## THE RURAL MUNICIPALITY OF PORTAGE LA PRAIRIE
## BY-LAW NO. 3197
BEING A BY-LAW OF THE RURAL MUNICIPALITY OF PORTAGE LA PRAIRIE to establish a rate for the collection of household waste, grass and weed cutting and control and recreation support services as a special service for the Delta Beach Association Inc. for the years 2023 to 2027, inclusive.
WHEREAS Section 312(d), (e), (g) of The Municipal Act of Manitoba, provides in part as follows:
312 "If approved by by-law, a municipality may provide, as a special service to all or part of a municipality, one or more of the following:
(d) grass and weed cutting and control; (e) the collection and transportation of waste or recyclable materials; (g) recreation support services;"
AND WHEREAS subsection 320(1) of the Act provides as follows:
320(1) "Subject to subsections (2) to (6), a council may by by-law
(a) approve the local improvement or special services as set out in the plan or proposal; and

AND WHEREAS the requirements as prescribed in section 318, 319, and 320 of the Act have been complied with;
NOW THEREFORE the Council of the Rural Municipality of Portage la Prairie, in open council assembled enacts as follows:
1. That pursuant to subsection 320(1) of the Act, the Rural Municipality of Portage la Prairie approves Special Service Proposal No. 3-2022 attached hereto as Schedule "A".
2. That the Rural Municipality of Portage la Prairie levy an annual special service tax upon all residential and commercial tax roll properties as hereby attached in Schedule "B".
DONE AND PASSED by the Council of the Rural Municipality of Portage la Prairie in open session assembled this 14th day of February, A.D. 2023.

## Special Service Proposal No. 3-2022
Household Waste (Garbage) Collection and Grass and Weed Cutting and Control and Recreation Support Services
(Pursuant to Section 312 - 314 of the Municipal Act)
## (A) Description of the Proposed Special Service
A special service levy currently exists for the Delta Beach Association (DBA) for the collection of household waste, grass and weed cutting and control and recreation support services. This special services levy expires December 31, 2022 and the DBA wishes it to continue for the period of years 2023 to 2027 inclusive.
Household waste collection service is provided to residential and commercial properties in the area known as Delta Beach. Household waste collection is placed in the waste trailer and hauled to the landfill as scheduled and approved by the DBA. Waste does not include any construction, hazardous or chemical wastes, motor vehicle parts, used oil, animal carcasses or any other waste not normally associated with residences.
## (B) Special Service area to be levied
The Special Service Area to be levied under this plan is for all residential and commercial properties (Class 10, 20, 60, 80) located in the area known as Delta Beach of the Rural Municipality of Portage la Prairie as described in Schedule "B" attached hereto.
## (C) Estimated Cost of the Service
The levy for 2022 was $12,154.80. The estimated cost of the service, for 2023 to 2027 inclusive, which is based on the motion approved at the DBA Annual General Meeting of July 2022 and submitted by the Delta Beach Association Inc., is proposed to raise the rate by 10% per year thereafter to the following amounts:
2023: $13,370.28
2025: $16,178.04
2024: $14,707.31
2026: $17,795.84
2027: $19,575.42
## (D) Method and Rate of Calculating the Proposed Special Service Tax
The requirements in each year are to be raised by a special service tax calculated on the basis of the portioned value of assessable property (i.e. special mill rate) that is real property. The rate will be calculated as follows:
Levy $13,370.28 / Total Portioned Assessment (using 2022 in this example) x 1,000 =13,370.28 / 15,439,980 × 1,000 = $0.87 per $1,000 of portioned value.
2023 estimate:
Calculated on a residential property valued at $100,000 ($45,000 portioned value) an estimated $39.15 special service tax will be levied annually.
The special mill rate will be determined according to the estimated Cost of Service amount
set out in the Rural Municipality of Portage la Prairie's annual Financial Plan.
## (E) Benefits of the proposed services
The benefits of the proposed services will include the continuation of removal of household waste from the Delta Beach area on a scheduled basis to an environmentally approved
disposal site.
