## A PURPOSE:
Amend BYLAW animal control bylaw fines and penalties sections.
- PREAMBLES: WHEREAS C.C.S.M. c. M225 The Municipal Act, DIVISION 3 -ENFORCEMENT OF BY-LAWS Sections 239(1) through
249.1 allows Council to enforce breach of bylaws and set fines and penalties for collection.
## ENACTMENT:
NOW THEREFORE the Council of the Rural Municipality of Sifton, duly assembled, enacts as follows:
1. THAT Council amend and repeal the following wording of sections of BYLAW 1418, DONE AND PASSED as a By-law of the RM of Sifton by the Reeve and Council in open session assembled the 13th day of March 2012:
20(1) Without limiting the penalties for specific offences set out in subsections 20(2), (3), (4), (5), (6), (7) and (8) hereof, any person who contravenes any provision of this By-law, shall be issued a Notice of Breach of this By-law and is guilty of an offence and is liable:
- (a) to a fine of $20.00, plus all applicable costs of apprehension and impoundment, for the first offence;
- (b) to a fine of $40.00, plus all applicable costs of apprehension and impoundment, for the second offence;
- (c) to a fine of $60.00, plus all applicable costs of apprehension and impoundment, for the third offence and for each subsequent offence within twelve (12) months of the first offence, and in default of payment, to imprisonment for not more than thirty (30) days.
20(2) Any person contravening this by-law by failing to confine a female dog or cat in heat as per Section 9(3), shall be issued a Notice of Breach of this By-law, and is guilty of an offence and is liable to a fine of $25.00
20(3) Any person contravening this by-law by failing to remove immediately the excrement of his animal from public or private property other than the property of the animal's owner as per Section 7(1)(c), shall be issued a Notice of Breach of this By-law, and is guilty of an offence and is liable:
(a) to a fine of $50.00 for the first offence;
(b) to a fine of $75.00 for the second offence:
(c) to a fine of $100.00 for the third offence and for each subsequent offence within (12) months of the first offence, and in default of payment, to imprisonment for not more than thirty (30) days.
20(4) Any person contravening this by-law by permitting an animal on parkland other than on a leash as per Section 7(1)(i), shall be issued a Notice of Breach of this By-law, and is guilty of an offence and is liable to a fine of $25.00.
20(5) Any person contravening this by-law by permitting an animal to damage private or public property as per Section 7(1)(e), shall be issued a Notice of Breach of this By-law, and is guilty of an offence and is liable to a fine of $500.00.
20(6) Any person who contravenes a provision of this By-law relating to a restricted animal or to an animal which has been declared a dangerous animal, shall be issued a Notice of Breach of this Bylaw, is guilty of an offence and is liable:
(a) to a fine of $50.00, plus all applicable costs of apprehension and impoundment for the first offense, and in default of payment, to imprisonment for not more than fifteen (15) days;
(b) to a fine of $100.00 plus all applicable costs of apprehension and impoundment for the second offence and for each subsequent offence within twelve (12) months of the first offence, and in default of payment, to imprisonment for not more than thirty (30) days.

## Rural Municipality of Sifton By-law No. 10-2019 Amend RMS BYLAW 1418 - Animal Control BYLAW.
20(7) Any person who interferes with or obstructs the duties of an animal control officer, a pound-keeper or any other person authorized to enforce any provisions of this By-law, or who unlawfully enters any pound or unlawfully removes any animal impounded, shall be issued a Notice of Breach of this By-law, is guilty of an offence and is liable:
- (a) to a fine of $100.00, or to imprisonment for a term of not more than thirty (30) days, for the first offence, plus all applicable apprehension and impoundment costs;
- (b) to a fine of $500.00, or to imprisonment for not more than six (6) months, for each subsequent offence, plus all applicable apprehension and impoundment costs."
2. THAT Council enact the following new wording for the penalties associated with the breach of any part of RMS BYLAW 1418:
20(1) Any person who contravenes, breaches, or infringes any provision of this By-law, shall be issued a NOTIIFCATION OF FINE and shall pay a fine determined by and at the discretion of the BYLAW ENFORCEMENT OFFICER for each offence not exceeding the sum of Five Hundred Dollars
3. THAT Council Amend SCHEDULE B - Notice of Breach of By-law No. 1418 to read "Notification of Fine" and that all reference in BYLAW 1418 to "Notice of Breach of Bylaw" shall be amended to refer to the "Notification of Fine".
