TRAFFIC BY-LAW
NO. 1573/77
A By-law of THE CITY OF WINNIPEG
concerning the Regulation of Traffic.
WHEREAS clause 139(i) of The City of Winnipeg Charter provides in part as follows:
General authority
139 Council may pass by-laws respecting streets and the parking of vehicles
in the city, including, without limiting the generality of the foregoing, by-laws
respecting
...
(i) traffic on streets;

The Council of the City of Winnipeg, in Council enacts as follows:
1.
This By-law may be referred to as the "City of Winnipeg Traffic By-law".

(1)
Unless otherwise expressly provided or unless the context otherwise requires, words
and expressions in this by-law have the same meaning as the same words and
expressions in The Highway Traffic Act of the Province of Manitoba and in Manitoba
Regulation 155/2018, being the Vehicle Weights and Dimensions on Classes of
Highways Regulation passed pursuant thereto.

In this By-law

"Chief of Police" means the Chief of Police of The City of Winnipeg or such person
as may be authorized by the said Chief of Police to exercise some or all of the
powers vested in him/her by this by-law.
"curb" means the lateral line of a roadway.
"Director" means the Director of Public Works or such other person as may be
authorized by the said Director to exercise some or all of the powers vested in
him/her by this by-law.

"disabled loading zone"

"driver" means a person who drives or is in actual physical control of a vehicle and
includes any body corporate in respect of vehicles driven by its officers, employees,
or agents in the course of their employment, and the expressions "drive" and
"driving" have a corresponding meaning.
"driver transfer point" means a point of transfer within the City such as a
trucking terminal and as so identified and authorized by the Director as may be
required from time to time, to enable a change of truck drivers for a trip originating
from outside the City and destined to a point within the City other than the point of
transfer.
"enhanced summer bike route" means a street, or portion of a street, that is set
out in Schedule 15 to this By-law;

"garage sale" means the display and sale of a collection of used goods from
residential premises.
"Holiday" or "Public Holiday" includes New Year's Day, Good Friday, Victoria
Day, Remembrance Day, the day set aside to celebrate the Queen's Birthday,
Canada Day, Civic Holiday, Labour Day, Thanksgiving Day, Christmas Day and
Boxing Day or any other day proclaimed as a holiday.
"large quadricycle" has the meaning ascribed to it in the Pilot Project (Large
Quadricycles) Regulation.

"Manual of Temporary Traffic Control" means the Manual of Temporary Traffic
Control in Work Areas on City Streets approved by the Council of the City of
Winnipeg from time to time and, unless otherwise specified, refers to the most
recently approved edition.

"parade"

"private approach" means that portion of a sidewalk and/or boulevard lawfully
improved or designed for the passage of vehicular traffic.
"Regional Street" means a street designated as such by Council on May 2, 1973
and as may be amended from time to time.

"Sunday/holiday bicycle route"

"taxi stand" means that portion of the roadway adjacent to the curb designated as
such by traffic control devices;

"truck" means a motor vehicle or semi-trailer truck, that is constructed or adapted
to carry goods, wares and merchandise, freight or commodities, but not passengers
or baggage, and that has more than four tires.
"truck tractor" means a motor vehicle designed and used primarily for towing
other vehicles, and not so constructed as to carry a load other than the driver
thereof and part of the weight of any vehicle so towed including the load thereon,
and that has more than four tires.

PROOF OF SCHEDULES
3.
The schedules to this by-law are part of the by-law and shall be identified by the signature
of the City Clerk of the City of Winnipeg.
CAUSING OR PERMITTING OFFENCE
4.
Any person who causes or permits an offence against this by-law is guilty of an offence.
SOLICITING RIDES PROHIBITED FROM ROADWAY
5.
No person shall occupy a roadway for the purpose of soliciting a ride from the driver of a
vehicle.
COASTERS, SKATEBOARDS, ETC., PROHIBITED ON ROADWAYS
6.
No person shall ride upon or use any coaster, skateboard, sleigh, skis, skates, toy vehicles,
or similar devices on a roadway.
IN-LINE SKATING
6.1
Notwithstanding the provisions of Section 6 hereof, the use of roller blades commonly
referred to as in-line skates is permitted:

(a)
On roadways designated by resolution of the Standing Policy Committee on
Public Works as Bicycle Routes during the period when vehicular traffic is
restricted to local access on said roadways; and,

(b)
On roadways in City of Winnipeg parks, except where such use is expressly
prohibited by traffic control device.

