THE RURAL MUNICIPALITY OF WOODLANDS
BY-LAW NO. 2835/26
A BY-LAW TO REGULATE PARKING ON MUNICIPAL STREETS AND IN CUL-DE-SACS WITHIN
THE LOCAL URBAN DISTRICT OF WARREN.
WHEREAS under section 139 of The Municipal Act (C.C.S.M. c. M225), a council may pass
by-laws respecting streets and the parking of vehicles;
AND WHEREAS the Council of the Rural Municipality of Woodlands considers it necessary
for public safety, emergency access, snow removal, and the efficient movement of traffic
to prohibit or restrict parking on certain municipal streets and within cul-de-sacs;
AND WHEREAS the Council of the Rural Municipality of Woodlands has adopted an
Administrative Penalties By-law for the purpose of enforcing certain municipal by-laws by
means of penalty notices;
NOW THEREFORE the Council of the Rural Municipality of Woodlands, in open meeting
assembled, enacts as follows:
1. Definitions
In this By-law:

"Administrative Penalties By-law" means the Rural Municipality of Woodlands
Administrative Penalties By-law, as amended from time to time.

"By-law Enforcement Officer" means any person authorized by the Municipality to
enforce this By-law.

"Cul-de-sac" means the circular or bulb-shaped portion at the closed end of a
municipal street designed for vehicle turning.

"Designated Area" means a street or portion of a street identified in Schedule "A"
where parking is restricted or prohibited.

"Municipality" means the Rural Municipality of Woodlands.

"Vehicle" means any motor vehicle as defined in The Highway Traffic Act
(Manitoba).
2. Parking Prohibitions
2.1 No person shall park or leave a vehicle:
a) In a manner that obstructs or impedes the normal movement of traffic;
b) In a manner that interferes with snow removal, garbage collection, or emergency
access;
c) In any cul-de-sac or on any portion of a street designated as "No Parking" by
authorized signage or listed in Schedule "A";
d) Within the circular or turning area of a cul-de-sac, except where signage permits
temporary parking;
e) Within 10 meters, measured from the nearest point, of a fire hydrant, driveway,
intersection, or the edge of a cul-de-sac bulb.
2.2 Owner Responsibility
The registered owner of a vehicle parked in contravention of this By-law is deemed to have
committed the offence, regardless of who was operating the vehicle at the time.
2.3 Temporary and Emergency Restrictions
Notwithstanding any other provision of this By-law, the Municipality may temporarily
prohibit parking on any municipal street or cul-de-sac during snow removal operations,
emergencies, or municipal service activities whether or not such street is listed in
Schedule "A".
3. Authorized Signs
3.1 The Municipality may erect and maintain official "No Parking" or "Parking Restricted"
signs to give effect to this By-law.
3.2 No person shall park a vehicle contrary to the restrictions indicated by any authorized
sign.
3.3 Signage Condition
The absence, damage, obstruction, or temporary removal of a sign does not invalidate the
application or enforcement of this By-law where parking is otherwise prohibited.
4. Enforcement
4.1 This By-law shall be enforced through the issuance of penalty notices under the RM of
Woodlands Administrative Penalties By-law.
4.2 Each day that a contravention continues constitutes a separate offence.
4.3 In addition to any penalty imposed, a vehicle parked in violation of this By-law may be
towed or removed at the owner's expense if:

It obstructs a cul-de-sac or turning area; or
-
It interferes with snow removal, emergency access, or municipal service vehicles.
4.4 Penalties
The penalties applicable to contravention of this By-law are set out in the Administrative
Penalties By-law.
5. Schedules
The following Schedules form part of this By-law:

Schedule "A" - List of Streets and Cul-de-sacs where Parking is Prohibited or
Restricted
6. Severability
If any section of this By-law is found invalid by a court of competent jurisdiction, the
remainder shall remain in full force and effect.
7. Effective Date
This By-law comes into force and takes effect upon the date of final passing by Council.
