## TOWN OF STONEWALL BY-LAW NO. 04-26
Being a By-Law of the Town of Stonewall for the Regulation of Traffic.
## PART 1: AUTHORITY, ENACTMENT AND DEFINITIONS
## 1. AUTHORITY
WHEREAS The Town of Stonewall is empowered under Part 7 and Part 9 section 282 of the Municipal Act S.M. 1996 c.58; Parts III, IV and VI of the Highway Traffic Act RSM 1985/86 c.H60; and the Dangerous Goods Handling and Transportation Act RSM 1987 c.D12 to regulate traffic and parking and the use of Streets and Sidewalks by By-Law and to impose penalties for the violation of such By-Law;
AND WHEREAS Section 45 of The Off-Road Vehicles Act provides, subject to the Act, a Traffic Authority may pass By-Laws respecting the operation of off-road vehicles;
AND WHEREAS The Highway Traffic Act S.M. 1985-86, c. 3 - Cap. H60, provides the Town of Stonewall, as the Traffic Authority, may pass By-Laws for the control and regulation of traffic, vehicles, pedestrians, and bicycles;
## 2. ENACTMENT
NOW THEREFORE be it and it is hereby enacted as a By-Law of the Town of Stonewall as follows:
## 3. TITLE
This By-Law may be referred to as "The Traffic By-Law" of the Town of Stonewall.
## 4. PROVINCIAL AND FEDERAL LEGISLATION
Pedestrians and all Persons driving, operating or using in any way a vehicle on any Street, Public Walkway, Off Street Parking Area, other Public Property, or on Private Property (where and to the extent as authorized by this By-Law), within the limits of the Town of Stonewall must in all respects conform to the provisions of this By-Law save and except where provisions of this ByLaw are inconsistent with provisions of relevant Provincial or Federal Statutes in which case the provisions of such statutes will override the provisions of this By-Law.
## 5. DEFINITIONS
In this By-Law:
- 5.1 "Alley" means a street intended primarily to give vehicles access to the rear or side of private or public property;
- 5.2 "Block" means the portion of a street which lies between two other streets neither of which is an alley and which both intersect the first named street;
- 5.3 "Boulevard" means the portion of a street, on either side or in the centre of the street, that:
- 5.3.1 is adjacent to the roadway or its shoulder;
- 5.3.2 is maintained for the purpose of improving the appearance or safety of the street;
- 5.3.3 is not intended to be used to carry vehicular traffic; and
- 5.3.4 is not a shoulder;
- 5.4 "CAO" means the Chief Administrative Officer of the Town of Stonewall as appointed by Council;
- 5.5 "Council" means the Council of the Town of Stonewall;
- 5.6 "Curb" means the actual curb to a street, or where there is no curb, the dividing line between that part of a street intended for the use of vehicles and that part of a street intended for use by pedestrians;
- "Dangerous Goods" means dangerous goods as defined in The Transportation of Dangerous Goods Act (Canada);
- 5.8 "Designated Officer" means the person or persons designated by the CAO of the Town of Stonewall who have been delegated authority over sections of this By-Law;
- 5.9 "Driveway" means a private right-of-way, paved or unpaved, that provides access for vehicles and pedestrians from a boulevard, curb, or sidewalk to private property or public property or a carport, garage, parking pad, parking area, loading berth, or structure located on the private property or public property;
- 5.10 "Enforcement Officer" means a Police Officer or Municipal By-Law Enforcement Officer of the Town of Stonewall. Can include a Provincial Enforcement Officer;
- 5.11 "Fire Lane" is a traffic lane or parking lane which is restricted for use by the Town fire fighting or emergency vehicles only;
- 5.12 "Heavy Vehicle" means:
- 5.12.1 a motor vehicle with a gross weight registration exceeding 9000 kilograms; or
- 5.12.2 a vehicle, including any combination of motor vehicle, trailer and load, with a total weight exceeding 9000 kilograms
- 5.12.3 Recreational vehicles as defined in this By-Law are excluded from the definition of a heavy vehicle.
- "Holiday" means any day identified as a general holiday in accordance with Town of Stonewall Non-Union Employees Policy;
- 5.14 "Intersection" means that portion of the roadway where two or more streets intersect;
- 5.15 "Loading Zone" means an area of street/road that no parking is allowed with the only exception of loading or unloading a vehicle whereby a vehicle can be parked on the street/road for the above purpose. Such loading zones will be identified by appropriate signs;
- 5.16 "Motorized Mobility Aid" means a device which is specifically manufactured or modified for operation by a physically disabled person and which has:
- 5.16.1 a maximum speed capability of not more than 15 kilometres per hour,
- 5.16.2 a maximum width of not more than 91 centimetres (36 inches), and
- 5.16.3 a maximum mass of not more than 226 kilograms (500 Ibs.),
- 5.16.4 and includes a motorized wheel chair;
- 5.17 "Not a Truck Route" means a route not to be used as a route of truck travel as outlined under Section 11.5 herein.
