehicle or equipment shall be driven on a sidewalk or boulevard, but may be driven over an approach or sidewalk crossing.  ## Rural Municipality of Gimli Traffic By-Law # 18-0022 ## 14. Soliciting Rides on a Street It shall be an offence for any person to stand on a street for the purpose of soliciting a ride from the driver of a vehicle except when hailing a taxicab/vehicle for hire. ## 15. Restrictions on Sidewalks and Streets - a) No person shall allow the use of an extension cord, water hose, or any other item to be run across from his/her property onto a sidewalk, boulevard, approach, lane, laneway or other municipal or public space. - b) It shall be an offence for any Person to ride upon or use any cart, coaster, Skateboard, roller skates, roller blades, sleigh, skis, snowboard, skates, toboggan, toy vehicles, or similar device on a Sidewalk, Street/Road where it interferes with Pedestrian or vehicular traffic. ## IV GENERAL STREET REGULATIONS ## 16. Work in or upon any Street/Road - a) Subject to the provisions of subsection b hereof, in the interest of public safety, any Person desiring to work in or upon any Roadway within the jurisdiction of the Municipality must provide 48 hours' notice to the Manager of Public Works. - b) No work shall be commenced in or upon any Roadway without prior Written Permission of the Traffic Authority. - c) The Traffic Authority shall have the authority to restrict the hours during which such work shall be conducted on Arterial and Collector Roadways so as to minimize the disruption of pedestrians and traffic. - d) Subsections b and c above shall not apply to the Department of Highways, its agents or employees with respect to Provincial Highways ## 17. Damaging Structures in Streets - a) It shall be an offence for any Person to damage any Structure in, upon or under any Street. - b) It shall be an offence for any Person, other than a duly authorized employee or agent of the owner of the Structure, to climb, break, cut, willfully destroy, tear down, paint or deface or interfere with any Utility housing, or any light, power, telephone, police or fire alarm or signal  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 pole or tower or any other pole, tower, wire or cable or any guy wire or other support or accessory thereto. ## 18. Nuisance and Dangerous Conditions - a) It shall be an offence for any Person to place any Structure, or other obstruction in or upon any Walkway or Street and any Person who has placed any such building, Structure or obstruction in or upon any such land previous to the passing of this By-law shall remove such building, Structure or other obstruction after being given a reasonable time to do so by the Municipality. - b) Subsection a, is exempt by existing or future Encroachment agreements as authorized by the Traffic Authority. In the event that an emergency arises requiring such building, structure or other obstruction, to be moved forthwith, the Officer in charge or Fire Chief shall direct that such building, structure or obstruction be removed, and the cost of such removal shall become a charge against the owner thereof and may be assessed and collected by the Municipality in the same manner as municipal taxes. This restriction shall not apply to approved Traffic Control Devices or other approved structures installed or erected in accordance with the provisions of this by-law or the Act. - c) It shall be an offence for any Person to throw, pile, deposit, or leave any articles, merchandise, water or material of any kind in or upon any Street or Boulevard. It shall be an offence for any person to carry out or permit any action causing or resulting in the creation of a nuisance or dangerous condition in or on any Street or Boulevard. This section shall not be construed to interfere with the reasonable use of a portion of a Street or Boulevard for a reasonable time during the taking in or delivery of goods, wares, or merchandise as provided for herein, or as may be required under the Municipalities Solid Waste By-law, as amended. ## 19. Special Events - a) The Council by Resolution may, at their discretion, authorize the temporary use of Streets and/or Sidewalks for special events such as Sidewalk sales, and block parties and other like events. - b) Any Person desiring to hold such an event as referred to in subsection a) above, shall make application to the Chief Administrative Officer for permission for a Special Event. - c) The Rural Municipality of Gimli may close any street/road or portion thereof for the purpose of conducting a special event thereon and provided proper signage is in place 24 hours prior to the event taking place.  ## 20. Remedial Action - a) The Manager of Public Works may or cause to have remedy, remove or repair any nuisance or dangerous condition in a Street, including the removal of any unauthorized Structure, pole, post or material in a Street. - b) The Manager of Public Works may or cause to have erected and maintain any barricades or other protective device in a Street for the purpose of preventing a breach of this bylaw or to prevent a hazardous condition in a Street resulting from an action contrary to this by-law. - c) The cost of any remedial actions undertaken in accordance with the above authority may be charged to the Person responsible for the contravention of this by-law and collected in the same manner as ordinary municipal taxes. ## 21. Snow Ice or Dirt - Business Premises - a) Every occupant, and in case there is no occupant, the owner or Person having charge or care of every business building fronting or abutting on any Street or public place within the Municipality shall strive to maintain a safe clean sidewalk. - b) Each day, following a snowfall, hail or rain which may have frozen on the Sidewalk, or after a fall of snow or ice off any building, cause the same to be removed entirely off the Sidewalk fronting or abutting the building. In the event the ice or snow shall be so frozen that removal would damage the Sidewalks, every such Person shall strew the Sidewalk with salt, sand or other like substances. - c) Each day, remove from the Sidewalk fronting or abutting the building all dirt, debris and other obstructions. In some cases hosing off the sidewalk may be warranted more than once during the day, to prevent the attraction of pests. - d) If the snow, ice, dirt or other obstruction has not been removed as set out in subsections a) and b), the Manager of Public Works may cause such ice, dirt or obstruction to be removed at the expense of the owner, and the same may be recovered by the Municipality in the same manner as other municipal taxes. ## 22. Snow Ice or Dirt - All Properties - a) It shall be an offence for any Person to push, shovel or blow, snow, slush, ice, leaves or other debris, from any property onto any municipal roadway, walkway, or property. This practice could negatively impact drainage, or create a hazardous condition for either vehicular or pedestrian traffic, or otherwise impede the snow removal efforts of the Municipality or Manitoba Infrastructure and Transportation. ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - b) Subsection (a) above shall not apply to the Municipality, the Department of Highways, their agents or employees who are actively engaged in snow removal from Streets, Boulevards or Sidewalks in the course of their employment or fulfillment of contract. - c) Any Person occupying a property where a building abuts the property line adjacent to a Street in such a manner that snow cannot be cleared onto the property may pile the snow at the Curb line of the Street in such a manner that both vehicular and Pedestrian traffic can pass only if a hazardous condition is not created when snow is piled in this manner. - d) The Rural Municipality of Gimli may designate any street/road or portion thereof as a "Snow Route" for the purpose of regulating or prohibiting the flow of traffic for a maximum of 48 hours after any given snowfall as deemed necessary to speed the cleanup of said roadway provided proper signage is in place 24 hours prior to cleanup. ## 23. Avoiding Conflict with Fire Apparatus - a) It shall be an offence for any Person, except by direction of the Fire Chief to drive or bring any Vehicle within 30 metres of any fire apparatus on route to or at the scene of a fire. - b) No person shall drive a vehicle over any unprotected fire hose extended for firefighting purposes. - c) No person shall enter or park within an area where emergency personnel are actively performing firefighting, rescue or other emergency work. - d) No person shall willfully fail or refuse to comply with any lawful order or direction of a fire department official in enforcing this bylaw. ## 24. Parades - a) It shall be an offence for any Person to hold, take part in or be a member of a Parade unless, the Parade is under the direction or control of a Parade Marshall, and such Parade has been duly authorized by the council of the Municipality. - b) Any person desiring to hold a parade shall apply to the Chief Administrative Officer of the Rural Municipality of Gimli in writing for permission therefore not less than four weeks prior to the time set for commencement of the parade. The request shall specify the nature of the parade, the day and hour at which it is to be held, the place of formation and dispersal, the exact route to be followed and the estimated time for the parade to pass. - c) Upon approval of the parade application, by a resolution of Council, the manager of public works shall arrange to provide for barricade pickup and placement by the Parade official.  ## Rural Municipality of Gimli Traffic By-Law # 18-0022 - d) The Parade Marshal shall be responsible for ensuring the proper policing of streets, directing of traffic during the parade and the return of barricades after the parade - e) While a parade is in progress, pedestrians not participating shall be restricted to the adjoining sidewalk. - f) Unless so directed by an Officer, it shall be an offence for any Person, other than the operator of an Emergency Vehicle, to drive a Vehicle through a Parade. ## V GENERAL TRAFFIC RESTRICTIONS ## 25. Clinging to Motor Vehicle - a) No person riding upon or using any vehicle or device shall attach the same or himself/herself to any moving vehicle upon a highway or roadway. - b) No driver of any moving vehicle shall permit any such person to attach himself/herself to any vehicle. ## 26. Driving Through Barricaded Streets - a) Unless otherwise directed by an Officer or Traffic Control Device, it shall be an offence for any Person to drive a Vehicle, on any portion of a Street that has been, barricaded roped or otherwise indicated to be closed to traffic. - b) Subsection a does not apply to Vehicles engaged in related construction. 27. Not to Damage Roadways - a) It shall be an offence for any Vehicle having corrugated or flanged metal wheels, or any device which is dragged or hauled without wheels, or anything so constructed or loaded in such a manner as to damage the Roadway. The owner or operator of the Vehicle shall be responsible for any damage done to the pavement or other surface of any Roadway. Such repairs will be carried out by the Municipality and the costs paid by the owner and/or operator of the Vehicle which damaged the Roadway. - b) It shall be an offence for any person to damage or remove material. Including but not limited to gravel and limestone, from a roadway in any manner that may cause damage to the surface of the roadway. - c) It shall be at the discretion of Council whether a bond may be required where construction equipment is being used for yard or building construction. 28. Vehicles No Loud Speaker - a) No person shall create or cause a disturbance of the peace by blowing of horns, or squealing of tires, or operating vehicles with no muffle. - b) It shall be an offence for any Person to use a loud speaker on or from any Vehicle on the Roadway unless authorized and directed by the Fire Chief. 29. Highway Restrictions - a) All highways and roadways within the boundaries of the municipality will have weight restrictions, which will be in accordance with the Provincial Road Restrictions. Restriction dates will be determined by the annual restriction dates imposed by Infrastructure and Transportation, Province of Manitoba. - b) Exceptions for vehicles carrying essential commodities will be as described and specified in the Spring Road Restrictions Bulletins issued by the Province of Manitoba. - c) A peace officer/by-law enforcement officer may at any time stop and weigh, or cause to be weighed, any vehicle or any vehicle and load, on a highway. The Officer may require that the vehicle be driven to any scale capable of weighing the vehicle and its load. - d) No action lies against a peace officer/by-law enforcement officer or against the Municipality for loss or damage suffered by any person resulting from the enforcement of or compliance with this section.  ## 29. U Turns - a) It shall be an offence for any Driver to turn a Vehicle so as to proceed in the opposite direction (U Turn) where there is a Traffic control device prohibiting it, or there is a Signalized intersection, or at any intersection with a 3 or 4 way stop. - b) No person shall make a U Turn at any intersection on Centre Avenue. - c) U turns are permitted at intersections only. - d) Such U-turn where otherwise permitted, are not allowed if it would interfere with other traffic or Pedestrians.