PROHIBITION OF SKATEBOARDS ON DESIGNATED SIDEWALKS
6.2
No person shall ride upon or use a skateboard on a sidewalk where there is placed a traffic
control device prohibiting such use of the sidewalk.

6.3(1) Subject to the conditions set out under subsections 6.3(2) and (3), large quadricycles are
permitted to ride upon or use roadways located within the geographical area set out in
Schedule 17 to this By-law.

6.3(2) Large quadricycles shall not cross multi-lane regional streets, except at intersections that
are controlled by traffic signals or that have an all-way stop condition.

6.3(3) Operators of large quadricycles must inform the Director of any planned route of operation
outside of the geographical areas set out in Schedule 17 to this By-law, and may not permit
large quadricycles to ride upon or use any roadways unless the Director has approved that
planned route of operation.

6.3(4) Operators of large quadricycles must submit an annual report to the Director documenting
the number of trips taken by the large quadricycle, the total number of hours the large
quadricycle spent in operation, and any safety-related incidents associated with the
operation of the large quadricycle.

ARREST OF A PEDESTRIAN
7.
Where a peace officer has reasonable grounds for believing that a pedestrian has committed
or is committing a breach of those provisions of a by-law that relate to pedestrian traffic, he may
require the pedestrian to stop and there and then to state correctly his name and address, and to
prove his identity to the satisfaction of the peace officer.
8.
If a pedestrian refuses or fails to stop and state correctly his name and address or so to
prove his identity when so required, the peace officer may arrest him without warrant.

PARADES
PARADE PERMITS PROVIDE EXEMPTIONS FROM TRAFFIC RULES AND PROTECTION FROM
DISRUPTIONS
9(1)
Where the Chief of Police has issued a parade permit under section 11, any use of the street
other than that contemplated by the parade permit is restricted or prohibited, as the case may be,
pursuant to subsection 86(1) of The Highway Traffic Act.

9(2)
Without restricting the general nature of subsection (1), except as authorized by or
permitted by a peace officer escorting an event for which a parade permit has been issued, no
person other than a participant of the event may walk, cycle, drive or otherwise move through an
event for which a parade permit has been issued. However, this prohibition does not apply to the
drivers of the following vehicles operating in an emergency:
(a)
an ambulance;
(b)
a fire department vehicle; or
(c)
a police vehicle.

9(3)
Participants in an event for which a parade permit has been issued under this By-law or for
which a use of street permit has been issued under the Streets By-law who are in compliance with
the conditions of the parade permit or use of street permit, and who comply with the directions of a
peace officer with respect to the conduct of that event are not required to comply with the
following:
(a)
the requirements of The Highway Traffic Act with respect to travelling in a roadway
including complying with traffic control devices;
(b)
the prohibitions in the Streets By-law or other by-laws concerning the obstruction of
pedestrian or vehicular traffic in a street;
(c)
the prohibitions or restrictions in this or other by-laws concerning the riding of
horses or horse-drawn vehicles in a street.

ELIGIBILITY FOR PARADE PERMIT
10(1) An event is eligible to be considered for a parade permit if both of the following apply:
(a)
it involves the cohesive movement of a group of people - whether on foot or being
conveyed - from one point to another on one or more streets; and
(b)
it will not occupy any particular area of the street for an extended period of time.

10(2) An event is ineligible for a parade permit but may be eligible for a use of street permit under
the Streets By-law if any of the following are applicable:

(a)
it involves a group of people which will remain largely stationary during the event;
(b)
as a result of the event, pedestrian or vehicular traffic on the street will be
significantly affected for a significant period of time;
(c)
as a result of the event, the street will not be available for any pedestrian or
vehicular traffic for a period of time.

ISSUING PARADE PERMITS
11(1) In order to appropriately consider whether or not to grant parade permits, the Chief of
Police may establish reasonable requirements for applications for parade permits, which may
include:
(a)
a minimum amount of time prior to a proposed event by which an application must
be made;
(b)
specific information that must be provided on a parade permit application;
(c)
the completion of an application form.