- 5.18 "Off-Road Vehicle" means a vehicle as defined in The Off-Road Vehicles Act;
- 5.19 "Over Dimensional Vehicle" means any combination of vehicle or load that exceeds:
- 5.19.1 2.10 metres in width for a passenger vehicle, or;
- 5.19.2 2.60 metres for any other vehicle but not including the following is part of that width:
- 5.19.2.1 loose hay, straw or fodder projecting beyond the sides of the vehicle to a total outside width not in excess of 3.70 metres;
- 5.19.2.2 one or more mirrors for the purpose of complying with The Highway Traffic Act, which do not extend more than 20 cm on each side beyond the total width of the vehicle and load;
- 5.19.2.3 a splashguard, load-covering device, load securement device, ladder, clearance lamp, dangerous goods placard, or other auxiliary device or piece of equipment not designed to carry cargo, that does not extend more than 10 cm on each side beyond the widest part of the vehicle and its load;
- 5.19.3 23.0 metres in length; or
- 5.19.4 4.15 metres in height;
- 5.20 "Parade" means a procession of 20 or more pedestrians standing, marching or walking along a street, excepting members of His Majesty's Armed Forces, or any group of 10 or more vehicles proceeding on a street under a common leadership except funeral processions;
- 5.21 "Pedestrian" means any person on foot, in a wheelchair, in a child's carriage, or a physically disabled person operating a motorized mobility-aid;
- 5.22 "Person" means any individual and includes corporation, firm, partnership and association or company and utilities;
- 5.23 "Private Property" means any real property which is not owned or under the control and management of the Town of Stonewall;
- 5.24 "Public Property" means any real property owned or under the control and management of the Town of Stonewall;
- 5.25 "Recreational Vehicle" means a vehicle, portable structure, trailer or watercraft that can be towed, hauled, carried on a vehicle or trailer, or driven and which is designed to be used for travel or recreational purposes, including:
- 5.25.1 a motor home, camper, travel trailer, fifth wheel trailer, tent trailer, truck camper, boat, canoe, kayak, snowmobile, all-terrain vehicle, jet ski, motorcycle, dirt bike, or other similar vehicle; or
- 5.25.2 a trailer designed to carry an item listed in 5.25.1;
- 5.26 "Roadway" means the portion of a street that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder;
- 5.27 "'School Bus Loading Zone" means an area of street/road that no parking is allowed with the only exception of loading or unloading a school bus whereby a school bus can be parked on the street/road for the above purpose. Such loading zones will be identified by appropriate signs;
- 5.28 "Service Vehicle" means: 5.28.1 an emergency vehicle; 5.28.2 a vehicle operated by or on behalf of the Town of Stonewall for Town purposes;
- 5.29 "Street" means any public right-of-way, including a road, highway or a Provincial Highway, providing primary access to abutting property, used as a public thoroughfare for Vehicles and Pedestrians including Streets under construction or repair, and where the context so requires, includes the whole of the area between the boundaries of the Streets as recorded in the Land Titles Office and includes all Lanes and Alleys;
- 5.30 "Traffic Control Device" means any sign, signal, pavement marking, barricade or other device erected, placed or marked on, at or above a street pursuant to The Highway Traffic Act and the manual of Uniform Traffic Control Devices for Canada as placed or erected by the CAO or their Designate for the purpose of regulating, warning, or guiding traffic pursuant to this By-Law;
- 5.31 "Traffic Lane" means a strip of roadway intended to accommodate a single line of moving vehicles;
- 5.32 "Trailer" means a vehicle designed for carrying goods or persons and for being towed by a motor vehicle;
- 5.33 "Truck" means a motor vehicle or semi-trailer truck that is constructed or adapted to carry goods, wares and merchandise, freight or commodities, but not passengers or luggage;
- 5.34 "Town" means the Town of Stonewall;
- 5.35 "Town Fire Department" means the Stonewall-Rockwood Fire Department as established, governed and operated by the Town of Stonewall;
- 5.36 "Vehicle" means a device in, on or by which a person or thing is or may be transported or drawn on a street and includes special mobile machines and agricultural implements, and, for the purpose of parking and stopping restrictions, includes any portion of a vehicle, but does not include a device designed to be moved solely by human muscular power or a motorized mobility aid;
- 5.37 "Work of Necessity" means work that is required to repair, replace, maintain or improve infrastructure belonging to the Town, the Province of Manitoba, or other public utilities.
## PART 2: TRAFFIC CONTROL DEVICES
## 6. TRAFFIC CONTROL STANDARD
The Transportation Association of Canada's Uniform Traffic Control Devices for Canada Manual is hereby adopted as the standard for all traffic control devices within the Town. Traffic Control Devices in existence at the time this By-Law is passed may be permitted by Town Council or the Designated Officer.
## 7. INSTALLATION AND MAINTENANCE
- 7.1 The Designated Officer is hereby authorized to install and maintain traffic control devices for the purpose of control, warning, guidance, information, and direction of traffic including any work of necessity in conformity with the provisions of this By-Law or any traffic requirements approved by Town Council;
- No person may install a traffic control device on public property unless given written approval by the CAO or the Designated Officer. The placement of any traffic control device in contravention of this By-Law is an offence and such traffic control device(s) will be removed;
- 7.3 The Designated Officer will keep a record of the location of all traffic control devices and zones where parking or stopping is restricted or prohibited by a traffic control device. The record will be available for inspection at the Town Office during normal business hours;
- 7.4 A person may request the Town to install or remove a traffic control device. Requests must be made in writing and may be reviewed by Town Council in a public meeting.
## 8. PROTECTION OF TRAFFIC CONTROL DEVICES
No person may damage, deface, remove, obscure, or interfere with any traffic control device placed or maintained by the Town for the purpose of traffic or parking control.
## 9. DIRECTIONAL ARROWS
Where a sign indicates parking or stopping restrictions by directional arrow, that restriction will continue in the direction of the arrow to the next street intersection unless interrupted by a similar sign with an opposite facing arrow.
## 10. TEMPORARY TRAFFIC CONTROL DEVICES
- 10.1 The Designated Officer will place and maintain, or cause to be placed and maintained, temporary traffic control devices for the purpose of prohibiting or regulating traffic in conformity with the provisions of this By-Law or any traffic requirements approved by Council;
- 10.2 Any person undertaking work authorized by the Town of any form within a street or in any way interfering with or obstructing the normal use of a street must place and maintain a temporary traffic control device as directed by the Designated Officer.
