## Permit ## Town of Swan River Bylaw 16/ 2025 ## Public Reserve Shoreline Vegetation Management Bylaw Being a Bylaw of the Town of Swan River to regulate development activities and the clearing of vegetation on public reserves along the river shorelines, in accordance with the Town of Swan River's Zoning Bylaw and Swan Valley Planning District's Development Plan Bylaw. ## PREAMBLE · WHEREAS subsection 232(1) of The Municipal Act, S.M. 1996, c. 58 (the "Act") provides, in relevant part, as follows: 232(1) A Council may pass bylaws for municipal purposes respecting the following matters: - (b) people, activities and things in, on or near a public place or a place open to the public, including parks, municipal roads, recreation centres, restaurants, facilities, retail stores, malls, and private clubs and facilities that are exempt from municipal taxation; NOW THEREFORE, the Council of the Town of Swan River (hereinafter the "Town") enacts as follows: - All development and clearing of vegetation on Public Reserves bordering the Swan River is prohibited. - Applicants may apply for a permit from the Chief Administrative Officer or designate to grant an exception to clause 1 permitting the work to be completed. - The application must specify where the work is to be completed and the nature of the work being done. - The Town reserves the right to deny the application, adjust the scope of work, or to approve the application. 5. The Town will consider these factors when evaluating an application: - a. The current Town of Swan River Zoning Bylaw and Swan Valley Planning District's current Development Plan Bylaw, - The aesthetic objectives of the neighbourhood, and - c. For riverbanks, both slope stability and erosion control. 6. An approved permit will contain this disclosure statement: This permit is issued in accordance with the Town of Swan River's Public Reserve Shoreline Vegetation Management Bylaw. The permit holder is authorized to undertake approved development or vegetation clearing activities on designated public reserve lands. It is the applicant's responsibility to ensure all other legislation is followed and to avoid disturbing riverbanks, waterways, or introducing sediment into aquatic environments. The Town assumes no responsibility for natural changes to the riverbank or waterline, and the permit holder proceeds at their own risk. ## Offence - A person who contravenes this bylaw is guilty of an offence. - Administrative penalties and appeals for the contraventions of this bylaw shall be administered as set out in the current Town of Swan River Enforcement Bylaw. - This by-law shall be enforced by a designated officer in the current Designated Officer Bylaw. 10. In addition to all other rights of collection which the Municipality may have at law, costs associated with the Town of Swan River remedying a contravention of this bylaw under the Municipal Act section 245 may be collected by the Municipality in the same manner as a tax may be collected or enforced under the Municipal Act. ## Transitional 11. Amend the 2025 Fee Schedule, Tab 1, under Municipal Planning, by adding a new fee for "Public Reserve Development Permit" and set the fee at $50.00. 12. Amend the 2025 Fee Schedule, Tab 13, add a new row for "Public Reserve Protection and Development Regulation Bylaw", list the offence as "Contravention of this Bylaw", and set the fine at $1,000.00. 13. Amend Enforcement Bylaw 2/2024 by adding to Schedule A "Public Reserve Protection and Development Regulation Bylaw" and list the offence as "Contravention of this Bylaw". 14. This bylaw shall come into effect and force on November 21, 2025.
