## BY - LAW # 2008-7 ## RURAL MUNICIPALITY OF SHOAL LAKE BEING A BY-LAW OF THE R. M. OF SHOAL LAKE RESPECTING THE DISPOSAL AND TIPPING FEES OF CERTAIN SOLID WASTE. WHEREAS Section 232 of "The Municipal Act" authorizes a council to pass by-laws for municipal purposes; provides as follows: NOW THEREFORE the council of the R.M. of Shoal Lake hereby enacts as follows: ## 1. DEFINITIONS FOR the purpose of this by-law the following definition(s) shall apply: - a) "Building" means any well, pipe line, excavation, cut, fill, transmission line of other erection or structure, or any part thereof, and also includes any addition to or extension of a "Building" and any chattel that is attached to any structure or land that is installed herein or thereon; - b) (High Density?) "Construction and Demolition Wastes" means the waste "Building" materials and rubble resulting from the construction, remodeling, repairs, demolition or destruction by fire of Buildings and other structures, and the installation, repair or removal of pavement and like works; - c) Demolition Waste - Low Density means insulation, buffalo board, styrofoam, roofing paper, roofing tar, etc. - d) "Industrial Refuse" means material (stone, concrete, bricks, gravel and soil and tree stumps) from excavations, material from building constructions, repair, alteration or maintenance, debris from any building removed, destroyed by fire, and any other cause; - e) "Landfill Site" shall mean the R.M. of Shoal Lake's sanitary landfill site located adjacent to the village of Oakburn, which is designated by the R.M. of Shoal Lake as the current landfill site for the purpose of disposing of refuse; - f) "Tipping Fee" means the charge for disposal based upon weight or volume for industrial refuse or construction and Demolition waste; - g) "Tires" means rubber tires from vehicles and/or equipment. ## 2. CONTROL: - a) The removal and disposal of Construction and Demolition Wastes and Industrial Refuse shall be the sole responsibility of the party that has generated such waste or refuse. - b) No person shall drive or move any vehicle within the R.M. unless such vehicle is so constructed, loaded, or covered to prevent any load, contents or litter from being blown or deposited upon any public place, public road, or private property. - ## 3. LANDFILL SITE: - a) No person shall make deliveries or deposits of any Construction and Demolition Waste or Industrial Refuse at the landfill site at any time other than posted hours, except with the permission and supervision of the Landfill Attendant. ## 4. TIPPING FEES: - a) Construction &amp; Demolition Waste tipping fee per tonne(2200 Ibs) is $32.00, with a minimum fee of $16.00 under 1/2 tonne (1100 Ibs). - b) The Industrial refuse tipping fee per tonne (2200 Ibs) is $20.00. - d) The Scaling fee (when necessary) must be paid by the Customer. - c) The Demolition Waste-Low Density tipping fee is $16.00 per cubic meter. - e) If Hauling on days the Landfill is not open, approval must be obtained from the Landfill Attendant, their discretion and a fee of $20.00 per hour will apply. - g) Tipping Fees for burnable material shall be determined on a case by case basis, by the R.M. of Shoal Lake Council. - f) 20 Inch and larger than 20 inch Tires will be accepted for a fee of $5.00 per tire. ## 5. MISCELLANEOUS: - a) In the event of dispute, the final decision to determine the type of waste shall be made by the R. M. of Shoal Lake, Landfill Attendant. ## 6. USER FEES FOR HOUSEHOLD MATERIALS AT OAKBURN LANDFILL: - a) Non-residents-- --$4.00 a day - That By-law 1096 respecting the disposal and tipping fees of certain solid waste be hereby repealed.
