## Rural Municipality of Grey
## By-Law No. 04-2023
BEING A BY-LAW OF THE RURAL MUNICIPALITY OF GREY TO REGULATE THE PARKING, STOPPING OR STANDING OF VEHICLES AND SNOW REGULATIONS ON MUNICIPAL ROADS IN THE RURAL MUNICIPALITY OF GREY.
WHEREAS subsection 232(1)(b) of The Municipal Act provides that a council may pass by-laws for municipal purposes respecting municipal roads;
AND WHEREAS subsection 249 (1) of The Municipal Act provide, in part, that a person who contravenes a by-law of a municipality is guilty of an offence;
AND WHEREAS subsection 249 (2) of The Municipal Act provides that where a contravention continues for more than one day, the person is guilty of a separate offence for each day it continues;
AND WHEREAS subsection 249 (1) of The Municipal Act provides, in part that a person who contravenes a by-law of a municipality is guilty of an offence;
AND WHEREAS Manitoba Regulation 50/97 provides that the maximum fine that a council may impose in respect of a contravention of a by-law is One thousand ($1,000.00) dollars;
AND WHEREAS Council for the Rural Municipality of Grey deems it advisable and in the public interest to regulate the standing stopping or parking of vehicles on municipal roads;
NOW THEREFORE, the Council of the Rural Municipality of Grey enacts as follows:
## Definitions:
"Park", when prohibited, means to stand a vehicle whether occupied or not, except when it is caused to stand temporarily for the purpose of:
- a. loading or unloading (only while engaged in)
- b. stopping for emergency vehicles
3. when ordered to do so by a person having authority
4. stopping at posted traffic control devices (lights, signs, etc)
"Persons" shall mean any individual, firm, company, association, society, corporation or group.
"Street" shall mean a municipal road for public use and includes a road allowance (including the shoulder), street, lane, thoroughfare, walkway and bridge but does not include a departmental road as defined in the Highways and Transportation Act.
"Vehicle" means a device in, upon or by which a person or thing is or may be transported or drawn upon a street and includes:
- a. an implement or husbandry that is not a motor vehicle
2. a special mobile machine, but does not include
- C. a device designed to be moved by human power or used exclusively upon stationary rails or tracks, and
- d. a motorized mobility aid
## Traffic and Parking Restrictions:
1. No person shall park a vehicle, trailer or any other piece of equipment (motorized or non-motorized) on a street in such a manner that it obstructs the entrance to a lane or to a driveway or an approach leading into a private premise or public pathway.
2. No person shall park a vehicle upon or over a sidewalk or in front of a public pathway which will obstruct the use of the sidewalk/pathway by pedestrians.
## Snow Regulations:
1. Persons shall remove parked vehicles and refrain from parking on public streets and lanes during and after snowfall events in order to accommodate the removal of accumulated snow.
2. No person shall deposit snow from private properties onto public roads, streets, lanes and right of ways. Persons found depositing snow on public roads, streets, lanes and right-of-ways may be charged the cost to remove such snow.
Vehicles, trailers or any other piece of equipment (motorized or non-motorized) found to be in violation of this by-law will be subject to towing, removal and/or impoundment with all costs of enforcement being the responsibility of the owner.