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 ## VI GENERAL TRAFFIC REGULATIONS ## 31. Speed in the Municipality - a) All urban areas, including towns, villages, local urban districts, neighborhoods, and subdivisions are restricted speed areas within the Rural Municipality of Gimli. - b) All rural areas, except for provincial Highways; 8, 9, 222, 229, 231, 324, and 519, shall be a maximum speed of 90 kilometers per hour unless otherwise posted. - c) Signs shall be posted at the entrance to a restricted speed area stating that the speed limit is 50 kilometers per hour, unless otherwise posted. - d) A traffic authority must not fix a speed limit of less than 20 km/h. - e) It shall be an offence for any person in control of a vehicle to travel on any street/road at a greater speed than 50 kilometers per hour, in a restricted speed area. - f) It shall be an offence for any person in control of a vehicle to travel on any street/road at a greater speed than 30 kilometers per hour in a reduced-speed school zone. - g) It shall be an offence for any person in control of a vehicle to travel on any Road/Highway within the Municipality of Gimli at a speed greater than 70 kilometers per hour, in a modified speed zone. - h) It shall be an offence for any person in control of a vehicle to travel on any Road/Highway within the Municipality of Gimli at a speed greater than 90 kilometers per hour, with exception to provincial highways as listed in b above. ## 32. Modified Speed Zones - 51 - 90 km/h - a) That portion of P.T.H. No. 8 situated in the RM of Gimli beginning at the point 400 meters south of its centre point of intersection with P.R. No. 231 and continuing in a northerly direction for a distance of 700 meters metres is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 70 km/h. - b) That portion of P.T.H. No. 9 situated in the RM of Gimli beginning at the point where the northern boundary of Colville Drive or the production thereof crosses the highway and continuing in a southerly direction for a distance of 1.15 kilometers metres is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 70 km/h.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - c) That portion of P.R. No. 222 situated in the R.M. of Gimli lying between the point 200 metres north of the point where the northern boundary of Fifth Street North or the production thereof crosses the highway and the point where the southern boundary of P.R. No. 324 or the production thereof crosses the highway is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 80 km/h - d) That portion of P.R. No. 231 situated in the R.M. of Gimli in the vicinity of the Town of Gimli lying between the point where the western boundary of P.T.H. No. 9 crosses the highway and the point where the eastern boundary of P.T.H. No. 8 crosses the highway is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 70 km/h. - e) That portion of P.R. No. 231 situated in the R.M. of Gimli in the vicinity of the Gimli Industrial Park beginning at the point where the western boundary of P.T.H. No. 8 crosses the highway and continuing in a westerly direction for a distance of 1.7 km is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 80 km/h. - f) That portion of Colonization Road situated in the R.M. of Gimli in the community of Arnes beginning at the point where the southern boundary of section 16-21-4 EPM crosses the highway and continuing in a north easterly direction for a distance of 500 metres is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 70 km/h. - g) That portion of P.R. No. 222 situated in the R.M. of Gimli in the vicinity of the community of Arnes beginning at the point 150 metres north of the point where the northern boundary of the NE ¼ 8-21-4 EPM crosses the highway and continuing in a southerly direction for a distance of 800 metres is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 70 km/h. - h) That portion of the Arnes Access Road situated in the R.M. of Gimli in the vicinity of the community of Arnes lying between the point 800 metres east of the point where the eastern boundary of P.T.H. No. 8 crosses the highway and the point where the western boundary of P.R. No. 222 crosses the highway is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 70 km/h. - i) That portion of Beachside Road situated in the R.M. of Gimli lying between the point where the eastern boundary of Trevino Trail crosses the highway and the point where the C.P.R. rightof-way crosses the highway is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 70 km/h.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - j) That portion of Distillery Road situated in the R.M. of Gimli in the vicinity of the Town of Gimli beginning at the point where the western boundary of P.R. No. 222 crosses the highway and continuing in a westerly direction for a distance of 800 metres is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 70 km/h. - k) That portion of Gimli Park Road situated in the R.M. of Gimli lying between the point where the eastern boundary of P.T.H. No. 8 crosses the highway and the point where the western boundary of P.T.H. No. 9 crosses the highway is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 70 km/h. - I) That portion of P.R. No. 519 situated in the R.M. of Gimli in the vicinity of Sandy Hook lying between a point 550 metres west of the point where the western boundary of P.T.H. No. 9 crosses the highway and a point 50 metres west of the point where the western boundary of Trevino Trail crosses the highway is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 70 km/h. - m) That portion of Trevino Trail situated in the R.M. of Gimli lying between the point where the northern boundary of P.R. No. 519 crosses the highway and the point where Beachside Road crosses the highway is designated as a modified speed zone and the maximum speed for vehicles being driven in that zone is fixed at 70 km/h 33. Restricted Speed Zones - 50 km/h - a) That portion of P.T.H. No. 9 situated in the RM of Gimli and in the town of Gimli lying between the point where the northern boundary of Colville Drive or the production thereof crosses the highway and the point where the northern boundary of Fifth Street North or the production thereof crosses the highway are designated as a restricted speed area. - b) That portion of P.T.H. No. 9 situated within the boundaries of the Town of Gimli is excluded from the restricted speed area. - c) That portion of P.T.H. No. 9 situated in the Town of Winnipeg Beach and in the RM of Gimli lying between its centre point of intersection with P.R. No. 229 also known as Park Avenue and the point where the southern boundary of Pine Avenue or the production there of crosses the highway are designated as a restricted speed area. - d) That portion of P.T.H. No. 9 situated in the RM of Gimli lying between the point where the southern boundary of Pine Avenue in the Town of Winnipeg Beach or the production thereof crosses the highway and continuing in a northerly direction to the point 50 meters north of the point where the southern boundary of Seventeenth Avenue or the production thereof crosses the highway in the community of Sandy Hook is designated as a restricted speed area during the period beginning on the Friday before the third Monday of May and ending on the Tuesday after the first Monday of September in each year.