11(2) The Chief of Police must issue a parade permit to an applicant if all of the following
requirements are met:
(a)
the event for which a parade permit is sought is eligible for a parade permit under
section 10;
(b)
the applicant has complied with the requirements established by the Chief of Police
under subsection 11(1);
(c)
the applicant has paid any applicable fees and charges;
(d)
the Chief determines that adequate insurance will be in place to protect the City as
well as participants and others who may suffer harm or damage as a result of the
event for which a parade permit is sought.
(e)
adequate security and traffic control for the event will be provided by the Royal
Canadian Mounted Police or the Canadian Forces Military Police or can reasonably
be provided by the Winnipeg Police Service;
(f)
the time, date and route of the proposed event
(i)
is unlikely to unduly disrupt traffic along the proposed parade route;
(ii)
is unlikely to result in conflicts with other events or parades taking place; and

(iii)
does not pose undue security or public safety concerns;
(g)
due to the nature of the event, the numbers of people or vehicles involved or for
some other reason, it will be difficult or impossible for those involved in the event to
remain a cohesive group while complying with The Highway Traffic Act, the Streets
By-law and this By-law.

11(3) Where the event meets all of the criteria set out in subsection (2) except those set out in
clauses (e) or (f), the Chief of Police must propose a reasonable alternative time, date or route that
would result in these criteria being met.

11(4) Where the event meets all of the criteria set out in subsection (2) except that set out in
clause (e), the Chief of Police must authorize the parade permit if the applicant agrees to make use
of Winnipeg Police Service members through the WPS Special Duty Program and pays the
applicable fees and charges for the event through that program.

11(4) Where the event meets all of the criteria set out in subsection (2) except that set out in
clause (2)(g), the Chief is authorized but not required to issue a parade permit with respect to the
event.

11(5) No fee is applicable for a parade permit authorizing a parade or other event involving
members of Her Majesty's Armed Forces, whether on foot or in vehicles.

CONDITIONS ON PARADE PERMITS
12(1) It is a condition of every parade permit that
(a)
members of the Winnipeg Police Service, the Royal Canadian Mounted Police or the
Canadian Forces Military Police must escort the event; and
(b)
all participants must comply with the directions of the escorting peace officers.

12(2) The Chief of Police may impose additional conditions on a parade permit that are designed
to ensure the following
(a)
disruption to traffic along the proposed parade route is minimized;
(b)
the event for which the parade permit is issued does not result in conflicts with
other events or parades taking place;
(c)
security or public safety concerns are minimized; and

(d)
adequate insurance will be in place in accordance with clause 11(2)(d).

12(3) Without restricting the generality of subsection (2), the conditions imposed by the Chief of
Police may include any or all of the following:
(a)
a requirement to follow a specific route;
(b)
a requirement that the event take place on a specific date and time;
(c)
a requirement that the event use only a specified lane or roadway;
(d)
restrictions or prohibitions on the activities that may take place during the event.

12(4) If the conditions imposed on a parade permit are not met, the parade permit is invalid.

12(5) The Chief of Police or any member of the Winnipeg Police Service whom the Chief has
authorized to exercise this authority may revoke the parade permit prior to or during the parade if
he or she concludes that the parade will
(a)
unduly disrupt traffic along the parade route;
(b)
result in conflicts with other events or parades taking place; or
(c)
pose undue security or public safety concerns.

12(6) If a parade permit is invalid or revoked, the exemptions provided in subsection 9(1) are not
applicable and participants in the event must comply with all applicable provisions of The Highway
Traffic Act, the Streets By-law and this By-law.

13.
While a parade is in motion, pedestrians shall not walk through a parade.
INSTALLATION AND MAINTENANCE OF TRAFFIC CONTROL DEVICES
14.
The Director shall place and maintain or cause to be placed and maintained all traffic control
devices authorized by Council.

TEMPORARY TRAFFIC CONTROL DEVICES
15.
The Director shall place and maintain or cause to be placed and maintained temporary
traffic control devices to prohibit or regulate traffic in an emergency or for the purposes of carrying
out any authorized work on the street including street cleaning and snow removal operations or as
authorized by the Chief of Police to insure orderly movement of traffic, to prevent injury or damage
to persons or property, or to permit action in any emergency.

(1)

Any person undertaking authorized work of any form within a street or in any way
interfering with or obstructing the normal use of a street shall place and maintain
temporary traffic control devices as prescribed in the Manual of Temporary Traffic
Control, or as directed by the Director.

