## THE RURAL MUNICIPALITY OF PORTAGE LA PRAIRIE
## BY-LAW No. 3211
BEING A BY-LAW OF THE RURAL MUNICIPALITY OF PORTAGE LA PRAIRIE to set water rates for the RM of Portage la Prairie Water Utility.
WHEREAS Section 232 (1) and (2) of the "Municipal Act", S.M. 1996, c. 58, provides in part as follows:
- 232(1) A council may pass by-laws for municipal purposes respecting the following matters:
- (I) public utilities;
- 232(2) Without limiting the generality of subsection (1), a council may in a by-law passed under this Division;
- (d) establish fees or other charges for services, activities or things provided or done by the municipality or for the use of property under the ownership, direction, management or control of the municipality;
AND WHEREAS The RM of Portage la Prairie is supplied with water from the Carter Water Regional Cooperative and the City of Portage la Prairie and billed by the Manitoba Water Services Board and City of Portage la Prairie;
AND WHEREAS the water wholesale rates implemented by Manitoba Water Services Board and the City of Portage la Prairie have increased;
AND WHEREAS The Public Utilities Board has approved rate increases through Board Orders 19/19, 32/19 and 137/22;
AND WHEREAS it is deemed advisable to provide rates for 2024 and thereafter to be paid by persons to whom water is supplied by the RM's Regional Water System and the City Water System, and to provide for the collection thereof;
NOW THEREFORE THE COUNCIL OF THE RURAL MUNICIPALITY OF PORTAGE LA PRARIE IN SESSION DULY ASSEMBLED, HEREBY ENACTS A BY-LAW AS FOLLOWS:
- 1) THAT Schedule "A" be attached hereto and forming part of this by-law, coming into effect April 1, 2024.
DONE AND PASSED by a by-law of the Rural Municipality of Portage la Prairie in the Province of Manitoba this 23rd day of January, A.D. 2024.

## 2. Minimum Charges per Quarter
Notwithstanding the rates set forth in paragraph 1, all customers will pay the applicable minimum charges set out below, which includes the water allowance as listed.
## a. Water & Sewer or Water Only Customers (for water system including Peony Farm)

The sewer only charge is based on average quarterly consumption of 10,000 gallons plus the quarterly customer service charge.
The quarterly charge for sewer only customers is (10 * $6.83) + $11.73 = $80.03.
