BEING A BY-LAW OF THE TOWN OF WINNIPEG BEACH PROVIDING FOR THE
REGULATION OF LOITERING AND PUBLIC NUISANCES.
by-law:
WHEREAS Section 232(1) of The Municipal Act states in part that a Council may in a A Council may pass by-laws for municipal purposes respecting the following matters: people, activities and things in, on or near a public places or a open to the public, including parks, municipal roads, recreation centres, restaurants, facilities, retail stores, malls, and private clubs and facilities that are exempt from municipal taxation.

AND WHEREAS it is desirable and in the best interests of the Town of Winnipeg Beach to establish regulations for deterring of loitering and public nuisances in the Town of Winnipeg Beach.
THEREFORE BE IT RESOLVED that the Council of the Town of Winnipeg Beach, in open meeting duly assembled enacts as follows:
1. "Loitering" means to linger idly.
THAT no person shall by any manner or conduct commit any public nuisance by collecting, loitering, or standing as idlers, on any of the streets or sidewalks of the Town of Winnipeg Beach, or on the steps of, or approach to, a house or other premises open to the public street, whereby the public are liable to be subjected to disturbance or annoyance.
THAT any person intervening the provisions set out in this by-law may be arrested without warrant by any peace officer having jurisdiction within the Town of Winnipeg Beach.
THAT any person who contravenes the provisions set out in this by-law shall, for
each offence, be liable upon summary conviction to a find of not less than $100.00 and not greater than $300.00 plus costs. Each contravention of this bylaw shall be deemed to be a separate offence.
