## THE TOWN OF SAINTE-ANNE
## BY-LAW NO. 3 - 2021
BEING a by-law of the Town of Sainte-Anne to provide for the regulations and control of traffic and parking within the limits of the Town of Sainte-Anne.
WHEREAS Section 90(1) of The Highway Traffic Act provides for a traffic authority to make rules or by-laws to regulate and control vehicular and other traffic and the parking thereof within its jurisdiction;
AND WHEREAS Section 90(2) of The Highway Traffic Act provides for the council of the municipality to impose penalties for a violation of any such rule or by-law;
AND WHEREAS Section 90 (3) of The Highway Traffic Act provides for the council of a town to make rules or by-laws applicable to any part of a provincial highway within the town.
AND WHEREAS Section 236 (1)(b)(ii) of The Municipal Act states:
- 236 (1) Without limiting the generality of clause 232(1)(o) (enforcement of by-laws), a by-law passed under that clause may include provisions
- (b) remedying contraventions of by-laws, including
- (ii) subject to the regulations, providing for fines and penalties, including the imposition of a penalty for an offence that is in addition to a fine or imprisonment, so long as the penalty relates to a fee, rate, toll, charge or cost that is associated with the conduct that gives rise to the offence, or related to enforcing the by-law.
AND WHEREAS Council for the Town of Sainte-Anne deems it necessary and in the best interest of the municipality to pass a by-law to regulate and control vehicular and other traffic, and the parking thereof, within the Town of Sainte-Anne;
THEREFORE, BE IT RESOLVED that the Council of the Town of Sainte-Anne, in open meeting assembled, enacts as follows:
## Section 1. Name
- 1.1 This by-law may be referred to as "Traffic & Parking By-Law"
## Section 2. Definitions
- 2.1 Unless otherwise expressly provided or unless the context otherwise requires, words and expressions have the same meaning as The Highway Traffic Act of the Province of Manitoba with the following:
- 2.1.1 "Approach" means that portion of a curb, sidewalk or boulevard improved or designed for the passage of vehicular traffic. Also known as a Driveway.
- 2.1.2 "Boulevard" means that portion of street, on either side or in the center of the street, that:
- a. is adjacent to the roadway or its shoulder;
- b. is maintained for the purpose of improving the appearance or safety of the street;
- c. is not intended to be used to carry vehicular traffic; and
- d. is not a shoulder.
- 2.1.3 "Chief of Police" means the person appointed by council as the chief of the Ste. Anne Police Department;
- 2.1.4 "Council" means the council of the Town of Sainte-Anne;
- 2.1.5 "Cul-de-sac" means any turnaround with the limits of the Town with more than 2 driveways encroaching onto the turnaround"
- 2.1.6 "Curb" means the lateral line of a roadway;
- 2.1.7 "Enforcement Officer" means a Police Officer or Municipal By-Law Enforcement Officer of the Town of Sainte-Anne. Can include a Provincial Enforcement Officer.
## 2.1.8 "Heavy Vehicle" means
- a. A motor vehicle with a gross weight registration exceeding 4,536 kilograms (10,000 Ibs); or
- b. Any vehicle including any combination of motor vehicle, trailer and load with a weight exceeding 4,536 kilograms (10,000 Ibs).
3. 2.1.9 "Loading Zone" means an area of street/road that no parking is allowed with the only exception of loading or unloading a vehicle whereby a vehicle can be parked on the street/road for the above purpose to a maximum of 15 minutes. Such loading zones will be posted accordingly;
4. 2.1.10 "Parade" means any procession or body of pedestrians standing, marching or walking anywhere on a street or any group of vehicles standing or moving anywhere on a street, excepting a funeral or wedding procession;
5. 2.1.11 "Penalty Notice" means a penalty notice issued under The Municipal By-Law Enforcement Act.
6. 2.1.12 "Police Department" means any member of the Police Department, including Auxiliary Officers, Constables and Sergeants;
7. 2.1.13 "Town" means the Town of Sainte-Anne.