## PART 3: HEAVY/COMMERCIAL VEHICLES
## 11. DESIGNATED ROUTES
- 11.1 The streets set out as Dangerous Goods Routes are:
- 11.1.1 2nd Avenue North between the easterly limit of the Town and 4th Street East (PTH No. 67);
- 11.1.2 4th Street East between the northerly limit of the Town and 2nd Avenue North (PR 236);
- 11.1.3 4th Street East between 2nd Avenue North and the southerly limit of the Town (PTH No. 67);
- 11.1.4 Provincial Trunk Highway No. 67 between 4th Street East and the westerly limit of the Town;
- 11.2 No person shall operate a vehicle transporting or designed for transporting dangerous goods in bulk other than on a Dangerous Goods Route except while such vehicle:
- 11.2.1 is making collection or delivery, provided that the operator proceeds by the most direct route to or from the point of collection or delivery, as the case may be, to or from the nearest Dangerous Goods Route;
- 11.2.2 is proceeding to or from the business premises of the owner or operator of the vehicle, provided that the operator proceeds by the most direct route to or from the business premises, as the case may be, to or from the nearest Dangerous Goods Route;
- 11.2.3 is proceeding to or from a garage for the purpose of repairs, servicing or refuelling, provided that the operator proceeds by the most direct route to or from the garage, as the case may be, to or from the nearest Dangerous Goods Route;
- 11.2.4 is being operated in the service of the Town; or
- 11.2.5 is under escort by a marked vehicle operated by an Enforcement Officer or the
- 11.2.6 Town Fire Department, pursuant to a valid Temporary Street Use Permit, in which case the vehicle shall travel on the route approved by the Town necessary to reach a permitted destination;
- 11.3 Notwithstanding subsection 11.2, no person shall operate a vehicle transporting or designed for transporting dangerous goods in bulk on any route other than on a Dangerous Goods Route between the hours of 7:00 AM to 9:00 AM and 4:00 PM to 7:00 PM except:
- 11.3.1 where the operator is in the course of delivering heating fuel to a residential dwelling unit; or
- 11.3.2 where the operator is in the course of delivering cylinders containing oxygen for medical purposes, provided no cylinder being transported may weigh more than 60 kilograms, the total weight of cylinders being transported may not exceed 1,900 kilograms and not exceeding 36 cylinders;
- 11.4 Notwithstanding sub-sections 11.2 or 11.3, this section does not apply:
- 11.4.1 to the transportation of dangerous goods of a weight measure equal to or less than such weight measures as are exempted under Federal regulations; or
- 11.4.2 to fuel in the fuel tank of the vehicle transporting or designed to transport dangerous goods, provided that the fuel is carried in permanently mounted tanks with direct lines to the fuel system of the vehicle.
- 11.5 The streets set out shall be deemed as "Not a Truck Route:"
- 11.5.1 Road 76N between Roads 6E the eastern most edge of NW19-13-2E
## 12. HEAVY VEHICLES
- 12.1 No person shall operate on any street a heavy vehicle or load, or both, as defined in this ByLaw, except where the Designated Officer has approved such operation by the issuance of an Overweight Load Permit, as set out in Schedule A attached hereto, and the payment of the applicable Permit Fee as prescribed in Schedule D attached hereto;
- 12.2 This section does not apply to a heavy vehicle making collection or delivery from residences or businesses within the Town, provided that the operator proceeds by the most direct route to or from the point of collection or delivery, to or from the nearest provincial road or highway;
- 12.3 This section does not apply to any vehicle owned by or under contract to the Town or any other public utility vehicle while that vehicle is:
- 12.3.1 actually engaged in maintenance or construction of public works; or
- 12.3.2 travelling to any location for the purpose of carrying out maintenance or construction of public works;
- 12.4 Every operator of a vehicle shall comply with a request of an Enforcement Officer to immediately proceed to the nearest Weigh Scale and there allow the vehicle to be weighed for the purpose of determining whether the vehicle is overweight.
## PART 4: RESTRICTED VEHICLES
## 13. OFF-ROAD VEHICLES
- 13.1 The following designated off-road vehicles may be operated upon a street within the Town, with the exception of the streets or portion thereof (being a portion of 2nd Ave North and a portion of 4th St. East) under the authority of the Province of Manitoba which are shown on the Map attached hereto as Schedule B, provided the designated off-road vehicles are operated in compliance with subsection 13.3.
- 13.1.1 Snowmobiles;
- 13.1.2 All Terrain vehicles;
- 13.1.3 A mini-bike, dirt bike, trail bike and a "pocket" motorcycle or dirt bike;
- 13.2 The following designated off-road vehicles are not permitted to be operated upon a street or any other public property within the Town:
- 13.2.1 A four-wheel drive motor vehicle, a motorcycle or a snow vehicle not registered and licensed under The Highway Traffic Act or any other Act of the Legislature passed and enacted to govern the registration of vehicles;
- 13.2.2 A miniature vehicle such as a dune or sport buggy;
- 13.2.3 An off-road maintenance vehicle; and
## 13.2.4 An amphibious vehicle;
- 13.3 The off-road vehicles designated in subsection 13.1.1, 13.1.2, and 13.1.3 are permitted to operate upon a street within the Town provided the operation of the designated off-road vehicle:
- 13.3.1 is the most direct route to and from a residence or other place of origination and the limits of the Town; and
- 13.3.2 does not exceed a speed of 30 kilometres per hour; and
- 13.3.3 is operated by a person over the age of 16 years, and the off-road vehicle is licensed and registered under The Off Road Vehicle Act; and
- 13.3.4 is operated by a person wearing on his head a properly adjusted and securely fastened helmet in compliance with the requirements contained in the regulations under The Off-Road Vehicle Act; and
- 13.3.5 is not operated in a careless manner or without due care and attention; and
- 13.3.6 is not operated without reasonable consideration for other persons and property or in a manner likely to cause damage or injury to other persons and property;
- 13.4 No person shall operate a designated off-road vehicle:
- 13.4.1 on private property without the express or implied consent of the owner or lawful occupier of the property;
- 13.4.2 within 30 meters of a dwelling between the hours of 12:00 AM and 7:00 AM, unless the dwelling is located on the operator's own property or property under the operator's control or as an invited guest; or
- 13.4.3 within 30 meters of a playground, or area set aside for other recreational uses, unless the area is enclosed or fenced.
