CITY OF STEINBACH
By-Law 1908
BEING A BY-LAW to ban smoking in and around public buildings in the City of
Steinbach.
WHEREAS The Municipal Act states in part as follows:
"232(1) A council may pass by-laws for municipal purposes respecting the
following matters:
(a) the safety, health, protection and well-being of people, and the safety
and protection of property;
(b) people, activities and things in, on or near a public place or a place
open to the public, including parks, municipal roads, recreation centers, restaurants,
facilities, retail stores, malls, and private clubs and facilities ..."
AND WHEREAS The Non-Smokers Health Protection Act states in part as
follows:
2(1)
Except as permitted in Sections 3 to 5.1, no person shall smoke in
(a) an enclosed public place;
(b) an indoor workplace;
(c) a group living facility;
(d) a public vehicle; or
(e) a vehicle used in the course of employment, while carrying two or
more employees.
AND WHEREAS the City of Steinbach deems smoking and chewing tobacco
hazardous to the health of people and offensive to the well-being of people;
THEREFORE BE IT ENACTED:
1.
THAT the City of Steinbach prohibit smoking and chewing tobacco by
any person(s) or employee(s) in, or within 50 feet of the entrance commonly used by the
public or employees, the public buildings known and identified as:
a)
City Hall
b)
T.G. Smith Centre
c)
Steinbach Aquatic Centre
d)
A.D. Penner Park picnic shelter and washrooms
e)
Jake Epp Public Library
f)
Steinbach Cultural Arts Centre
g)
Steinbach Airport
h)
Steinbach Firehall
i)
Lift Stations, Pumphouses, Water Treatment Plant, Reservoir, Lagoon
Building
j)
Steinbach Operations Building (and all related buildings on site)
k)
Landfill Office (and all related buildings on site)
l)
Any other building(s) which the City of Steinbach may build, lease, or
purchase after date of passage of this by-law.
2.
THAT the City of Steinbach authorize the installation and placement of
signs within the said buildings, and at the main entrances of the said buildings, indicating
that smoking and the use of chewing tobacco is prohibited within these facilities, and
within 50 feet of the main entrance.
3.
THAT every person who contravenes or refuses, neglects, omits, or fails
to obey or observe any provisions of this by-law, is liable on summary conviction to a
fine of not less than $100.00 and not more than $500.00 for each such contravention,
refusal, neglect, omission, or failure for one or more such offense.
DONE AND PASSED in Council duly assembled at Steinbach, in Manitoba, this 17th
day of August, 2010.