SPRING WEIGHT RESTRICTIONS
17.
(1)
The Director may restrict the maximum weight of vehicles operated on those
streets that do not have concrete pavement to the extent and for such period of
time as is reasonably required to protect the streets from damage and deterioration
during spring thaw conditions.
(2)
Where the Director restricts the maximum weight of vehicles on streets pursuant to
subsection (1), the Director must cause to be placed such traffic control devices as
are necessary to reasonably inform the public of the restrictions and, at least one
week prior to the weight restriction coming into effect, must publish in a newspaper
having a general circulation in the city a notice setting out
(a)
a description or list of the streets affected by the weight restriction;
(b)
the maximum weight permitted on the streets identified; and
(c)
the period of time during which the weight restrictions are in effect.
(3)
No person may operate a vehicle on a street in contravention of a restriction made
by the Director pursuant to subsection (1) Director shall place and maintain or cause
to be placed and maintained traffic control devices to limit the weights of vehicles
operated upon streets that do not have concrete pavements. The weight limitation
referred to herein shall be imposed during the period March 23 to May 31, both
inclusive, of each year, unless the Director declares otherwise.

ENHANCED SUMMER BIKE ROUTES

(1)
In this section
(a)
"block" subject to section 17.1(2), means a section of a street extending
from one intersection to the next; and
(b)
"intersection" means an intersection between two roadways that are not
back lanes.

In this section, the section of street between Birchdale Avenue and Highfield Street
constitutes one block.

Subject to subsection (4), no person may operate a motor vehicle on an enhanced
summer bike route between 7:00 a.m. and 9:00 p.m. on the following days:

any Saturday or Sunday from May 1 to Thanksgiving Day, inclusive;
(b)
Victoria Day, Labour Day, the National Day for Truth and Reconciliation, or
Thanksgiving Day;

vehicles authorized to use Sunday/holiday bicycle route pursuant to a valid
Use of Streets Permit or Parade Permit issued by the City of Winnipeg.

A person who contravenes this section is guilty of an offence and upon summary
conviction is subject to a fine of $90.22 plus court costs and surcharges imposed by
law.

18.
No person shall drive a vehicle on any street or portion of street that is barricaded or
otherwise indicated as being closed to vehicular traffic.
19.
Unless otherwise directed by a peace officer, pedestrians and drivers shall obey the
direction, instruction, limitation, restriction, or prohibition of any applicable traffic sign, traffic
control signal, marking, barrier, or device placed or maintained by the Director for the purpose of
regulating or prohibiting traffic, for highway construction, repair, maintenance, painting or any
emergency.

FUNERAL PROCESSIONS
36.
The driver of every vehicle in a funeral procession indicated as such by the headlamps of all
motor vehicles therein being lighted upon approaching a traffic control signal showing a red traffic
control light, or a stop sign, shall cause the vehicle to slow down or stop as may be necessary for
safety, but may then proceed cautiously past the traffic control signal or stop sign, the driver of
each of the other vehicles in the procession shall have the right-of-way over all other vehicles upon
the highway at the intersection or place where the signal or stop sign is situated.

Where a traffic sign bearing the words "Entrance Only" or "Exit Only" or words to the same
effect or restricting or regulating the mode of entrance to or exit from a private approach is erected
at or near an approach, the driver of every vehicle shall obey the direction on any such traffic sign.

VEHICLES TO KEEP TO THE RIGHT
37.1
On a street which consists of more than one roadway separated by one or more dividing
strips or boulevards, the driver of a vehicle shall keep to the right of the main or median dividing
strip or boulevard.

LANE DIRECTION CONTROL SIGNALS
38.
(1)
Where a Lane Direction Control Signal showing a red "X" is located over a traffic
lane, a driver of a vehicle facing the signal shall not drive or continue to drive in the
traffic lane over which the Lane Direction Control Signal is located.
(2)
Where a Lane Direction Control Signal showing a downward pointing green arrow is
located over a traffic lane, the driver of a vehicle facing the signal may drive or
continue to drive in the traffic lane over which the Lane Direction Control Signal is
located.
ROUTE OF TRUCK TRAVEL
39.
All trucks, truck tractors or combinations of either one of them with a trailer or trailers
within The City of Winnipeg shall be operated only over and along the streets or sections of streets
set forth as Truck Routes in Schedules 1 and 2 hereto, but any truck or truck tractor or combination
of either one of them with a trailer or trailers may operate upon any street where necessary to the
conduct of business at a destination point, provided that Truck Routes are used until reaching the
intersection nearest the destination point. Upon leaving the destination point, a truck or truck
tractor or combination of either one of them with a trailer or trailers shall return by the shortest
routing to a Truck Route.

