<!-- image --> ## THE RURAL MUNICIPALITY OF PORTAGE LA PRAIRIE ## BY-LAW NO. 3179 BEING A BY-LAW OF THE RURAL MUNICIPALITY OF PORTAGE LA PRAIRIE to regulate the cat population within the R.M. of Portage la Prairie. WHEREAS Section 232(1) of The Municipal Act provides that a Council may pass bylaws for municipal purposes respecting the following matters: - (k) wild and domestic animals and activities in relation to them, including bylaws differentiating on the basis of sex, breed, size or weight; - (o) the enforcement of by-laws. NOW THEREFORE THE REEVE AND COUNCIL OF THE RURAL MUNICIPALITY OF PORTAGE LA PRAIRIE IN OPEN SESSION ASSEMBLED HEREBY ENACTS AS A BY-LAW OF THE SAID MUNICIPALITY AS FOLLOWS: 1. This By-Law may be referred to as "the Cat By-Law". 2. Whenever used in this By-Law, unless the context otherwise requires: - a) CAT: means any member of the genus Felis Domesticus (domestic cat). - b) BY-LAW ENFORCEMENT OFFICER: means the person appointed by Council from time to time to carry out the duties of such officer as set forth in this By-Law and includes his deputy or assistant; - C) FERAL CAT: is an un-owned, free-roaming cat that lives outdoors; - d) PERSON: includes corporation, firm, a partnership and association; - e) OWNER: means any person who keeps or harbours a cat; - f) HARBOURING: includes constructing, erecting, locating, or keeping on the premises of which the person is the occupant a structure designed to be used as a shelter by a dog or cat. 3. No person may own, keep, harbour, or have in possession more than two (2) cats over the age of 3 months in and around any premises or dwelling located within any cat control area as mentioned in Section 4. If an owner possesses a female cat who has a litter of kittens, the owner may keep the kittens until the completion of the weaning process; 4. The cat control areas are listed below: - Oakville - Newton - Southport - Edwin - Macdonald - Peony Farm - Poplar Point - St. Ambroise - High Bluff - Delta 5. cat(s). No person shall harbour, and/or feed feral cats. The By-Law Enforcement Officer is authorized to enter the property harbouring the feral cats) for the removal of the feral 6. Where it is found that there are cats in excess of the maximum number allowed in a controlled area, a notice will be given to the property owner in violation of this by-law that will include a deadline of 21 days to remove the excess number of cats. If removal is not conducted or confirmed, the By-Law Enforcement Officer is authorized to enter the property to remove the cats in excess of the maximum number. 7. The By-Law Enforcement Officer is authorized to rent or loan cat traps to individuals for the purpose of capturing cats at large on condition that the individual agrees to: - a) Turn a captured cat over to the By-Law Enforcement Officer; and - b) Treat the captured cat humanely. 26. No license is required on any cat. 9. Any cat known to be rabid shall be terminated immediately. 10. Not withstanding any other By-Law to the contrary, the By-Law Enforcement Officer may use any method or tool that he considers necessary in the circumstances to capture, control, or terminate a cat. 11. All expenses incurred and fees charged in the removal and termination of the cats, including feral cats, as set out in the fees &amp; charges policy, are a debt owed by the property owner and may be collected by the Municipality in the same manner as a tax may be collected or enforced under The Municipal Act. <!-- image --> DONE AND PASSED as a By-Law of the Rural Municipality of Portage la Prairie by the Reeve and Council thereof in open session assembled this O day of June A.D. 2021. <!-- image --> <!-- image --> <!-- image --> <!-- image --> <!-- image --> Tell Kameron W.