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - e) The following highways or portions of highways in the Rm of Gimli within the Sandy Hook Golf Course are designated restricted speed areas; Clubhouse Road, Hogan's Alley, Nicklaus Close, Palmer Place, Player Park Road, and Sandy Links Lane, are designated as a restricted speed area. - f) All those highways and portions of highways situated in the R.M. of Gimli lying east of the eastern boundaries of P.T.H. No. 9 and P.R. No. 222 excluding those that are modified speed zones that are within the following described boundaries are designated as a restricted speed area: - i) bounded on the north by the northern boundary of the R.M. of Gimli; 4. ii) bounded on the south by the southern boundary of the R.M. of Gimli; 5. iii) bounded on the west by the eastern boundaries of P.T.H. No. 9 and P.R. No. 222; and 6. iv) bounded on the east by the western shore of Lake Winnipeg. - g) That portion of P.R. No. 222 situated in the R.M. of Gimli in the vicinity of the Town of Gimli beginning at the point where the northern boundary of Fifth Street North or the production thereof crosses the highway and continuing in a northerly direction for a distance of 200 metres is designated as a restricted speed area. - h) All those highways and portions of highways situated in the R.M. of Gimli that are within the boundaries of the community known as the Aspen Park Development are designated as a restricted speed area. - i) All those highways and portions of highways situated in the R.M. of Gimli in the vicinity of Boundary Park as shown on Plan No. 933 that are within the SE ¼ 4-18-4 EPM are designated as a restricted speed area. - j) That portion of P.R. No. 324 situated in the R.M. of Gimli in the vicinity of Camp Morton beginning at the point where the western boundary of P.R. No. 222 crosses the highway and continuing in a westerly direction for a distance of 250 metres is designated as a restricted speed area. - k) All those highways and portions of highways situated in the R.M. of Gimli that are within the boundaries of the development known as Gimli Industrial Park within the NW ¼ 18-19-4 EPM and the NE ¼ 13-19-3 EPM are designated as a restricted speed area. - 1) That portion of Husavick Road situated in the R.M. of Gimli beginning at the point where the western boundary of P.T.H. No. 9 crosses the highway and continuing in a westerly direction for a distance of 400 metres is designated as a restricted speed area.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - m) All those highways and portions of highways excluding P.T.H. No. 9, P.R. No. 222 and P.R. No. 231 situated in the R.M. of Gimli in the community of Loni Beach that are within the boundaries of the E ½ 20-19-4 EPM the NE ¼ 17-19-4 EPM and in all of section 21-19-4 EPM are designated as a restricted speed area. - n) All those highways and portions of highways excluding P.T.H. No. 9 situated in the R.M. of Gimli in the community of Sandy Hook that lie within the boundaries of the NE ¼ and the W½ 9-18-4 EPM and that portion of section 16-18-4 EPM that lie east of the C.P.R. right-of-way Plan No. 1217 are designated as a restricted speed area. - o) That portion of P.R. No. 519 situated in the R.M. of Gimli in the vicinity of the community of Sandy Hook beginning at the point where the western boundary of P.T.H. No. 9 crosses the highway and continuing in a westerly direction for a distance of 550 metres is designated as a restricted speed area. - p) That portion of Seventeenth Avenue situated in the R.M. of Gimli lying between the point where the C.P.R. right-of-way crosses the highway and the point where the western boundary of P.T.H. No. 9 crosses the highway is designated as a restricted speed area. - q) All those highways and portions of highways excluding P.T.H. No. 9 situated in the R.M. of Gimli in the community of South Beach that are within the boundaries of the E ½ 8-19-4 EPM the SE ¼ 17-19-4 EPM and in all of section 9-19-4 EPM are designated as restricted speed areas. - r) That portion of P.R. No. 229 situated in the R.M. of Gimli in the vicinity of the Town of Winnipeg Beach beginning at the point where the western boundary of P.T.H. No. 9 crosses the highway and continuing in a westerly direction for a distance of 1.0 km is designated as a restricted speed area. 34. Reduced Speed Zones - Below 50 km/h - a) Sigurbjorg Stefansson Early School - 11 Autumnwood Drive - i) That portion of Autumnwood Drive beginning 150 meters south of the southwest property boundary of the Sigurbjorg Stefansson Early School and continuing in a northerly direction and ending at the point where the south boundary of Solvin Road meets Autumnwood Drive; and 10. ii) That portion of Centennial Road that is parallel to the south boundary of the Sigurbjorg Stefansson Early School at the point where the east boundary of Autumnwood Drive meets Centennial Road and continuing in an easterly direction and ending at the point where Centennial Road meets the Gimli Recreation Centre parking lot. - b) Dr. George Johnson Middle School - 53 Third Avenue  ## Rural Municipality of Gimli Traffic By-Law # 18-0022 - i) That portion of Third Avenue beginning at the point where the south boundary of Goldfield Drive meets Third Avenue and continuing in a northerly direction and ending at the point where the north boundary of Barney Thomas Drive meets Third Avenue; and 2. ii) That portion of Barney Thomas Drive beginning at the point where the west boundary of Third Avenue meets Barney Thomas Drive and continuing in an easterly direction and ending at the point where the east boundary of Second Avenue meets Barney Thomas Drive; and 3. ili) That portion of Second Avenue beginning at the point where the south boundary of Goldfield Drive meets Second Avenue and continuing in a northerly direction and ending at the point where the north boundary of Barney Thomas Drive meets Third Avenue. - c) The reduced speed zone with a maximum speed of 30 kilometers per hour, apply from 7:00 a.m. to 6:00 p.m. Monday to Friday from