8. 2.1.14 "Truck" means a motor vehicle or semi-trailer truck, that is constructed or adapted to carry goods, wares, and merchandise, freight or commodities, but not passengers or baggage, and that has more than 4 tires.
9. 2.1.15 "Truck Tractor" means a motor vehicle designed and used primarily for towing other vehicles, and not so constructed as to carry a load other than the driver thereof;
10. 2.1.16 "Works of Necessity" means work that is required to repair, replace, maintain or improve infrastructure belonging to the Town, the Province of Manitoba, or other public utilities.
## Section 3. Schedules
- 3.1 The schedules attached to this by-law form part of this by-law.
## Section 4. Causing or Permitting an Offense
- 4.1 Any person who causes or permits an offense against this by-law is guilty of an offense and is subject to penalties as outlined in this or any other Town of Sainte-Anne by-law.
## Section 5. Traffic Control Devices
- 5.1 Installation and Maintenance:
- 5.1.1 The Town shall place and maintain or cause to be placed and maintain all approved traffic control devices in conformity with the provisions of this By-Law or any traffic requirements authorized by Council;
- 5.1.2 No person may install a traffic control device on public property unless given written approval by the Town. The placement of any traffic control device in contravention of this By-Law is an offence and such traffic control device(s) will be removed;
- 5.1.3 The Town will keep a record of the location of all traffic control devices and zones where parking or stopping is restricted or prohibited by a traffic control device;
- 5.1.4 Any person may request the Town to install or remove a traffic control device. Requests must be made in writing to the Chief Administrative Officer and may be reviewed by Council in a public meeting.
## 5.2 Protection of Traffic Control Devices:
No person may damage, deface, remove, obscure, or interfere with any traffic control device placed or maintained by the Town for the purpose of traffic or parking control.
## 5.3 Directional Arrows:
Where a sign indicates parking or stopping restrictions by directional arrow, that restriction will continue in the direction of the arrow to the next street intersection unless interrupted by a similar sign with an opposite facing arrow.
- 5.4 Compliance with Traffic Control Devices:
## 5.4.1 Where a traffic control device is placed or maintained:
- a) To prohibit the stopping or parking vehicles at any time or during the hours stated on the sign on the street or any portion thereof;
- b) To limit the time during which vehicles may be parked on the street or any portion thereof, either during the whole of any day or during a part thereof, no person shall stop or park a vehicle or cause or permit a vehicle to remain stationary on the street or portion thereof to which the device relates, in contravention of the device or for a period longer than otherwise authorized by the device.
3. 5.4.2 No person shall park or leave a vehicle on private property on which there is erected a sign indicating that the parking of vehicles thereon is prohibited or restricted.
4. 5.4.3 Any Enforcement Officer of the Town of Sainte-Anne is authorized to enforce the following traffic regulations on private and public parking lots upon request by owner where the required signage is in place, namely:
- a) Parking spaces for physically disabled persons;
- b) Emergency Vehicles only;
- c) Loading Zones;
- d) No Parking, Entrance/Exit only;
- e) No Parking, Emergency Exit;
- f) Authorized Parking only.
11. 5.5 Temporary Traffic Control Devices:
12. 5.5.1 The Town shall place and maintain, or cause to be placed and maintained, temporary traffic control devices for the purpose of prohibiting or regulating traffic in an emergency or for the purposes of carrying out any authorized work on the street, including street cleaning and snow removal operations, in conformity with the provisions of this By-Law, to insure orderly movement of traffic, to prevent injury or damage to persons or property, or to permit action in any emergency;
13. 5.5.2 Any person undertaking authorized work of any form within a street or in any way interfering with or obstructing the normal use of the street shall place, maintain and remove temporary traffic control devices as directed by the Town.