## 14. MOTORIZED MOBILITY AID
- 14.1 A motorized mobility aid may be operated upon a street within the Town provided the motorized mobility aid is operated:
- 14.1.1 by a person who is licensed pursuant to The Driver's License Regulation;
- 14.1.2 as closely as practicable to the right-hand edge of the roadway;
- 14.1.3 except when over taking or passing is not operated beside another mobility vehicle, motorized mobility aid or bicycle that is operating in the same lane;
- 14.1.4 at all times, with at least one hand on the handle bar;
- 14.1.5 is not operated in a careless manner or without due care and attention;
- 14.2 A motorized mobility aid may be operated upon a sidewalk within the Town provided it is not operated in a careless manner or without due care and attention.
## 15. GOLF CARTS
- 15.1 Golf carts are not permitted to be operated upon a street or any other public property within the Town with the following exception:
- 15.1.1 Golf Carts May be operated within the Town if owned by, or leased to, or under contract to the Town;
- 15.1.2 Golf Carts may be operated within Quarry Park as follows:
- 15.1.2.1 the golf cart belongs to a registered camper in the seasonal campground;
- 15.1.2.2 the golf cart is registered with the Quarry Park Manager at the start of each camping season;
- 15.1.3 Golf carts may be operated upon a street that has been closed by the Town for a Festival or Special Event as follows:
- 15.1.3.1 The Festival or Special Event Organizers have received written authorization from the CAO permitting use of a specified number of golf carts needed to run the event;
- 15.1.3.3 All golf carts must be used for the successful operation of the Festival or Special Event. Personal use is not permitted.
- 15.1.3.2 All golf carts are registered with the Town Office along with a list of operators at least two weeks prior to the Festival or Special Event;
- 15.2 The Golf Cart exceptions provided for in subsections 15.1.1, 15.1.2, and 15.1.3 must abide by the following conditions:
- 15.2.1 only electric golf carts are permitted;
- drivers must be 16 years of age, have adequate training and drive responsibly;
- drivers must give pedestrian traffic the right of way;
- 15.2.3 drivers must not exceed speed of 10 km per hour;
- no open alcohol or recreational drug use is allowed while driving or riding on a golf cart;
- 15.2.6 all riders must have a proper seat and remain seated with all body parts inside the cart when cart is in motion. No standing while the cart is moving;
- 15.2.7 dogs riding on a cart must be secured so that they remain on the cart at all times;
- 15.2.8 after dusk, headlights are required. Homemade lighting is not acceptable;
- 15.2.9 golf carts are not permitted to be driven around the park after 11:00 PM;
- 15.2.10 owners of the golf cart are responsible for the actions and activity of any person driving/riding on their cart and will be held liable if misuse or injury should occur;
- 15.3 Power-Assisted (Electric) Bicycles may be operated upon a street within the Town in accordance with The Highway Traffic Act of Manitoba and the regulations under the act.
## PART 5: RESTRICTED USE OF STREETS
## 16. TEMPORARY STREET CLOSURE
- 16.1 No person shall operate a vehicle on any street temporarily closed to vehicle traffic by authority of this By-Law, or any other By-Law of Council, or any Resolution passed by Council;
- 16.2 No person shall park or stop a vehicle on any street where parking or stopping is temporarily restricted by authority of this By-Law, or any other By-Law of Council, or any Resolution of Council;
- 16.3 Notwithstanding any other provision in this By-Law, the CAO shall have authority to temporarily close to vehicle traffic or restrict parking or stopping on any street as follows:
- 16.3.1 to enable work to be carried out by or on behalf of the Town, including road construction and/or maintenance, street cleaning, snow removal and sewer or water line construction, repair or improvements;
- 16.3.2 to facilitate the moving of any building, structure, machine or other object;
- to facilitate the construction, repair or demolition of a building, structure or other object; and
- 16.3.4 to facilitate public gatherings.
- 16.4 Where a street is temporarily closed, the Designated Officer shall cause the street to be marked with a sign or barricade indicating the closure and the hazards, if any, that would be encountered in its use.
## 17. TEMPORARY STREET USE PERMIT
- 17.1 No person shall occupy any street, sidewalk or boulevard or cause any encroachment or obstruction thereon in the manner contemplated in this section without first obtaining a Temporary Street Use Permit;
- 17.2 The CAO may issue Temporary Street Use Permits, as prescribed in Schedule C attached hereto, for temporary use of a public street, highway, sidewalk or boulevard.
- 17.3 Temporary Street Use Permits shall be restricted to situations involving major deliveries, the construction, repair, demolition or relocating a building or other object, and to special uses the CAO deems appropriate.
