<!-- image --> ## TOWN OF SNOW LAKE BY-LAW NUMBER 995/24 ## BEING A BY-LAW OF THE TOWN OF SNOW LAKE TO REGULATE UNNECESSARY AND HARMFUL NOISE WITHIN THE TOWN OF SNOW LAKE WHEREAS Section 232 (1) of the Municipal Act provides in part "A Council may pass bylaws for municipal purposes respecting the following matters: (a) the safety, health, protection and well being of people, and the safety and protection of property: AND WHEREAS Council deems it necessary to enact provisions for the regulation of noise within the boundaries of the Town of Snow Lake. Definitions: - (a) "Town" means the Town of Snow Lake (b) "Industrial Noise" means a noise normally made in the course of normal operations by a machine when used by industry or in construction, exclusive of motor vehicles required to be licensed under the Highway Traffic Act. (c) "Wrongful Noise" means any noise of every nature and kind made within the Town limits except to the extent that the making of noise is authorized by the other provisions of this bylaw, that is liable to disturb or annoy persons in the Town, including without limiting the foregoing the ringing of bells (except church and school bells), blowing of horns, beating of drums, or unnecessary noise from the contact of motor vehicle tires with the roadway. NOW THEREFORE the Council of the Town of Snow Lake, in Council duly assembled, hereby enacts as follows: (1) Engine Brakes are prohibited within the boundaries of the Town of Snow Lake within the area of PR 392 outlined on the map attäched hereto as Schedule "A", and within the urban limits of the Town. (2) An industrial machine may be operated between the hours of 07:00 and 22:00 provided all reasonable effort is made to minimize the noise produced by reasonable operation thereof and the use of sound minimization as is normally used with such a machine. (3) No loud speaker or other device for the amplification of sound shall be used at any public place in the Town that is not fully enclosed, between 07:00 and 22:00 without a permit first being obtained from the authority of the Town prescribing the time, place, and period of time for the use thereof. - (4) Helicopters, aircraft, or motorized commercial vehicles shall not be operated outside of the hours of 07:00 and 22:00 without a permit being issued prescribing the time, place, and period of time for the use thereof.