14. 5.6 Compliance with Temporary Traffic Control Devices:
15. 5.6.1 No person shall drive a vehicle on any street that is barricaded or otherwise indicates as closed to vehicular traffic;
16. 5.6.2 Unless otherwise directed by an Enforcement Officer, pedestrians and drivers shall obey the direction, instruction, limitation, restriction, or prohibition of any applicable traffic sign, traffic control signal, marking, barrier, or device placed or maintained by the Town for the purpose of regulating or prohibiting traffic, for street construction, repair, maintenance, painting or any emergency.
## Section 6. Heavy / Commercial Vehicles
## 6.1 Designated Routes:
The Town will determine and keep a record of heavy vehicle routes and spring weight road restrictions placed on streets within the Town.
- 6.2 Heavy Vehicle Restrictions:
No person may operate a heavy vehicle on any street except:
- 6.2.1 While such a heavy vehicle is travelling on a designated heavy vehicle route;
- 6.2.2 While such a heavy vehicle is making collection or delivery, provided that the operator proceeds by the most direct route to or from the point of collection or delivery, to or from the nearest heavy vehicle route;
- 6.2.3 While such a heavy vehicle is proceeding to or from a business premises located in an industrial zone, provided that the operator proceeds by the most direct route to or from the business premises, to or from the nearest heavy vehicle route;
- 6.2.4 While such heavy vehicle is being operated in the service of the Town.
- 6.3 Spring Weight Restrictions:
- 6.3.1 Town spring weight restrictions take effect for the same period of time as that which is designated by the Province of Manitoba for provincial highways which run through the Town;
- 6.3.2 The Town will place and maintain, or cause to be placed and maintained, temporary traffic control devices for the purpose of indicating that spring weight restrictions are in effect;
- 6.3.3 Heavy vehicle axle loadings will be restricted to 65% of legal axle loadings or as indicated with a traffic control device when spring weight restrictions are in effect except on specified heavy vehicle routes;
- 6.3.4 No person may operate any heavy vehicle that exceeds permitted spring weight restrictions within the Town except where a permit has been obtained from the Town to allow passage of that heavy vehicle over specified Town streets at a specified time.
## 6.4 Determination of Weight:
Any person operating a vehicle must comply with a request of an Enforcement Officer to immediately proceed to a weigh scale and allow the vehicle to be weighed for the purpose of determining:
- 6.4.1 If the vehicle exceeds the weight limits allowed for when spring weight restrictions are in effect; or
- 6.4.2 If the vehicle exceeds the weight limits allowed for on streets not designated as heavy vehicle routes.
## Section 7. Restricted Use of Streets
## 7.1 Temporary Street Closure:
- 7.1.1 The Town is authorized to temporarily:
- a) Close the whole or any part of a street at any time for any purpose considered necessary;
- b) Prohibit parking on the whole or any part of a street at any time for any purpose considered necessary.
- 7.1.2 Where a street is temporary closed or parking is temporarily prohibited on a street, the street must be signed or barricaded to provide notice of the temporary closing or prohibition;
- 7.1.3 No person may drive or park a vehicle on any street which has been temporarily closed, except where permitted by the Town who closed the street.
## 7.2 Parades:
- 7.2.1 No person shall hold, take part in, or be a member of a parade unless
- The parade is under the direction or control of a marshal or organizer; and
- b. The parade has been permitted by the Chief of Police or his designate;
- 7.2.2 No person may cross through or in any way obstruct or interfere with a parade or assembly for which a parade has been authorized, except for a person operating a emergency vehicle such as an Ambulance, Fire Department vehicle or vehicle belonging to the Police Department, and is responding to an emergency.
## 7.3 Funeral Processions:
The driver of every vehicle in a funeral procession indicated as such by the four-way flashers of all motor vehicles therein being lighted upon approaching a traffic control signal showing a stop sign shall cause the vehicle to slow down or stop as may be necessary for safety, but may then proceed cautiously past the traffic control signal or stop sign. The driver of each of the other vehicles in the procession shall have the right-of-way over all other vehicles upon the street at the intersection or place where the signal or stop sign is situated.
