## CITY OF WINKLER
## BY-LAW NO. 1974-09
Being a By-Law to provide for the installation of Sump Pits and Pumps in New Basement Construction and existing Sump Pit retrofits.
WHEREAS section 232 (1) of the Municipal Act (L.M. 1996, c. 58, chapter M225) provides in part, that a council may pass by-laws for municipal purposes respecting the following matters;
- (a) the safety, health, protection and well-being of people, and the safety and protection of property;
- (1) public utilities;
- (h) drains and drainage on private or public property;
- (0) the enforcement of by-laws
WHEREAS the Council of the City of Winkler deems it necessary and in the best interests of the public to require installation of sump pits and pumps in basements and/or crawl spaces constructed in the City of Winkler;
NOW THEREFORE the Council of the City of Winkler, in open meeting, duly assembled, enacts as follows:
- a) THAT where buildings are provided with subsurface drainage system, the system shall be constructed so that the drainage as directed to a sump pit equipped with the pump and discharged to the outside of the building in conformance with the Manitoba Plumbing Code and this by-law.
- b) THAT the system including drain tile, sump pits, pumps and other associated equipment, shall be designed and constructed in accordance with good design practice, such that the water level in the pit is normally maintained below the lowest level of the drain tile entering the pit and in the case of power failure the pit is large enough to contain water collected from the drain tile for a period of at least one (1) hour before overflowing to the domestic drain.
## Sump pumps shall:
- be automatically controlled and set to maintain the water level below the lowest drain tile entering the pit;
- c) be installed with their inlets located at least 25mm (1") above the bottom of the sump pit;
- be of the centrifugal impeller type
- d) be a submersible pump; and
- f) not be disconnected, removed and/or altered in such a manner that by-pass to the domestic drain becomes the primary method of discharge. Persons found in violation will be subject to the penalties set out in this By-law.
- be capable of discharging a minimum flow of 0.75L/S at 3.6M head.
## The sump pump motor shall:
- be designed for no less than 10 start/stop cycles per hour;
- be connected to an electrical circuit that supplies no other outlets or equipment, unless such circuit or equipment outage service to alert the homeowner of a power failure to the sump pump.
- c) Be equipped with a self-resetting thermal overload protection switch;
- e) have a rpm rating not exceeding 3500;
- d) have a rating of at least 0.19 kw;
- f) have a minimum service factor of 1:10;
- h) be CSA approved
- be rated for continuous duty; and
## Sump Pits shall:
- be provided with a cover adequate to support the occupancy floor load;
- a) have walls and bottoms constructed of concrete, polyethylene, polypropylene, fiber-glass or other suitable materials;
- c) for residential buildings with a basement area of 185m° (2000 sq. ft.) or less, have a minimum floor area of 0.16m2 (1.75 sq. fl.) and minimum depth of 0.8m (30 inches) for buildings with a basement are over 185m2 (2000 sq. ft.) have a minimum floor area of 0.46 m' (5.0 sq. ft.) and a minimum depth of 0.8m (30 inches).
- e) Provide a 1.5 inch (minimum) floor recess in the utility floor are for the sump pit, water heater and floor drain as shown on Schedule "A" attached to this By-law. This will allow for backup overflow in the event that a power failure occurs.
- For other buildings with basement areas exceeding 185m2 (2000 sq. ft.) it is incumbent upon the designer, contractor and/or owner to ensure that the pit is in compliance with subsection (b) of Section 1 of this By-law.
- f) With regard to a floor drain connected to a sanitary sewer, have a solid pipe extend from the floor drain trap to the finished floor level with no interconnection between the floor drain and the sump pit unless a backwater valve is installed to protect the floor drain from public sewer backup.
## The discharge pipe system from the sump pump shall:
- b) have a minimum internal diameter of 25mm (1");
2. be constructed of materials and installed in conformance with the Code;
- c) have a check valve installed near the connection of the pump to prevent backflow into the sump pit;
4. have a union joint installed near the pump to facilitate pump removal and inspection: and
- e) be graded or otherwise protected to prevent the freezing of water in the system.
- f) Be so located so as not to present a hazard.
## 6. Powers and Authority of Designated Officers:
- b) Where in the opinion of the Director of Works and/or the Development Officer, the landscaped are around the building is inadequate to dispose of subsurface properties, the type of system and point of discharge may be directed to the street, curb or ditch as may be acceptable to the Director of Works and/or Development Officer. Disposal of drainage discharge onto public streets, curbs and/or sidewalks during freezing temperatures is forbidden.
- a) Where in the opinion of the Director of Works and/or the Development Officer, the landscaped area around the building is adequate to dispose of subsurface drainage without causing a nuisance to adjoining properties, the discharge from the sump pump shall be directed to the outside of the building and discharged on a splash pad as specified by the Director of Works and/or Development Officer
- c) When requested in writing by the owner, special dispensation may be considered regarding Article 6(b), where in the opinion of the Director of Works and/or Development Officer, sump pump discharge should be temporarily discharged to the sanitary service during freezing temperatures.
- d) Duly authorized employees of the City bearing proper credentials and identification shall be permitted to enter upon all properties for the purposes of inspection, observation and testing in accordance with the provisions of this by-law.
## Penalties
- a) Any person found to be violating any provision of this ordinance shall be served by the City with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations.
- c) Any person violating any of the provisions of this by-law shall become liable to the City for any expense, loss, or damage occasioned by the City by reason of such violation.
3. Any person who shall continue any violation beyond the time limit provided for in Section Ta) shall be guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding (Two Hundred ($200.00 Dollars) for each violation. Each day in which any such violation shall continue shall be deemed and separate offense.
4. That upon final approval of this By-law, that Town of Winkler of By-law 1653-99 be repealed