- 17.4 Notwithstanding subsection 17.2, Temporary Street Use Permits shall only be issued by the CAO on:
- 17.4.1 receipt of a written application not less than three working days, or in the case of an application for an outdoor restaurant 15 days prior to the commencement of the temporary street use;
- 17.4.2 the issuance of necessary permits or approvals by authorities having jurisdiction over the activity or area for which the temporary street use is sought;
- 17.4.3 receipt of the Applicant's written agreement, to bear all costs associated with the Temporary Street Use, to carry insurance in amounts acceptable to the Town, to indemnify the Town from and against third party claims, and to repair or pay costs of repairing any damage done by the Applicant to Town property or to streets, sidewalks and boulevards;
- 17.4.4 receipt of a fee prescribed in Schedule D attached hereto; and
- upon the CAO being satisfied that the Temporary Street Use Permit will not result in an activity which unduly interferes with the movement of traffic or constitutes a threat to public safety;
- 17.5 The CAO may impose conditions on the issuance of a Temporary Street Use Permit. Failure to meet any of the conditions outlined in the Street Use Permit may result in the Applicant being subject to a fine as specified Schedule D attached hereto;
- 17.6 Any person who obtains a Temporary Street Use Permit shall abide by the conditions imposed by the CAO pursuant to this Section;
- 17.7 The CAO may revoke or suspend a Temporary Street Use Permit when the Applicant fails to observe conditions of permit issuance or where in the opinion of the CAO the activity of the Applicant has proven to unduly interfere with the movement of traffic or is constituting a threat to public safety, or otherwise in accordance with rights reserved by the CAO as a condition of permit issuance;
## 18. PARADES
- 18.1 No person shall hold, take part in or be a member of a parade unless;
- 18.1.1 The parade is under the direction or control of a person acting as Marshall or Organizer;
- 18.1.2 The parade has been duly permitted by the Town in accordance with Policy 9.4;
- 18.1.3 While a parade is in process, pedestrians not participating shall be restricted to the adjoining sidewalk or boulevards;
- 18.1.4 No person shall drive a vehicle through a parade, obstruct or interfere with a parade or drive a vehicle on any portion of a street that has been roped off, barricaded or otherwise indicated to traffic.
## 19. FUNERAL PROCESSIONS
The driver of every vehicle in funeral procession indicated as such by the four-way flashers of all motor vehicles therein being lighted upon approaching a traffic control signal showing a red traffic control light, or a stop sign, shall cause the vehicle to slow down or stop as may be necessary for safety, but may then proceed cautiously past the traffic control signal or stop sign. The driver of each of the other vehicles in the procession shall have the right-of-way over all other vehicles upon the street at the intersection or place where the signal or stop sign is situated.
## 20. TRANSPORTING MATERIAL
- 20.1 All material or any kind being transported over any street or lane must be transported in such a manner and in such containers that no part of the material, while in transit may find its way onto the surface of the street or lane. The owner or operator is responsible for the removal of any material or items falling onto the street or lane;
- 20.2 No person may place any item or material that will obstruct any street, lane, sidewalk or boulevard. Any person who has placed such an item or material is responsible for removing it;
- 20.3 No person may litter on any street, lane, sidewalk, boulevard or other public property.
## 21. PROHIBITED OBSTRUCTIONS
- 21.1 No person shall place or leave any cord or cable across any street, lane, or sidewalk except for the purpose of traffic counts authorized by the Designated Officer;
- 21.2 No person shall build or construct any crossing in, on, or across any street, boulevard, sidewalk, drain, gutter, or any other public place in the Town without written permission from the Designated Officer;
- 21.3 No person shall obstruct, interfere with or interrupt the free passage of traffic on any street, lane or sidewalk;
- 21.4 No person shall place or dump snow, earth, gravel, sand and or other material on a street, except where permitted by the Designated Officer through a Temporary Street Use Permit.
## 22. INTERSECTION SIGHT LINE CONTROLS AND OBSTRUCTIONS
- 22.1 No person shall obstruct sight lines at the intersection of a street with any other street, alley or driveway;
- 22.2 The Designated Officer may remove or cause the removal of that obstruction at the cost of the person who caused or allowed the obstruction and may destroy or otherwise dispose of the obstruction;
- 22.3 This Section does not apply to mature trees situated within identified site lines provided that all branches and foliage of any such tree are cut back from ground level to a height of two (2) meters measured from the grade of the nearest curb;
- 22.4 Subject to subsection 22.2, no owner or occupant of a property shall cause or permit:
- 22.4.1 the planting, erection, maintenance or keeping of any plant, tree, fence or other obstruction; or
- 22.4.2 the piling or placing of snow; or
- 22.4.3 the parking of a recreational vehicle;
on that portion of the adjacent boulevard so as to cause an obstruction;
- 22.5 Subject to subsection 22.4, the Designated Officer may remove any recreational vehicle, plant, tree, structure or snow that has been placed on the adjacent boulevard.
## PART 6: MOVING VIOLATIONS
## 23. OBSTRUCTING TRAFFIC
- 23.1 No person shall obstruct, interfere with or interrupt the free passage of traffic on any street or private road within the Town;
- 23.2 No person shall obstruct, interfere with or interrupt the free passage of pedestrian traffic on any crosswalk, pedestrian corridor or sidewalk.
## 24. U-TURNS
No person shall turn a vehicle so as to proceed in the opposite direction at any intersection on Main Street in the Town between the northern limit of Main Street at Fourth Avenue North where said Avenue intersects Main Street and the southern limit of Main Street at the entrance to the Veterans Memorial Sports Complex.
## 25. SOLICITING FROM VEHICLE
- 25.1 No person shall solicit business from a vehicle, except where licensed to do so by the Town;
- 25.2 No person shall annoy any person by soliciting or enticing any person to a vehicle.
