CITY OF SELKIRK BY-LAW NO. 5251 BEING A BY-LAW OF THE CITY OF SELKIRK TO PROVIDE FOR THE PREVENTION OF DANGERS TO PUBLIC SAFETY OR PROPERTY. WHEREAS: A. The Municipal Act provides as follows: 231 The power given to a council under this Division to pass by-laws is stated in general terms (b) to enhance the ability of the council to respond to present and future issues in the municipality. 232(1) A council may pass by-laws for municipal purposes respecting the following matters: (a) the safety, health, protection and well-being of people, and the safety and protection of property; (o) the enforcement of by-laws B. The issue of dangers to public safety or property has arisen in the City, and Council is of the opinion that it should respond to the issue in the interests of public safety and security. NOW THEREFORE, the Council of the City of Selkirk enacts as follows: 1. In this By-law: a. "occupier", "real property", and "registered owner" mean the same as those terms are defined in The Municipal Assessment Act, and b. "personal property" means personal property as defined in The Municipal Assessment Act, and includes a boat and ship. 2. This By-law applies to dangers or unsafe conditions occurring as a result of the condition or use of personal property or real property within the City of Selkirk. 3. The responsibility for compliance with the provisions of this By-law is imposed for real property on the registered owner or occupier, and for personal property on the owner, occupant, user or person in possession or control. 4. Personal property and real property must be maintained and used so that it does not cause a danger to the safety or health of people, or to the safety of property. 5.