39.1
Notwithstanding Section 39, to minimize truck travel on non-truck routes when a truck or
truck tractor or combination of either one of them with a trailer or trailers has multiple deliveries in
an area bounded by Truck Routes, it may proceed to conduct such business without returning to
the nearest Truck Route and only after the completion of all business return by the shortest routing
to a Truck Route.

39.2(1) Despite any other provision of this By-law but subject to this section, Council may, by
resolution, approve a temporary exemption to the requirement that a truck or truck tractor or
combination of either one of them with a trailer or trailers use the shortest routing from a
destination point to a Truck Route under section 39.

39.2(2) In order for a temporary exemption approved under subsection (1) to be valid, the
resolution approving it must:

(a)
identify the alternate route that is to be used between a destination point and a
Truck Route;
(b)
identify the trucks or truck tractors or a combination of either of them with a
trailer or trailers who are authorized to use the alternate route identified in (a);
and
(c)
specify the time period during which the exemption shall apply.
39.2(3) Notwithstanding clause 39.2(2)(c), at any point following the date after which a
temporary exemption is approved by Council under subsection (1) and before the date on which
the exemption expires, Council may approve an extension of the temporary exemption, which
extension must not be longer than one year.

All streets and sections of streets set forth as Truck Routes in Schedule 1 hereto shall be
further identified as Truck Routes by appropriate Truck Route signs except where Sections 42 and
43 apply, and shall remain open as Truck Routes, Monday to Sunday, both days inclusive, at all
times.

All streets and sections of streets set forth as Truck Routes in Schedule 2 hereto shall be
further identified as Truck Routes by appropriate Truck Route signs and shall remain open as Truck
Routes, Monday to Saturday, both days inclusive, between the hours of 7:00 a.m. and 7:00 p.m.
42.
Where "Route" Signs are installed and maintained on a street or section of street, the street
or section of street shall be deemed to be a Truck Route within the terms of this by-law.

Where Provincial Trunk Highway signs or Provincial Road signs of The Province of Manitoba
are installed and maintained on a street or section of street, the street or section of street shall be
deemed to be a Truck Route within the terms of this by-law.
44.
The Director shall keep and maintain a current map setting out the streets and sections of
streets set forth as Truck Routes in Schedules 1 and 2 hereto, and shall make available to the
public, copies of the map at no charge.
VEHICLE WEIGHT AND LENGTH LIMITS
45.
No person may drive or move, or permit to be driven or moved, on any street within the
City of Winnipeg, a vehicle which contravenes the requirements set out in Part 8 of The Vehicle
Weights and Dimensions on Classes of Highways Regulation, Manitoba Regulation 155/2018 with
respect to a highway classed as an RTAC route.

48.

for those waterway crossings and overpasses listed in Schedule 7 hereto.

SPECIAL PERMITS FOR OVERSIZED OR OVERWEIGHT VEHICLES
48.1
(1)
Notwithstanding sections 45, 47 and 48, the Director may issue a special permit
permitting the operation of an oversized or overweight vehicle on streets within the
City of Winnipeg where the Director is satisfied that the operation of the vehicle will
not

damage the streets over which it passes;
(b)
disrupt traffic or pose a threat to vehicular traffic or pedestrians;
(c)
damage properties adjacent to the right of way.
(2)
A special permit issued under subsection (1) may be issued subject to conditions
and limitations imposed by the Director to eliminate or minimize
(a)
damage to the streets over which the vehicle will pass;
(b)
disruption of traffic or the threat to vehicular traffic or pedestrians;
(c)
damage to properties adjacent to the right of way.

AGE OF DRIVER OF A HORSE DRAWN VEHICLE
49.
No person under the age of 16 years shall ride a horse or drive a horse drawn vehicle upon
any street or portion of street.

50.
Between the hours 7:00 - 9:00 a.m. and 15:30 - 17:30 p.m. on any day excepting
Saturdays, Sundays and Public Holidays, the riding of horses and the driving of horse drawn

51.
The riding of horses on streets during the hours of darkness is prohibited except on streets

52.
A reference to time shall be deemed to be a reference to Daylight Saving Time when such is

ENFORCEMENT OFFICIALS
52.1
The Director, and any employee of the City of Winnipeg or other individual appointed as a
special constable under section 176 of The City of Winnipeg Charter whose special constable
appointment authorizes him or her to enforce this By-law, is an enforcement official, and has the
powers of a peace officer within the limits of his or her appointment, for the purposes of enforcing
this By-law.

