BY-LAW No. 16-2004 To establish No Truck Routes within the Rural Municipality of Ritchot WHEREAS Section 232 (1) of the Municipal Act, S.M. 1996, c.58 in part states: " A Council may pass by-laws for municipal purposes respecting the following matters: (a) the safety, health, protection and well-being of people, and the safety and protection of Property." AND WHEREAS Section 90 (1) of The Highway Traffic Act, S.M. 1985-86, c.3 in part states: " A traffic authority may classify vehicles according to dimensions, design, weight, kind of weight carried or otherwise, for any class or all classes of vehicles and may make rules or by-laws supplementary to, or in addition to, but not contrary to, any provision of this Act or regulations made thereunder and applicable on highways over which the traffic authority has jurisdiction or within any area over which the traffic authority has jurisdiction, with respect to (d) prescribing routes of travel; and may impose penalties for a violation of any such rule or by-law." AND WHEREAS the Municipal Council of the Rural Municipality of Ritchot deems it in the best interest and safety of the residents of the Municipality to regulate certain vehicles traveling on urban streets and other municipal right-of-ways in the Municipality; AND WHEREAS Section 90(2) of the Highway Traffic Act, S.M. 1985-86, c.3 authorizes the Municipality to impose a penalty; NOW, THEREFORE the Council of the Rural Municipality of Ritchot in open session assembled, hereby enacts as a by-law as follows: 1. This By-law shall be known as the "No Truck Route" regulation By-law. 2. Definitions: a) The words used in this By-law have the same meaning as defined in the Highway Traffic Act unless otherwise provided. b) Municipal road means a municipal road as defined in the Municipal Act, and includes a road and road allowance maintained by the Municipality. c) No Truck Route means a municipal road listed in Schedule A. 3. The Municipality designates the municipal roads listed in Schedule A as No Truck Routes. 4. No person shall drive, use, park or stand a truck or truck tractor on a No Truck Route. Page 2. The No Truck Route restrictions set out in clauses 3 and 4 do not apply to the following: a) emergency vehicles, b) a vehicle of Her Majesty's Mail, or of the Government of the Province of Manitoba, and of any public utility, if such vehicles have the owner's name painted thereon and are actually engaged in works of necessity on or near a highway requiring them to stop or be parked in contravention of any such provision; c) a vehicle owned and operated or a vehicle contracted and employed by the Rural Municipality of Ritchot while in use in connection with work being done on or near a highway, d) a truck or truck tractor providing goods or services to a resident or owner of property, provided the driver uses caution and care and uses the shortest distance to and from the property to a municipal road not listed on Schedule A. e) a truck or truck tractor operated by a resident traveling to and from their home, provided the resident uses caution and care and uses the shortest distance to and from their home to a municipal road not listed on Schedule A. The truck or truck tractor must be parked on the resident's private property. 6. A person who contravenes or fails to comply with this By-law is guilty of an offence and is liable on summary conviction: (a) for a first offence to a fine of $100.00, (b) for a second offence to a fine of $200.00, (c) for a third or subsequent offence to a fine of not more than $2000.00. A person may pay the fine, plus applicable costs and surcharges to the Municipality. Where the fine is not paid voluntarily or following conviction, in addition to the enforcement remedies set out in the Summary Conviction's Act, the fine may be collected in any manner in which a tax may be collected or enforced under the Municipal Act. 7. By-law 12-99 is repealed, except with respect to an offence committed before this By- law comes into effect. By-law 12-99 remains in effect to the extent required for the prosecution of any such offence.