## 26. PUBLIC PROPERTY
- 26.1 No person shall drive any vehicle on or across any public property other than a street, including any ditch, park, playground, public reserve or school ground, except as authorized by this By-Law or indicated by traffic control devices erected by the Town or other public authority having jurisdiction;
- 26.2 This section shall not apply to service vehicles owned by or leased to the Town of Stonewall.
## 27. CROSSING CURB
No person operating a vehicle shall drive the vehicle across a curb or sidewalk except at a defined driveway.
## 28. TRACKING MUD OR DEBRIS UPON A PUBLIC HIGHWAY/STREET
- 28.1 No person shall drive, operate or permit to be driven or operated, any vehicle or equipment of any nature or kind in such a manner as to track mud or debris upon a street to such an amount, that in the opinion of an Enforcement Officer, results in a dangerous and/or unsafe condition on the said street;
- 28.2 Any person who tracks upon a street, contrary to subsection 29.1, in addition to the penalty specified in Schedule D attached hereto, shall be liable to the Town for costs of clean up or removal of the mud or debris.
## 29. ENGINE RETARDER BRAKES
No person operating a vehicle shall use engine retarder brakes in the Town, except to avoid or reduce the impact of a collision or in the case of such other emergency.
## PART 7: PARKING AND STOPPING
## 30. STOPPING AND PARKING PROVISIONS NOT EXCLUSIVE
The provisions of this By-Law dealing with restrictions on stopping or parking may not relieve any person from the duty to observe other and more restrictive provisions, prohibiting or limiting the stopping or parking of vehicles in specified places or at specified times.
## 31. PARKING
- 31.1 Restricted parking traffic control devices shall indicate those times during the day or those days of the week when parking is restricted or prohibited;
- 31.2 Parking limit traffic control devices shall indicate the maximum time period and the days of the week when parking is limited or permitted;
- 31.3 A temporary change to parking restrictions in a specific area may be authorized by a resolution of Council for a set period of time;
## 32. PARKING AT CURB
- 32.1 No person shall park a vehicle on a street except:
- 32.1.1 at the right-hand curb on a two-way street;
- 32.1.3 in the direction of traffic on that side of the street; and
- 32.1.2 parallel to or alongside the curb unless angle parking is indicated by signs or markings;
- 32.1.4 if such parking is not otherwise prohibited by this By-Law.
## 33. PARALLEL PARKING
- 33.1 No person may parallel park:
- 33.1.1 with the front or rear wheel nearest the curb more than 0.45 metres (1.5 feet) from that curb;
- 33.1.2 within one metre (3.2 feet) of any vehicle previously parked in front of or behind the vehicle;
- 33.2 The operator of a motorcycle must park the vehicle at an angle of forty-five degrees to the curb and have the rear wheel within 0.3 metres (12 inches) of the curb.
## 34. LIMITED TIME STREET PARKING
No person shall stop, stand or park or cause to stop, stand or park any vehicle on Main Street in the Town between Second Avenue North and Third Avenue South for a period of more than four hours between the hours of 8:00 A.M. and 5:00 P.M. Monday through Saturday, both inclusive. This subsection shall not apply when businesses in the Town are closed because of a holiday.
## 35. NO STOPPING
- 35.1 No person shall stop a vehicle on any street or private road so as to interfere with or interrupt the passage of traffic;
- 35.2 No person may stop a vehicle on any street or private road in a traffic lane, except where required by traffic, a traffic control device, or as directed by an Enforcement Officer.
## 36. STOPPING OR PARKING IN LOADING ZONES
- 36.1 No vehicle may be stopped or parked in a loading zone unless it is in the process of being loaded or unloaded. See list of loading zones in Schedule E;
- 36.2 No vehicle may remain in a loading zone, even if it is in the process of being loaded or unloaded, for longer than the length of time specified on the signage designating the loading zone.
## 37. PARKING STALLS RESERVED FOR PHYSICALLY DISABLED PERSONS
- 37.1 No person may park a vehicle in any parking stall marked by signs, painted lines or poles reserving the spot for physically disabled persons unless a valid disabled person's parking permit is displayed;
- 37.2 The disabled person's parking permit must be used and displayed in the vehicle in accordance with The Highway Traffic Act of Manitoba and the regulations under the act.
## 38. NO PARKING OR STOPPING ZONES
- 38.1 No person shall stop, stand, or park or cause to stop, stand, or park any vehicle on the following streets in the Town:
- 38.1.1 in residential areas on the side of the street where the fire hydrants are located, as indicated in Schedule F;
- 38.1.2 South side of 2nd Ave North from 2nd Street East to Main Street;
- 38.1.3 North side of 2nd Ave North in front of Ecole R. W. Bobby Bend School building from the extension of the eastern wall of the school building to Main Street;
- 38.1.4 Market Street
- 38.1.5 Ist Avenue North between 4th Street West and 5th Street West from 8:00 AM to 4:00 PM;
- 38.1.6 South side of Centre Ave from 5th Street West to Ash Point Road;
- 38.1.7 West side of Ist Street West from the northernmost boundary of 429 1st Street West to 2nd Avenue South;
- 38.1.8 5th Street West from 2nd Avenue North to Centre Ave between the hours of 8:00 AM and 5:00 PM, Monday through Friday, inclusive;
- 38.1.9 Keith Cosens Drive between 5th Street West and Lions Way;
- 38.1.10 12th Street West;
## 39. PARKING PROHIBITED
- 39.1 No person may park a vehicle for any period of time:
- 39.1.1 where it is double parked;
- 39.1.2 on any portion of a boulevard, sidewalk or crosswalk;
- 39.1.3 within a street intersection;
- 39.1.4 in a traffic lane of any street or private road;
- 39.1.5 on any street where parking has been temporarily prohibited;
- 39.1.6 on any back lane or alley for more than 15 minutes;
- 39.1.7 any place where signage indicates parking is prohibited;
- 39.1.8 in any posted fire lane;
- 39.1.9 within 3 meters (10 feet) of a fire hydrant;
- 39.1.10 within 9 meters (30 feet) of a stop sign or traffic light;
- 39.1.11 within 3 meters (10 feet) of the approach side of any sidewalk or crosswalk;
- 39.1.12 obstructing any private approach or driveway;
- 39.1.13 any place where a curb is painted yellow upon direction of the Designated Officer;
- 39.1.14 in the opposite direction of traffic;
- 39.1.15 on public property other than a street or on any park, playground, public reserve or school ground, except as authorized by this By-Law or permitted by traffic control devices erected by the Town or other public authority having jurisdiction;
- 39.1.16 This section shall not apply to service vehicles owned by or leased to the Town of Stonewall.
