## BY-LAW NUMBER 01/2023
## BEING A BY-LAW TO GOVERN THE FEES AND CHARGES PAYABLE TO MOSSEY RIVER MUNICIPALITY FOR MUNICIPAL SERVICES RENDERED UNDER THE AUTHORITYOF THE MUNICIPAL ACT, AND BY-LAWS OF THE MUNICIPALITY
WHEREAS the Council of Mossey River Municipality deems it advisable to include in one by-law the fees and charges payable to Mossey River Municipality for certain services rendered by the Municipality;
NOW THEREFORE, the council of Mossey River Municipality, in open meeting assembled, enacts as follows:
## TITLE:
- 1.0: This By-Law may be referred to as "Mossey River Municipality Fees and Charges By-Law."
## SCHEDULES OF FEES AND CHARGES:
- 2.0 The fees and charges payable to Mossey River Municipality for services rendered by the Municipality shall be set out in the following schedules attached hereto:
- Administration and Finance
- Operations Department
- Public Works Department
- Public Safety
## GENERAL POWERS:
- 3.0 THAT Council may inform from time to time, by resolution of Council amend each and every schedule attached to this by-law.
- 3.1 THAT the fees and charges set out in the schedules attached to this bylaw shall take precedence over any other by-law.
- 3.2 THAT any fee or charge as identified within this by-law, which is owed to Mossey River Municipality and remains unpaid by any taxpayer, including any penalties related thereto as well as any fines imposed on the taxpayer for contravention of the Municipality's By-Laws may be added to the taxes of the said taxpayer and may be collected or enforced in the same manner as taxes as defined by The Municipal Act.
## FORCE AND EFFECT:
- THAT this By-law shall come into force and take effect on the day following the day that it is passed.
DONE AND PASSED as a by-law of Mossey River Municipality, at Winnipegosis, in the Province of Manitoba this i6 th day of march, 2023.

I agree to hold Mossey River Municipality harmless of all legal, financial, and any other liability that includes their agents, employees, successors and assigns, and any and all persons liable or who might be claimed to be liable, whether or no herein named, none of whom admit any liability to the undersigned, but all expressly denying liability, from any and all claims, demands, damages, actions, causes of action or suits of any kind or nature whatsoever, which have or may hereafter have, arising out of or in any way relating to and all injuries and damages of any and every kind, to both person and property, and also any and all injuries and damages that may develop in the future, as a result of or in any way relating to the Consenting Acts.
It is understood and agreed that this Agreement is made and received in full and complete settlement and satisfaction the causes of action, claims and demands mentioned herein; that this Consent contains the entire Agreement between the parties; and the terms of this Agreement are contractual and not merely a recital. Furthermore, this Consent shall be binding upon the undersigned, successors, and assigns.