September 1 to June 30. - d) All of Willow Island Road is a reduced speed zone with a maximum speed of 40 kilometers per hour. - e) All those highways and portions of highways known as Back Lanes situated in the R.M. of Gimli are designated as reduced restricted speed areas and the maximum speed for vehicles being driven in those areas is fixed at 30 km/h - f) All those highways and portions of highways situated within the boundaries of the Town of Gimli commonly known as Back Lanes are designated as reduced restricted speed areas and the maximum speed for vehicles being driven in those areas is fixed at 20 km/h. ## 35. Blocking Intersection Notwithstanding any Traffic Control Device indication to proceed, it shall be an offence for any Driver of a Vehicle to enter an Intersection unless there is sufficient space on the other side of the Intersection to accommodate the Vehicle without obstructing the passage of Pedestrians or other traffic. ## 36. One Way Lane The lane running in a North South direction located along the lake is a one way lane, from the end of Goldfield to Barney Thomas Drive. Vehicles must proceed in a north direction. ## 37. Engine Retarder Brake No person shall engage, operate, apply or otherwise use an engine retarder brake on any vehicle driven in the Rural Municipality of Gimli, except in an emergency where it is necessary in the circumstances to do so.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 ## VII STOPPING, STANDING AND PARKING ## 38. Method of Standing or Parking of Vehicles Unless otherwise required by Traffic Control Devices or by other provisions of this By-law, it shall be an offence for any Person to Stop, Stand or Park a Vehicle, except an Emergency Vehicle, on any Roadway other than parallel with the Curb, headed in the direction of vehicular traffic movement in the adjacent Traffic Lane with the Curb-side wheels of the Vehicle or Bus within 45 centimeters of the Curb, and a clear space of 1 metre left ahead and behind. This provision shall not be enforced if: - a) two Vehicles are parked less than 1 metre apart if both Vehicles have sufficient space separating them from any further Vehicles so as to be able to freely exit from the parking space; or - b) snow has accumulated to such an extent that Vehicles cannot park adjacent to the Curb, in which case a Vehicle shall park within 45 centimetres of the snowbank so long as the Vehicle is Stopped or Parked in compliance with Section 42 hereof. 39. Angle Parking - a) It shall be an offence for any Person to park a Vehicle diagonally on any Roadway except where Traffic Control Devices indicate that a Vehicle may be so parked. - b) Notwithstanding Subsection a), it shall be an offence for any Person to Park, Stand or Stop a Vehicle exceeding 6 metres in length diagonally at any time. 40. General Standing and Parking Prohibitions - a) Except when authorized by the Traffic Authority, no Person shall obstruct or encumber any Street or Sidewalk by placing thereon any goods, wares or merchandise or other articles, outside of any shop, warehouse, or other building, which shall project over any portion of the Sidewalk or Street beyond the line, or front, of such Person's property, but the provisions of this clause shall not be construed to interfere with the use of the portion of such Street or Sidewalk for a reasonable time during the taking in or delivering of goods, wares or merchandise. - b) No Person or Persons shall stand in groups, or sit, or lounge, on a Street or Sidewalk in such a manner as to cause, or to be likely to cause, any obstruction to the free use of said Street or Sidewalk by any other Person. - c) No Person shall Park any Vehicle: - i) in a Lane, on a Sidewalk or on a Boulevard;  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - ii) on any Street for a period of time longer than seven (7) consecutive days; - iii) at the entrance to a Lane or to any Approach leading into public or private premises so as to obstruct the ingress or egress of Vehicles; - iv) within an Intersection, or within 3 meters of an Intersection; - v) within 3 metres of a fire hydrant or when the hydrant is not located at the Curb, within 3 metres of the point on the Curb nearest the hydrant; - vi) on a Crosswalk, or within 3 metres of the Approach side of a Crosswalk; - vii) on the Roadway side of a Vehicle Stopped or parked at the Curb of a Street; - vili) on a Roadway with the left side of the Vehicle to the Curb, except in a one-way street; - ix) upon any bridge, overpass or other elevated Structure; - x) within 15 metres of any portion of a Street or Lane underneath a bridge, overpass or other elevated Structure. - xi) in any Off-Street Parking Area for a period of time longer than 24 consecutive hours. - xii) in a designated parking space, or in a manner that makes a designated parking space inaccessible, unless the vehicle displays a permit in accordance with the Highway Traffic Act. - xili) In contravention of any traffic sign, device or painted road markings put in place by the Municipality or that have been required to be put in place by the municipality. - xiv) No person shall park any vehicle on the roadways within the boundaries of Winnipeg condo Plan 208 commonly known as Aspen Park. - d) Except on those Streets and during those times shown on signs indicating that restricted parking is permitted. 41. Parking of Large Trucks, Buses, Trailers, Recreational Vehicles and Travel Trailers - a) Subject to the exemptions provided in Section 44 herein, no person shall park or leave a truck, a truck trailer, a semi-trailer detached from a truck tractor on any roadway/street or public parking lot within the Rural Municipality of Gimli. - b) No person shall park or leave any recreational trailer, including a travel trailer/camper, a bus which has been converted into a travel trailer, a fifth wheel whether or not it is connected to a  ## Rural Municipality of Gimli Traffic By-Law # 18-0022 motor vehicle, or any other recreational vehicle, on any Roadway/street or parking lot within the Rural Municipality of Gimli. - c) No Person shall park a Vehicle on a Roadway/Street or in any parking lot, without permission of the Traffic Authority, when such Vehicle displays and/or advertises goods for sale. ## 42. Temporary Designated No Parking Zones That temporary No Parking be in place from May 1 to June 15 and September 15 to October 30 of each year on the East side of 1s* Avenue in front of the Yacht Club compound gate. The no parking zone shall be located on the east side of 1s Avenue being the most northerly twenty feet from the north boundary of the Yacht Club Compound Gate and the most southerly twenty feet from the south boundary of the Yacht Club Compound