## 7.4 Transporting Material:
- 7.4.1 All material of any kind being transported over any street or lane must be transported in such a manner and in such containers that no part of the material, while in transit, may find its way onto the surface of the street or lane. The owner or operator is responsible for the removal of any material or items falling onto the
- 7.4.2 No person may place any item or material that will obstruct any street, lane, sidewalk or boulevard. Any person who has placed such an item or material is responsible for removing it.
## 7.4.3 No person may litter on any street, lane, sidewalk, boulevard or other public property.
## 7.5 Prohibited Obstructions:
No person may:
- 7.5.1 Place or leave any cord or cable across any street, lane, or sidewalk except for the purpose of traffic counts authorized by the Town;
- 7.5.2 Build or construct any crossing in, on, or across any street, boulevard, sidewalk, drain, gutter, or any other public place in the Town without written permission from the Town;
- 7.5.3 Obstruct, interfere with or interrupt the free passage of traffic on any street, lane or sidewalk:
- 7.5.4 Place or dump snow, earth, gravel, sand or other material on a street, except where permitted by the Town.
## Section 8. Moving Violations
## 8.1 Hitchhiking
No person standing or walking on a public street, sidewalk or boulevard may solicit a ride from the operator of a vehicle by word, gesture, or any action whatsoever.
## 8.2 Engine Retarder Brakes
No person operating a vehicle may use engine retarder brakes in the Town, except to avoid or reduce the impact of a collision or in the case of such other emergency.
## Section 9. Parking & Stopping
## 9.1 Stopping and Parking Provisions not Exclusive:
The provisions of this by-law dealing with restrictions on stopping or parking shall not relieve any person from the duty to observe other and more restrictive provisions, prohibiting or limiting the stopping or parking of vehicles in specified places or at specified times.
## 9.2 Parking at Curb:
No person may park a vehicle upon a street except:
- a) At the east side on a street extending in a north/south direction;
- b) At the north side of a street extending in an east/west direction
- c) In the outer or longest side of the roadway in any bay;
- d) Parallel to or alongside the curb unless angle parking is indicated by signs or markings;
- e) If such parking is not otherwise prohibited by this By-Law.
6. 9.3 Parallel Parking:
7. 9.3.1 No person may parallel park:
- a) With the front or rear wheel nearest the curb more than 0.45 metres (1.5 feet) from that curb;
- b) Within one metre (3.2 feet) of any vehicle previously parked in front of or behind the vehicle.
10. 9.3.2 The operator of a motorcycle must park the vehicle at an angle of forty-five degrees to the curb and have the rear wheel within 0.3 metres (12 inches) of the curb.
## 9.4 Limited Time Street Parking:
Where limited time street parking is established, no person may:
- a) Park any vehicle upon any street for a time that exceeds the limit indicated by parking signage; or
- b) Move any parked vehicle to another spot on the same block at the expiration of the time allowed for by parking signage.
3. 9.5 No Stopping:
4. 9.5.1 No person may stop a vehicle on any street so as to interfere with or interrupt the passage of traffic.
5. 9.5.2 No person may stop a vehicle on any street in a traffic lane, except where required by traffic, a traffic control device, or as directed by an Enforcement Officer.
## 9.6 Stopping or Parking in Loading Zones:
- 9.6.1 No vehicle may be stopped or parked in a loading zone unless it is in the process of being loaded or unloaded.
- 9.6.2 No vehicle may remain in a loading zone, even if it is in the process of being loaded or unloaded, for longer than the length of time specified on the signage designating the loading zone.