- 39.2 No person shall park or cause to be parked, a vehicle on any portion of a street in contravention of Town of Stonewall Snow Clearing Policy that provides for snow clearing from streets.
## 40. PROHIBITED VEHICLES
- 40.1 Unless specifically permitted by Resolution of Council, no person shall park or cause to be parked on any street:
- 40.1.1 A gasoline tank truck unattended;
- 40.1.2 A vehicle, for the principal purpose of washing, greasing or repairing such vehicle, except the immediate repairs necessitated by an emergency;
- 40.1.3 A vehicle displayed for sale;
- 40.1.4 Any trailer, semi-trailer or tractor, or heavy vehicle not actively loading or unloading for more than one (1) hour unless parked for use by tradespeople actively working on premises in the immediate area;
- 40.1.5 Any unlicensed vehicle or vehicle with expired registration;
- 40.1.6 Golf cart or similar vehicle;
- 40.1.7 Any bus not actively picking up or dropping off passengers;
- 40.1.8 Any vehicle displaying a sign on which the advertising copy is not fixed and may be changed while the vehicle is in motion or while it is stopped or parked on a street;
- 40.1.9 Any vehicle being used for the purpose of displaying goods for sale;
- 40.1.10 Any vehicle which is not in running condition or which is under repair;
- 40.1.11 Recreational Vehicles except for motorhomes and campers when actively loading or unloading for a maximum of two (2) hours;
- 40.1.12 Any vehicle with an overall length of more than seven metres (including attached trailers);
- 40.1.13 Subsection 41.1.4 shall not apply to vehicles owned by or leased to the Town;
- 40.1.14 Subsections 41.1.4 and 41.1.11 shall not apply to vehicles parked on streets in the Industrial Light Zone or Industrial Heavy Zone as identified in the Town of Stonewall Zoning By-Law;
- 40.1.15 Subsection 41.1.7 shall not apply to vehicles owned or leased to Stonewall & Area Mobility Services.
## 41. OFF-STREET PARKING
No person shall enter, leave or park in an off-street parking area except in accordance with the directional signs installed in that area.
## 42. PARKING EXEMPTIONS
- 42.1 The provisions of this By-Law prohibiting or regulating stopping and parking do not apply to:
- 42.1.1 Emergency vehicles such as ambulances, the Town Fire Department vehicles or vehicles belonging to the RCMP;
- 42.1.2 Vehicles belonging to or employed by the Town while in use in connection with work of necessity being done on or near a street;
- 42.1.3 Vehicles belonging to the Government of Manitoba, the Government of Canada, or a public utility where they are:
- 42.1.3.1 clearly identified as such;
- 42.1.3.2 actively engaged in work of necessity that requires them to stop or be parked in contravention of this By-Law;
- 42.1.3.3 not stopped or parked in a lot equipped with a parking meter(s).
## PART 8: ENFORCEMENT
## 43. EMERGENCY TRAFFIC
- 43.1 An Enforcement Officer is hereby authorized to direct traffic in conformity with this By-Law and The Highway Traffic Act;
- 43.2 Notwithstanding any other provisions of this By-Law, an Enforcement Officer, a person designated by a Peace Officer, or a member of the Town Fire Department are hereby authorized to direct or prohibit traffic on any street in any manner they deem necessary to expedite traffic, safeguard pedestrians, prevent accidents or meet any unforeseen conditions, whether or not in conformity with this By-Law or The Highway Traffic Act, in the event of a fire, traffic accident or other emergency;
- 43.3 Every person shall comply with a direction or signal of an Enforcement Officer, a person designated by a Peace Officer, or a member of the Town Fire Department given under authority of this Section.
## 44. CONTRAVENTION BY OWNER OR OPERATOR
- 44.1 If a vehicle is in contravention of a provision of this By-Law, the operator of the vehicle is in contravention of that provision and is liable to pay any fine or administrative penalty imposed in respect to that contravention;
- If a vehicle is in contravention of a provision of this By-Law, an owner of the vehicle who was not the operator is also responsible for that contravention and is liable to pay any fine or administrative penalty imposed in respect of that contravention unless the owner establishes that the vehicle was in the possession of the operator without the owner's consent;
- 44.3 If both the owner of a vehicle and its operator are liable for the same contravention, a penalty notice may be issued to either of them or separate penalty notices may be issued to each of them. If they are each issued a penalty notice, each is liable for the amount payable under the notices issued;
- 44.4 If a trailer connected to a motor vehicle is in contravention of this By-Law, the operator and the owner of the motor vehicle are liable for that contravention.
## 45. REFERENCE TO TIME
A reference to time in this By-Law or on any traffic control device that prohibits or regulates stopping or parking on a street or in a Town owned parking facility is a reference to the time determined in accordance with the Official Time Act of the Province of Manitoba.
