Rural Municipality of Morris
BY-LAW NO. 1775/2023
BEING A BY-LAW OF THE Rural Municipality of Morris to revise and update the fines,
penalties, fees and charges payable to the Rural Municipality of Morris for municipal
services rendered under the authority of The Municipal Act, The Planning Act, The
Noxious Weeds Act, and the By-laws of the Municipality.
WHEREAS Section 249 of The Municipal Act of the Province of Manitoba states:
Contravention of by-law is an offence
249(1) A person who contravenes a by-law of a municipality is guilty of an offence and, if the
by-law imposes no other penalty, is liable on summary conviction to a fine of not more
than $500. or to imprisonment for a term of not more than three months, or both.
Continuing offence
249(2) Where a contravention continues for more than one day, the person is guilty of a
separate offence for each day it continues.
Disposition of fines
249(3) A fine imposed for contravening a by-law of a municipality must be paid to the
municipality.
AND WHEREAS the Rural Municipality of Morris has numerous By-laws which it has
enacted which do not provide for any fines or penalties;
AND WHEREAS the Rural Municipality of Morris wishes to enact a By-law which will
provide for a penalty rate structure in the case of contravention of any of it's By-laws
which do not have a penalty clause;
AND WHEREAS the Council of the Rural Municipality of Morris deems it advisable to
include in one by-law, the fines, penalties, fees and charges payable to the Rural
Municipality for certain services rendered by officers and employees of the Municipality;
NOW THEREFORE, THE COUNCIL OF THE RURAL MUNICIPALITY OF MORRIS IN
OPEN SESSION ASSEMBLED HEREBY ENACTS AS A BY-LAW AS FOLLOWS:
1.
THAT every person(s) who contravenes any By-law of the Rural Municipality
of Morris, which does not have a penalty clause contained therein, is liable on
summary conviction of a $50.00 fine for the first offence, $100.00 fine for the
second offence, $150.00 fine for the third offence, and an additional $50.00
for every additional offence up to a maximum fine of $500.00 per incident
2.
THAT the fees and charges payable to the Rural Municipality of Morris for
services rendered by officers and employees of the Rural Municipality shall be
as set out in the following schedules attached hereto;

THAT Council may from time to time, by resolution, amend each and every
schedule attached to this by-law.
4.
THAT the fees and charges set out in the schedules attached to this by-law
shall take precedence over any other by-law.
5.
THAT this By-law shall be known as THE FINES, PENALTIES, FEES AND
CHARGES BY-LAW.
6.
THAT Section 7 of By-Law No. 1011/1971, known as The Lottery By-Law, be
repealed and replaced by the following:
"7.
Fees for the issuing of licences shall be as set by the current Fees and
Charges By-Law and amendments thereto."

THAT Section 4.1.1(c) of By-law No. 1520/99, known as the Rural Municipality of
Morris Building By-law, be repealed and replaced by the following:
"4.1.1(c)
state the valuation of the proposed work and be accompanied by
the required fee as set by the current Fees and Charges By-law and
amendments thereto."
8.
THAT Section 4.2.1.2(h) of By-law No. 1520/99, known as the Rural
Municipality of Morris Building By-law, be repealed and replaced by the
following:
"4.2.1.2(h)
non-structural alterations or repairs where the value of such work
does not exceed the maximum values as set by the current Fees and
Charges By-law and amendments thereto."
8.
THAT Section 5.5.10 of By-law No. 1520/99, known as the Rural Municipality of
Morris Building By-law, be repealed and replaced by the following:
"5.5.10
The authority having jurisdiction may place a valuation on the
cost of the work for the purpose of determining permit fees. Such valuation
shall take precedence over any valuation provided by the owner, as set by
the current Fees and Charges By-law and amendments thereto."
9.
THAT Section 17 of By-law 1674/11, known as the Rural Municipality of Morris
by-law to regulate the storage of vehicles, be repealed and replaced by the
following:
"17
In addition to any fines imposed pursuant to section 20 hereof, the
Municipality shall impose the penalties and charges in respect of each
vehicle removed in accordance with this By-law. The amount of penalties
and charges shall be set out by the current Fees and Charges By-law and
amendments thereto."

10.
THAT Section 12 of By-law 1618/07, known as the Rural Municipality of Morris
Dog By- law, be repealed and replaced by the following:
"12
THAT the impounding fees shall be as set out in the current Fees and
Charges By-law and amendments thereto."
11.
THAT any unpaid fees or charges owed to the Rural Municipality by any tax
payer including any penalties related thereto as well as any fines imposed on
the taxpayer by the court for contravention of the Rural Municipality By-Laws
may be added to the taxes of the said tax payer and may be collected or
enforced in the same manner as a tax as defined by the Municipal Act, L.M.
1996 c.58.
12.
THAT By-law No. 1751/2020 be repealed upon passage of this by-law.
13.
THAT this By-Law shall come into force and effect on January 1, 2023, unless
there is another date specified in a particular section of any given Schedule.
DONE AND PASSED by Council of the Rural Municipality of Morris, in open

3.
Planning:
The fees chargeable under the Planning Act CCSM P80 shall be as follows:
Where a permit holder fails to call for any required inspection a penalty of $500 per
inspection shall be charged.

Inspections requested after-hours, other than 8:30 a.m. to 4:30 p.m., Monday to Friday
(excluding holidays) providing the Inspector is available is as follows:
