CITY OF WINKLER BY-LAW NO. 2223-18 BEING a By-law of the City of Winkler to establish a rate for the collection of solid waste, and recycling and compost services within the City of Winkler as a special service for 2019- 2023 inclusive. WHEREAS Section 312 of The Municipal Act of Manitoba, provides as follows: 312 If approved by by-law, a municipality may provide, as special service to all or a part of a municipality, one or more of the following: (e) the collection and transportation of waste and recyclable materials; AND WHEREAS Section 320(1) of the Act provides as follows: Subject to subsections (2) to (6) and subsection 321(4), a council may by by-law (a) approve the local improvement or special service as set out in the plan or proposal; and (b) authorize the municipality to impose taxes as set out in the plan or proposal. AND WHEREAS the Council of the City of Winkler, has entered into a contract with private contractors for the collection of solid waste, compost and recyclables from all residential property excluding vacant lots within the Local Improvement District of the City of Winkler. AND WHEREAS the Council of the City of Winkler, in the Province of Manitoba, has prepared a Special Services Plan No. 44 to establish a rate for the collection of solid waste, and compost and recycling services within the City of Winkler as a special service pursuant to Part 10 in the Act; NOW THEREFORE the Council of the City of Winkler, duly assembled, enacts as follows: 1. THAT pursuant to subsection 320(1) of the Municipal Act, the City of Winkler approves Special Service Plan No. 44 attached hereto as Schedule "A". 2. THAT the City of Winkler levy an annual special service tax upon all residential property excluding vacant lots within the Local Improvement District of the City of Winkler as hereby attached in Schedule "B". CITY OF WINKLER SCHEDULE "A" TO BY-LAW NO. 2223-18 SPECIAL SERVICE PLAN NO. 44 Establishing a rate for collection of Solid Waste, Compost and Recycling Services within the City of Winkler (Pursuant to Subsection 314 of the Municipal Act) (a) Description of the Proposed Special Service The City of Winkler provides solid waste collection, as well as compost and recycling services to residents within the City of Winkler. The City of Winkler contracts out these services to private contractors. This is not a new service but the City changes the method to charge for the service. Starting in 2019 the service will no longer be charged on the assessment but as a flat fee. The purpose of this Special Service Plan is to levy a fair tax to all residential properties. The plan will show the amounts to be levied to single and multi-family properties in the levy area. (b) Area to be levied The Special Service Area to be levied under this proposal will be all residential properties within the City of Winkler as described on Schedule "B" attached hereto. (c) Estimated Cost of the Special Service The City of Winkler has contracted Penner Waste for the collection of solid waste and compost as well as the processing of compost materials. Gateway Resources has been contracted for the collection and processing of all recycling materials in the City of Winkler. The estimated annual cost for providing this service is a total cost of $434,170 for 2019 to a maximum of $592,050 for 2023. The cost is based on a total number of 3,947 dwelling units. (d) Method and Rate to calculate Special Service Tax The special service tax will be levied annually, from 2019 to 2023, inclusive on a per parcel basis. The cost of the service will be as follows: All rates are based on an annual basis: Single Family Residences $110.00 in 2019 up to a maximum of $150.00 in 2023 Multi Family Residences (Duplexes and up) $110.00 in 2019 up to a maximum of $150.00 in 2023 These rates are based on weekly waste, compost and recycling pickup.