## 9.7 Parking Stalls Reserved for Physically Disabled Persons:
- 9.7.1 No person shall stop, stand or park a motor vehicle in a parking space marked by signs, painted lines or poles reserving the spot for physically disabled persons, or in a manner that makes a parking space for physically disabled persons inaccessible, unless the vehicle displays a valid physically disabled person's parking permit issued under The Highway Traffic Act and in accordance with the regulations under that act;
## 9.8 Parking Prohibited:
No person shall park a vehicle for any period of time:
- a) Where it is double parked;
- b) On any portion of a boulevard, sidewalk or crosswalk;
- c) Within a street intersection;
- d) In a traffic lane of any street;
- e) On any street where parking has been temporarily prohibited;
- f) On any street for forty-eight (48) consecutive hours or more;
- g) On any back lane or alley for more than 15 minutes;
- h) Any place where signage indicates parking is prohibited;
- 1) In any posted fire lane;
10. Within 9 meters (30 feet) of a stop sign;
- k) Within 3 meters (10 feet) of the approach side of any sidewalk or crosswalk;
- 1) Obstructing any private approach or driveway;
- m) Any place where a curb is painted yellow upon direction of the Town;
- n) In the opposite direction of traffic;
- 0) Within 300 feet of a fire except fire trucks or other emergency vehicles.
## 9.9 Prohibited Vehicles:
The following are prohibited from parking on any street, lane or Town owned parking lot at any time:
- a) Any trailer, semi-trailer or tractor, or heavy vehicle not actively loading or unloading for more than two hours unless parked for use by tradespeople actively working on premises in the immediate area;
- b) Any unlicensed vehicle or vehicle with expired registration;
- c) Any snowmobile, dirt bike, all-terrain vehicle, golf cart or similar vehicle;
- d) Any bus not actively picking up or dropping off passengers;
- e) Any vehicle displaying a sign on which the advertising copy is not fixed and may be changed while the vehicle is in motion or while it is stopped or parked on a street;
- f) Any vehicle displayed for sale;

## 9.10 Snow Clearing:
- 9.10.1 No person may park or stop a vehicle or permit a vehicle to be parked or stopped on any street or portion of a street during and after snowfall events which will require the removal of accumulated snow. Persons may resume parking on streets after snow removal operations have been completed.
- 9.10.2 The Town may remove or cause to remove from a street, a vehicle that is stopped or parked in a position that causes it to interfere with removal of snow from the street or maintenance of the street.
## 9.11 Parking Exemptions:
The provisions of this by-law prohibiting or regulating stopping and parking shall not apply to:
- a) Emergency vehicles (ambulances, fire vehicles, police vehicles);
- b) Vehicles belonging to or employed by the Town of Sainte-Anne while in use on connection with work of necessity being done on or near a street;
- c) Vehicles of the Government of Manitoba, the Government of Canada, or a public utility where they are:
- i) Clearly identified as such;
5. ii) Actively engaged in work of necessity that requires them to stop or be parked in contravention of this by-law.
## Section 10. Enforcement
- 10.1 Contravention by Owner or Operator:
- 10.1.1 If a vehicle is in contravention of a provision of this By-Law, the operator of the vehicle is in contravention of that provision and is liable to pay any fine or administrative penalty imposed in respect to that contravention.
- If a vehicle is in contravention of a provision of this By-Law, an owner of the vehicle who was not the operator is also responsible for that contravention and is liable to pay any fine or administrative penalty imposed in respect of that contravention unless the owner establishes that the vehicle was in the possession of the operator without the owner's consent.
- 10.1.3 If both the owner of a vehicle and its operator are liable for the same contravention, a penalty notice may be issued to either of them or separate penalty notices may be issued to each of them. If they are each issued a penalty notice, each is liable for the amount payable under the notices issued.
- 10.1.4 If a trailer connected to a motor vehicle is in contravention of this By-Law, the operator and the owner of the motor vehicle are liable for that contravention.
## 10.2 Reference to Time:
A reference to a time in this By-Law or on any traffic control device that prohibits or regulates stopping or parking on a street or in a Town owned parking facility is a reference to the time determined in accordance with The Official Time Act of the Province of Manitoba.