Gate. ## 43. Exemptions to Parking Provisions The provisions of this by-law, relating to Stopping, Standing or Parking shall not apply to: - a) Vehicles of the Police Service and/or the Fire Department while used in the course of duty (excepting paid breaks); - b) Vehicles of, or employed by, the municipality while in use in connection with work of necessity being done on or near a Street requiring them to Stop, Stand, or be parked in contravention of any such provisions; - c) other clearly marked Municipality Vehicles parked at time limited parking zones while the Drivers of the Vehicles are engaged in municipal business (excluding paid breaks); - d) Vehicles of, or employed by, the Government of Manitoba, the Government of Canada, or a public Utility, if such Vehicles have the owner's name painted thereon, or can otherwise be identified as such, and are actually engaged in work of necessity on or near a Street requiring them to Stop or be parked in contravention of any such provisions; - e) any other Vehicles identified by a valid Special Parking Permit issued by the Traffic Authority insofar as same is provided in accordance with the terms set out on the permit; or - f) armoured Vehicles while used in the course of duty, providing a Driver remains in the Vehicle at all times, is prepared to move the Vehicle if required, and the Vehicle is not Parked or Stopped in such a manner as to constitute a hazard. ## 44. Designated Accessible Parking  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 All Designated Accessible parking stalls shall be signed and have pavement marking as a designated stall for the sole use of vehicles displaying an Accessible Parking Permit. - a) Designated Accessible Parking at Schools; - i) the parking stall immediately to the North of the 'Loading Zone' on the East side of 3". Ave. in front of Dr. George Johnson Middle School. 3. ii) the first parking stalls immediately to the East and West side of the sidewalk at the South entrance to the Sigurbjorg Stefansson Early School. 4. iii) the first parking stall at the gym door located on the South West side of the Gimli High School. 5. iv) the first stalls immediately to the North and South of the sidewalk fronting the parking lot located on the East side of Gimli 1915 Public School. - b) Designated Accessible Parking at Health Centres; - i) the first parking stall North of the Emergency Entrance to Johnson Memorial Hospital on the East side of 7th . Avenue 8. її) the first 3 parking stalls off the Main Entrance to Johnson Memorial Hospital on the West side of 6th . Avenue - c) Designated Accessible Parking at Churches; - i) the first three parking stalls on the Municipal Road Allowance on the west side of 3d Avenue as located on the east boundary of Lot 97/98 Block 4 Plan 17671 L owned by the Lutheran Congregation of Evangelical Trustees and extending Southerly 35 feet on the West side of Third Avenue from the point where it intersects with the south side of Keenora Street - d) Designated Accessible Parking at Businesses; - i) the stall at the entrance to the Lighthouse Mall on the West side of 3d Avenue. 13. ii) the parking stalls North and South off the entrance to the Gimli Theatre on the West side of . Avenue. - e) Designated No Parking at Public Areas; - i) the parking stalls on the East and West side of the walkway entrance to the Spray Park on the North side of Amisk Street.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - ii) the parking stalls on the East and West side of the walkway entrance to the Gimli Park Pavilion shall be established as designated parking spaces. - ill) the first two stalls on the North/West corner of the Public Library located on the South/East side of 1. Avenue and Goldfield Drive. - iv) the first four stalls immediately South of the South side entrance to the Curling Rink - v) the first two duly stalls on the East side of the laneway East of 15t Avenue and Goldfield Drive in the Public Parking lot. - vi) the first two parking stalls on the East side of the laneway East of 1st. Avenue and Keenora Street in the Public Parking lot - vii) the two parking stalls on the East side of the Public Parking Lot located between Keenora and Barney Thomas Drive and immediately North and South of the 'No Parking/Service Vehicles Only posted signs. - f) Designated No Parking Between Signs; - i) the stalls immediately to the North and South entrance of New Haven Lodge on the West side of 2nd . Avenue No Parking Between Signs' - ii) the parking area immediately to the North and South entrance of New Harbour Lodge on the West side of 5th '. Avenue shall be established as 'No Parking Between Signs'. - g) Designated No Parking Service Vehicles only; - i) the parking stalls on the East side of the Public Parking Lot located between Keenora and Barney Thomas Drive and adjacent to the Concession Stands. - h) Designated No Parking Zones; - i) all dead-end roadways or streets within the Rural Municipality of Gimli that dead end east of Highway # 9 at the lake shall be deemed and designated No Parking Zones. - ii) on the East and West side of Mercury Drive. - ili) On the North Side of Thompson Drive from Corona Crescent for 520 feet in a westerly direction.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 iv) on the East and West side of Corona Crescent, from Thompson Drive intersection for 175 feet north-easterly. ## 45. Parking Prohibited for Snow Clearing - a) No person shall stop, stand or park or cause to stop stand or park any vehicle on any highway or roadway within the limits of the Rural Municipality of Gimli so designated and property signed as a Snow Route between the hours of 12:01 a.m. and 7:00 a.m. during the period from the 15t* day of November in any year to the 315 day of March in the following year inclusively. - b) Centre Street, Goldfield Street and First Avenue shall be designated a Snow Route. 