## 46. MARKING OF TIRES
- 46.1 A Designated Officer or person authorized by the RCMP with the enforcement of this ByLaw may place an erasable mark on the tread face or side of any tire of any parked vehicle;
- 46.2 No person may obstruct justice by physically removing or erasing a mark placed on the tread face or side of a tire of any parked vehicle by a Designated Officer or person authorized by the RCMP until the vehicle has been moved through the nearest intersection;
- 46.3 Digital photographs are acceptable evidence for determining whether a vehicle has been parked in contravention to this By-Law.
## 47. PLACING AND REMOVAL OF TICKETS
- 47.1 No person, other than a Designated Officer or person authorized by the RCMP with the enforcement of this By-Law, may place a Penalty Notice ticket, Provincial Offence Ticket, or Warning Notice on any vehicle;
- 47.2 No person, other than the owner or operator of a vehicle may remove a Penalty Notice ticket, Provincial Offence Ticket, or Warning Notice from a vehicle;
- 47.3 Penalty Notice Tickets may be delivered by registered or ordinary mail to the address indicated in the record of the Registrar of Motor Vehicles for any contravention of this By-Law.
- 47.3.1 A notice that is sent by ordinary mail is deemed to have been given to the person seven days after the day it is mailed;
- 47.3.2 A notice that is sent by registered mail is deemed to have been given to the person on the day that it is delivered to their address.
## 48. REMOVAL AND IMPOUNDMENT OF VEHICLES
- 48.1 An Enforcement Officer, Police officer or other Designated Officer may at their discretion immediately remove or cause to be removed and impounded any vehicle that is:
- 48.1.1 stopped or parked in a contravention of a provision of this By-Law;
- 48.1.2 stopped or parked in a manner that causes it to interfere with removal of snow from a street by an authorized person;
- 48.1.3 stopped or parked in a position that causes it to interfere with the work or emergency workers such as paramedics, fire fighters or police officers;
- 48.1.4 is apparently abandoned on or near a street;
- 48.2 Any person requesting the release of an impounded vehicle must:
- 48.2.1 present appropriate identification which corresponds to the vehicle's ownership and registration;
- 48.2.2 sign a receipt for its return;
- 48.2.3 pay the cost of removal;
- 48.2.4 pay any cost of storage accrued;
- 48.3 Until paid, charges listed in subsection 48.2 of this By-Law constitute a lien on the vehicle which may be enforced in the same manner as a garage keeper's lien in accordance with the provisions of the Manitoba Garage Keeper's Act.
## 49. REMEDIES AND PENALTIES
- 49.1 Subject to the Town of Stonewall By-Law implemented under the authority of the Municipal By-Law Enforcement Act, any person who contravenes or disobeys, or refuses or neglects to obey any provision(s) of this By-Law is guilty of an offence and is liable to the fines listed in Schedule D;
- 49.2 Where a corporation commits an offense against this By-Law, each person who is authorized, or consented to, connived at, or knowingly permitted or acquiesced in, the doing of the act that constitutes offence, is likewise guilty of the offense and liable to the penalty for which provision is made in section 49.1;
- 49.3 Where the contravention, refusal, neglect, omission, or failure, continues for more than one day, the guilty person is liable to a separate offense for each day it continues;
## 50. REMOVAL OF OBSTRUCTION
Where an obstruction, encumbrance or encroachment is created or left on any street, boulevard or sidewalk, any Peace Officer may remove or cause the removal of that obstruction, encumbrance or encroachment at the cost of the person who caused the obstruction, encumbrance or encroachment and may destroy or otherwise dispose of the obstruction, encumbrance or encroachment.
## 51. FALSE STATEMENT
No person shall make any false statement, written report or document with respect to any material fact relating to any provision and/or aspect of this By-Law.
## PART 9: SEVERABILITY
If any Section, subsection, sentence, clause, phrase or other portion of this By-Law is for any reason held invalid or unconstitutional by any Court of Competent jurisdiction, that portion shall be deemed a separate, distinct and independent provision and holding of the Court shall not affect the validity of the remaining portions of the By-Law.
## PART 10: REPEAL
By-Law 17-24 is hereby repealed.

## APPLICANT ACKNOWLEDGEMENT
- i) The applicant agrees to bear all costs associated with the Temporary Street Use, to carry insurance in an amount acceptable to the Town, to indemnify the Town from and against third party claims, and to repair or pay costs or repairing any damage done by the Applicant to Town property or to streets, sidewalks, and boulevards.
- ii) Conditions (noted below) may be imposed on the issuance of the Temporary Street Use permit. Failure to abide by the conditions that may be imposed may result in a fine not exceeding $200.00.
- iii) The Temporary Street Use Permit may be revoked or suspended if the Applicant fails to observe any conditions or issuance or where in the opinion of the Town the activity of the Temporary Street Closure has proven to unduly interfere with the movement of traffic or is constituting a threat to public safety or otherwise in accordance with rights reserved by the Town as a condition of permit issuance.

## CONDITIONS OF APPROVAL:
- [ ] Permit Holder to ensure safe access for customers of existing businesses during construction, filming, etc.
- [ ] Permit Holder must ensure piles of material are clearly identified with reflective/high visibility markers for vehicle traffic.
- [ ] Permit Holder must provide traffic cones and/or signage to mark area.
- [ ] Access will be allowed to all Emergency Vehicles.
- [ ] Town of Stonewall Nuisance Noise By-Law 19-06 has been provided.
- [ ] All affected residents and businesses will be notified directly with notices providing details and contact information.
- [ ] Traffic Control will be provided including pylons and manned barricades by Permit Holder.
- [ ] Foot traffic to all Main Street businesses will be maintained for the duration of the permit.
- [ ] Permit Holder will advertise temporary street closures in the local newspaper.