- 10.3 Marking Tires
- 10.3.1 An Enforcement Officer may place an erasable mark on the tread face or side of any tire of any parked vehicle.
- No person may obstruct justice by physically removing or erasing a mark placed on the tread face or side of a tire of any parked vehicle by an Enforcement Officer until the vehicle has been moved through the nearest intersection.
- 10.3.3 Digital photographs are acceptable evidence for determining whether a vehicle has been parked in contravention to this By-Law.
- 10.4 Placing and Removal of Tickets:
- 10.4.1 No person, other than an Enforcement Officer, may place a Municipal Penalty Notice Ticket, Provincial Offence Ticket or Warning Notice on any vehicle.
- 10.4.2 No person, other than the person having charge of a vehicle, shall remove from the vehicle, a Municipal Penalty Notice Ticket, Provincial Offence Ticket, or Warning Notice from a vehicle.
- 10.4.3 Penalty Notice Tickets may be delivered by registered or ordinary mail to the address indicated in the records of the Registrar of Motor Vehicles for any contravention of this By-Law.
- 10.4.3.a A notice that is sent by ordinary mail is deemed to have been given to the person seven days after the day it is mailed
- 10.4.3.b A notice that is sent by registered mail is deemed to have been given to a person on the day that it is delivered to their address.
## 10.5 Removal and Impoundment of Vehicles:
- 10.5.1 An Enforcement Officer or Designated Officer of the Town of Sainte-Anne may, at their discretion, immediately remove or cause to be removed and impounded, any vehicle that is:
- a) Stopped or parked in contravention of a provision of this By-Law;
- b) Stopped or parked in a manner that causes it to interfere with removal of snow from a street by an authorized person;
- c) Stopped or parked in a position that causes it to interfere with the work of emergency workers such as paramedics, firefighters or police officers;
- d) Is apparently abandoned on or near a street.
- 10.5.2 Any person requesting the release of an impounded vehicle must:
- a) Present appropriate identification which corresponds to the vehicle's ownership and registration;
- b) Sign a receipt for its return;
- C) Pay the cost of removal;
- d) Pay any cost of storage accrued.
- 10.5.3 Until paid, charges listed in this By-Law constitute a lien on the vehicle which may be enforced in the same manner as a garage keeper's lien in accordance with the provisions of the Manitoba Garage Keeper's Act.
## Section 11. Remedies and Penalties
- 11.1 Subject to the Town of Sainte-Anne Enforcement By-Law, any person who contravenes or disobeys, or refuses or neglects to obey any provision(s) of this By-Law is guilty of an offence and is liable to the fines listed in Schedule "A" of this By-Law, in which shall form part of the Town of Sainte-Anne Enforcement By-Law.
- 11.2 Where a corporation commits an offense against this By-Law, each person who is authorized, or consented to, connived at, or knowingly permitted or acquiesced in, the doing of the act that constitutes offence, is likewise guilty of the offence and liable to the penalty for which provision is made in section 11.1.
- 11.3 Where the contravention, refusal, neglect, omission, or failure, continues for more than one day, the guilty person is liable to a separate offence for each day it continues.
## Section 12. Severability
If any section, subsection, sentence, clause, phrase or other portion of this By-Law is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, that portion shall be deemed a separate, distinct and independent provision and the holding of the Court shall not affect the validity of the remaining portions of the By-Law.
## Section 13. Repeal
- 13.1 The following Town of Sainte-Anne By-Laws are repealed:
- a) By-Law 8-2001 Traffic Control By-Law;
- b) By-Laws 6-2002, 5-2003, 3-2004, 12-2006, 11-2013, Amending By-Law 8-2001;
DONE AND PASSED in Council duly assembled at the Town of Sainte-Anne, in Manitoba, this 28th day of April, 2021.

Any contravention of the provisions of this By-Law are subject to the penalties listed below, in which is enforced under the Town of Sainte-Anne Enforcement By-Law, as amended.
