## Rural Municipality of Yellowhead By-law No.4-2023
Being a By-law of the Rural Municipality of Yellowhead to establish a rate for the Special Services proposal for the collection of solid waste and recycling for properties within the communities of Elphinstone, Oakburn, Burlington Beach, Jackson Beach, Shoal Lake, Strathclair and provide bins for collection to the development surrounding Thomas Lake under Special Service Proposal No. 2023-2 with the costs to be recovered on a per parcel basis. This special service will pertain to the years 20232027 inclusive.
WHEREAS Section 312 of The Municipal Act, S.M. 1996, C.58, provides in part as follows:
If approved by by-law, a municipality may provide, as a special service to all or part of the municipality, the following:
- (e) the collection and transportation of waste or recyclable materials;
AND WHEREAS subsection 320(1) of The Municipal Act provides as follows:
Subject to subsection (2) to (6) and subsection 321(4), a Council may by by-law
- (a) approve the local improvement or special service as set out in the plan or proposal; and
- (b) authorize the municipality to impose taxes as set out in the plan or proposal.
AND WHEREAS the Council of the Rural Municipality of Yellowhead has prepared Special Services Plan No. 2023-2 to establish a rate for providing the collection of solid waste and recycling services as a special service pursuant to Part 10 of The Municipal
AND WHEREAS the requirements as prescribed in section 318, 319 and 320 of the Act have been complied with;
NOW THEREFORE the Council of the Rural Municipality of Yellowhead enacts as follows:
- That pursuant to subsection 320(1) of The Municipal Act, The Rural Municipality of Yellowhead approves Special Services Plan No. 9-2018 attached hereto as Schedule "A".
2. That the Rural Municipality of Yellowhead levies an annual special service tax upon certain properties within the municipality as hereby attached in Schedule
