TOWN OF SWAN RIVER
BY-LAW NO. 1/2015
WHEREAS:
A.
Section 98.1 of the Highway Traffic Act and the Reduced-Speed School Zones
Regulation No. 136/2013 authorize a council to pass by-laws establishing the reduced
maximum permitted speed for vehicles being driven on a highway within a school zone
within the geographic boundaries of a municipality; and
B.
The Town of Swan River deems it advisable and in the best interests of the Town of
Swan River to establish school zones with a reduced maximum speed for vehicles.
NOW THEREFORE the Council of the Town of Swan River enacts as a by-law the following:
1.
This By-law may be called the "Reduced-Speed School Zone By-law".
Interpretation
2.
For the purposes of this By-law, "highway", "reduced-speed school zone", "school", "school
property", "traffic control device", and "vehicle" have the same meanings as set out in the
Highway Traffic Act and the Reduced-Speed School Zones Regulation No. 136/2013.
Establishment of reduced-speed school zones
3.
The following portions of highways are designated as reduced-speed school zones with
reduced maximum permitted speed:
a.
Ecole Swan River South School, 1015 2nd Street South,
Highways included in the reduced-speed school zone:
i.
That portion of Second Street South beginning at the point where the
northern boundary of Ninth Avenue South meets Second Street South and
continuing in a southerly direction and ending at the point where the
western boundary of Third Street South meets Eleventh Avenue South;
ii.
That portion of Eleventh Avenue South beginning at the point where the
southern boundary of Third Street South meets Eleventh Avenue South and
continuing in a northerly direction and ending at the point where the eastern
boundary of Second Street South meets Eleventh Avenue South;
iii.
That portion of Second Street South beginning at the point where the
northern boundary of Eleventh Avenue South meets Second Street South
and continuing in an westerly direction and ending at the point where the
northern boundary of Ninth Avenue South meets Second Street South.
b.
Heyes School, 128 2nd Avenue West,
Highways included in the reduced-speed school zone:
i.
That portion of Main Street West beginning at the point where the northern
boundary of Second Avenue West meets Main Street West and continuing
in a southerly direction and ending at the point where the eastern
boundary of Second Street South West meets Second Avenue West;
c.
Taylor School, 908 2nd Street North,
Highways included in the reduced-speed school zone:
i.
That portion of Second Street North beginning at the point where the
northern boundary of Seventh Avenue North meets Second Street North
and continuing in an easterly direction and ending at the point where the
northern boundary of Ninth Avenue North meets Second Street North;
ii.
That portion of Seventh Avenue North beginning at the point where the
western boundary of Second Street North meets Seventh Avenue North
and continuing in a northerly direction and ending at the point where the
eastern boundary of Third Street North meets Seventh Avenue North;
iii.
That portion of Ninth Avenue North beginning at the point where the
eastern boundary of Second Street North meets Ninth Avenue North and
continuing in a northerly direction and ending at the point where the
northern boundary of Lot 57 SP 3205 meets Ninth Avenue North;
iv.
That portion of Ninth Avenue North beginning at the point where the
eastern boundary of Second Street North meets Ninth Avenue North and
continuing in a southerly direction and ending at the point where the
southern boundary of Lot 1 Plan 47944 meets Ninth Avenue North.
d.
Swan Valley Regional Secondary School, 1483 3rd Street North.
Highways included in the reduced-speed school zone:
i.
That portion of Third Street North beginning at the point where the
northern boundary of Thirteenth Avenue North meets Third Street North
and continuing in an easterly direction and ending at the point where the
northern boundary of P.T.H No. 10 meets Third Street North;
e.
Swan Valley Nursery School, 1421 3rd St. South
Highways included in the reduced-speed school zone:
i.
That portion of Third Street South beginning at the point where the west
boundary of Lot 6 Plan 2282 meets Third Street South, and continuing to
the in an westerly direction and ending at the point where the western
boundary of Lot 2 Plan 2372 meets Third Street South.
Maximum permitted speed within reduced-speed school zones
4.
The maximum permitted speed for vehicles being driven in a reduced-speed school zone
on a highway is 30km/hr.
Times when the reduced-speed school zones apply
5.
The reduced maximum permitted speeds established under section 4 apply at all times
within a reduced-speed school zone.
Traffic control devices
6.
The Town of Swan River shall identify a reduced-speed school zone with traffic control
devices that comply with the Reduced-Speed School Zones Regulation No. 136/2013.
Repeal
7.
By-Law No. 1/2014 is hereby repealed.