46. Parking on Private Property - a) It shall be an offence for any Person to park or leave a Vehicle on Private Property or any Off Street Parking area on which there is erected and maintained a Traffic Control Device(s) indicating: - i) that the parking of Vehicles thereon is prohibited; or 6. ii) that parking of Vehicles is prohibited without the permission of the owner, occupant or the Person in charge or control of the property, and such permission has not been obtained; or 7. iii) that parking of Vehicles thereon during the period indicated, without the permission of the owner, occupant or the Person in charge or control of the property, and such permission has not been obtained, is prohibited; or 8. iv) that the posted area is designated as a physically disabled Persons parking zone, unless that vehicle is displaying a permit in accordance with The Highway Traffic Act and the regulations under that Act. - v) that the posted area is designated as a Fire Lane. - b) The owner, occupant or Person in charge or control of Private Property who wishes to take advantage of the regulations in this Section for the purpose of keeping Persons or unauthorized Persons from parking or leaving Vehicles on the property or within certain Parking Stalls shall erect and maintain thereon clear and legible signs, at least 18 inches square with printed letters at least 2 inches high which indicate that, pursuant to the Municipalities Traffic By-law, parking is prohibited or is restricted to certain users, such as customers or physically disabled Persons, or to certain days or times. - c) In cases where special permits are issued to designate certain Persons as authorized users of a private parking area or Parking Stall, such as physically disabled parking permits, the Sign which restricts parking in that area or stall shall also state 'permit must be displayed'.  ## Rural Municipality of Gimli Traffic By-Law # 18-0022 - d) For the purpose of this section, an unauthorized parked Vehicle shall mean any and all Vehicles parked or left standing on Private Property contrary to subsections a), b), or c) above. - e) Pursuant to subsections b) and c) above, the property owner, occupant or Person in charge or control, shall establish a suitable system for the allocation of authorized or reserved parking spaces on each property and shall be responsible for determining whether or not any specific Vehicle is authorized to park in a particular Parking Stall. - f) Pursuant to subsections b) and c) above, the property owner, occupant or Person in charge or control, shall allow any Vehicle displaying a "Physically Disabled Parking" authorization symbol to park in a "Physically Disabled Parking only" parking lot or Parking Stall. - g) It shall be an offence for any Person to park a Vehicle in such a lot in a manner that makes a "Physically Disabled Parking only" Parking Stall inaccessible, unless a Physically Disabled Parking Authorization permit is displayed in the Vehicle and is used in accordance with the Act and the regulations of the Act. - h) For the purpose of this section and Section 57, any revenues generated from fines collected as a result of the enforcement of these sections shall be paid to and retained by the Municipality to help cover the costs of such enforcement. ## 47. Off Street Parking Lots - a) Where stalls or allotments are designated or marked out within any Off-Street Parking Area, every Person parking a Vehicle within any such area shall park the same so that the Vehicle shall conform to the direction of parking and be wholly within the boundaries of such stall or allotment. Failure to do so shall constitute an offence under this By-law. - b) It shall be an offence for any Person to park a Vehicle in such a lot, whether lined or unlined, in such a manner as to impede the free flow of traffic within such lot, or in a manner that makes a "physically disabled Parking only" Parking Stall inaccessible, unless a Physically Disabled Parking Authorization permit is displayed in the Vehicle and is used in accordance with the Act and the regulations under the Act. - c) It shall be an offence for any Person to park a Vehicle in a Parking Stall if such stall has been designated "no unauthorized parking" or "reserved parking only" or "physically disabled parking only" unless specifically authorized to so park by a designated official of the municipality. ## VIII OTHER VEHICLE REGULATIONS 48. General Regulation  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - a) Snowmobiles and all-terrain vehicles are prohibited in all urban areas, rural subdivisions, and the Rails to Trails system, within the Rural Municipality of Gimli, with the exception of designated routes. - b) Every operator of a Snowmobile or all-terrain vehicle must be qualified to do so under the Highway Traffic Act and/or Off Road Vehicles Act. - c) No operation of snowmobiles or all-terrain vehicles is permitted on private or crown land without permission. - d) No operation of snowmobiles or all-terrain vehicles is permitted within 30 meters of a dwelling between the hours of ten pm and seven in the morning. - e) No operation of snowmobiles or all-terrain vehicles is permitted within 30 meters of a playground, or area set aside for recreational use. - f) No operation of snowmobiles or all-terrain vehicles shall be upon or across a roadway or on the shoulder, or on the median of a divided highway or at the right of way of an interchange. - g) No operation of snowmobiles or all-terrain vehicles within the Rural Municipality shall be at a speed greater than 40 kilometers per hour on routes and 20 kilometers per hour on lanes, streets/roadways. - h) All operators must comply with all traffic control devices and signage, and all Provincial legislation and regulations. - i) All operators must use the approved routes only or trailer their vehicle to the Designated Routes. 49. Designated All-terrain Vehicles Routes - a) The Designated Route for all-terrain vehicles is during the period of April 16 to December 15, in each year, when not snow covered. - b) Operation of the all-terrain vehicle must be on the shoulder or far right of the roadway within the designated route. - c) The Four designated routes are as follows; - i) South Beach - Colville Drive from the shore of Lake Winnipeg going West to Fifth Avenue. From the intersection of Fifth Avenue and Colville travelling south to Sigmund Road right of way. Travel west on Sigmund Road to Highway 9.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - ii) Loni Beach - All of Loni Street to intersection of North Seventh Avenue, all of North Seventh to North Colonization Road to Third Avenue. - ili) Urban Area - Amisk Drive from the shore of Lake Winnipeg traveling West to Highway # 9, and Third Avenue from Amisk Drive to Road 231. - iv) RM of Gimli- Map showing all routes off of and including highway 9. 50. Designated Snowmobile Routes - a) The Designated Route for snowmobiles is during the period of November 1 to April 15, in each year, when snow covered. - b) Operation of the snowmobile must be on the shoulder or far right of the roadway within the designated route. - c) The Five designated routes are as follows; - i) Colville Drive from Lake Winnipeg to the westerly right of Highway 9. - ii) Amisk Drive from Lake Winnipeg to the westerly right of Highway 9. - iii) Goldfield from Lake Winnipeg to Highway 9, across Highway 9, continuing west on Centenial Drive to the Gimli Recreation Centre parking lot. - iv) Second Avenue from Goldfield to parking lot across from Gimli theater. - v) The ditch on the west side of highway 9 from Road 100 N (Gimli Park Road and Provincial Road 231 51. Designated Route Maps - a) All-terrain Route for South Beach as per section 48 C (i) - b) All-terrain Route for Loni Beach as per section 48 C (ii) - c) All-terrain Route for Urban Center as per section 48 C (iii) - d) All-terrain Route for Rural Municipality of Gimli as per section 48 C (iv) - e) Snowmobile Routes for Rural Municipality of Gimli as per section 49 C ## IX OTHER REGULATIONS  ## 52. Excavations - a) It shall be an offence for any Person to cut, break, tear up or remove any road surface or make any excavation in or under any Street, Boulevard, or Sidewalk for any purpose. - b) Subsection a) shall not apply to the Department of Highways, its agents or employees with respect to Provincial Highways or Designated Highways; - c) Subsection a) shall not apply to the construction where a permit has been issued. 53. Driveway Permits - a) Any Person wishing to construct a driveway/approach shall apply for a Culvert Permit. The permit shall be in such form as authorized by the Administration, and issuance of such permit shall be subject to: - b) Payment of an application fee as set out in the Municipalities Fees and Charges By-Law; and - c) Compliance with all regulations and conditions contained on said permit. - d) Any person requesting a second driveway/approach shall be subject to the same procedures as above and - e) Request permission from the Council for the Rural Municipality of Gimli. ## X PENALTIES FOR VIOLATION ## 54. General Conviction - a) Any Person who fails to comply with any or all provisions of this By-law is guilty of an offence and is liable on summary conviction to the penalties provided in Schedule F attached. - b) Where such failure to comply continues for more than one day, the Person is guilty of a separate offence for each day that it continues. - c) Excepting that any person who contravenes or fails to comply with Reduced-Speed School Zone speed limits in Clause 29 of this by-law is guilty of an offence and liable, on summary conviction, to fines and suspensions as calculated in accordance with Sections 238(2), 238(3) and any other applicable sections of the Manitoba Highway Traffic Act C.C.S.M. c. H60. 55. Parking Violations - a) Where an offence as alleged is a parking violation, the specific fines as set out in Schedule F are to be levied upon a guilty plea before a Magistrate.  ## Rural Municipality of Gimli Traffic By-Law # 18-0022 ## Rural Municipality of Gimli Traffic By-Law # 18-0022 - b) Parking violation service shall be effected by leaving a Traffic Citation as referred to in hereof with the owner or operator of the Vehicle by affixing the said citation to the Vehicle in question. ## 56. Citation of Vehicle in Violation - a) Whenever any Motor Vehicle is found parked or left in violation of any provision of this Bylaw, an Officer, on finding such Vehicle, shall conspicuously affix a Traffic Citation to such Vehicle. Such citation shall contain the license plate number and such other information describing the Vehicle as the Officer determines to assist in identifying the owner or operator of the Vehicle. ## 57. Liens and Judgements Respecting Traffic Citation(s) The Traffic Authority may, by resolution, establish a policy to initiate proceedings by lien or by judgement for the collection of outstanding Traffic Citations. Such proceedings shall be in accordance with the provisions of The Summary Convictions Act, S.M. 1985-86, Chap.S230, and current amendments thereto. ## 58. Removal, Impounding and Return of Vehicles - a) Any Vehicle may be towed from a Street or from an off-Street parking area when, in the opinion of an Officer, the Vehicle: - i) is impeding traffic flow; or 3. ii) is restricting access to or from a Street; or 4. ili) is a hazard to other Vehicle operators; or 5. iv) is a hazard to Pedestrians; or - v) is a hazard to private or public property; or 7. vi) is parked on a Street during a parking restriction in accordance with this by-law. 8. vii) has been parked for longer than seven consecutive days in accordance with this bylaw. 9. viii) has been parked for longer than 48 consecutive hours in accordance with this bylaw - b) where the same Vehicle has been Cited previously for the same or similar offences so as to constitute, to the Officer involved, a course of conduct contrary to the provisions of this or other by-laws, The Highway Traffic Act or The Municipal Act, or alternatively, such prior breach  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 may be a continuing offence where the Vehicle has not been moved since being Cited previously. - c) Any Vehicle shall be towed from a Street or from an off-Street Parking area when it: - i) occupies or partially occupies a Fire Lane or other emergency access lane; or 3. ii) occupies a Bus Stop or Bus zone; or 4. ili) occupies a railway crossing; or 5. iv) is parked within 3 meters (9.84 feet) of a fire hydrant; or - v) is double parked; or 7. vi) is parked in an area designated as "no Parking" 8. vii) is parked on a Street during a parking restriction in accordance with this by-law. 9. viii) Is a currently unregistered vehicle; 10. ix) Is parked on a boulevard. - d) Any Person requesting the release of an impounded Vehicle shall: - i) sign a receipt for its return, 13. ii) pay the cost of removal, 14. ili) pay any cost of storage accrued. - e) Until paid, these charges constitute a lien on the Vehicle which may be enforced in the same manner as a garage keeper's lien in accordance with the provisions of The Garage Keeper's Act. - f) It shall be the duty of the By-Law Officer to keep a record of each Vehicle removed in accordance with this By-law. The record shall include a description of the Vehicle, its license plate number, the date and time of its removal, where it was removed from, its location, the name and address of its owner and last operator, if known, its final disposition, and the parking violation involved. 59. Parking Violation on Private Property - a) Vehicles parked in violation of Sections 44, may at the option of the property owner, be towed from the property and impounded.  ## Rural Municipality of Gimli ## Traffic By-Law # 18-0022 - b) The towing of any Vehicle pursuant to this section shall be subject to provisions of Sec 56. - c) The Police Service shall be notified by the towing contractor of the removal of a Vehicle pursuant to this section and such notice shall include the following details; make, model, and license plate number of the Vehicle, date and time of its removal, where it was removed from, its final disposition and the parking violation involved. ## XI REPEALS AND COMING IN TO FORCE 60.