PENALTY
53.
(1)
Subject to the remainder of this section, a person who contravenes a provision of
this by-law is subject, upon conviction, to a fine of the following amount plus
mandatory court costs and surcharges as provided for by The Provincial Offences
Act:

in the case of an individual, a fine of not more than $1000., or
imprisonment for a term of not more than six months, or both; and
(b)
in the case of a corporation, to a fine of not more than $5,000.

(1.1)
Subject to the Municipal By-law Enforcement Act Enabling By-law, a person who
contravenes a provision of this By-law that is referred to in Schedule A of the
Municipal By-law Enforcement Act Enabling By-law must pay the administrative
penalty for that contravention set out in that Schedule. If an Early Payment
Discount amount is set out for a provision in that Schedule, a person who is issued
a penalty notice for a contravention of that provision may, within 14 days after the
penalty notice has been issued, voluntarily pay to The City of Winnipeg the
applicable Early Payment Discount amount and will thereafter not be prosecuted for
contravention.

Every person found guilty of a breach of any provision of Sections 17, 45, 46, 47 or
48 of this by-law shall be liable
(A)
to a fine of not less or more than $10.00 for each fifty kilogram, or
fraction thereof, by which the actual gross weight of the vehicle or
axle assembly exceeds the maximum gross weight prescribed in the
appropriate schedule thereto, in addition to costs.
(B)
where the fine computed under Clause (A)
(a)
is, on a first offence, less than $100.00 to a fine of not less
than $100.00 in addition to costs, and
(b)
is, on a second offence, less than $200.00, to a fine of not
less than $200.00 in addition to costs, and
(c)
is, on a third or subsequent offence, less than $500.00, to a
fine of not less than $500.00 in addition to costs.

LIABILITY OF OWNERS TO CONVICTION
53.1
Where an offence, consisting of a violation of any provision of this by-law
(a)
is committed by means of, or with respect to any vehicle; or
(b)
occurs by reason of, or with respect to, the ownership, use, or operation of
any vehicle;

the owner of the vehicle may be charged with commission of the offence and, if the judge
or justice before whom the charge is tried, is satisfied that the offence was committed, the
owner is guilty of the offence and is liable, on summary conviction, to the penalty herein
provided for that offence unless the owner satisfies the judge or justice that, at the time of
the violation, the vehicle was in the possession of a person other than the owner or the
driver without the consent of the owner.

Where an address for sending a notice, order, decision or other document is required, one
of the following shall be used:
(a)
if the person to be served is the owner of real property, the address
maintained by the tax collector for the purpose of issuing the tax notice for
that property; and
(b)
if the person to be served is the occupant of real property, the street
address for that property; and
(c)
if the document to be served relates to a permit, licence or other document
for which the person to be served has applied, the address provided by the

56.
(1)
All by-laws and by-law amendments, passed prior hereto by any area municipality
as defined in clause (1) of Section 1 of The City of Winnipeg Act and still in force,
relating to the regulation of traffic shall hereinafter cease to have effect, save as
provided in (c) of Subsection 2 hereof.
(2)

WEIGHT RESTRICTIONS OR ALLOWANCES ON SPECIFIC STREETS, WATERWAY CROSSINGS
AND OVERPASSES, PURSUANT TO SECTION 47 OF THE TRAFFIC BY-LAW
1.
No person shall operate a truck or track tractor, or any vehicle in excess of 9,100 kilograms
gross vehicle weight, along or over Arlington Street between Logan Avenue and Dufferin
Avenue (The Arlington Street Bridge).
2.
No person shall operate a truck or truck tractor with more than six tires along Jubilee
Avenue, unless that truck or truck tractor is:

conducting business on Jubilee Avenue;

MOBILE VENDOR'S PARKING PERMITS
Eligibility
1.
The Chief Operating Officer of the Winnipeg Parking Authority may issue a Mobile
Vendor's Parking Permit with respect to a vehicle if the applicable application or permit fees
have been paid; and either
(a)
the vehicle for which a permit is sought is a motor vehicle or a trailer that is
designed so that food or other goods or services can be served or provided from
within the vehicle to customers who are located either within or outside the
vehicle; or
(b)
the motor vehicle for which a permit is sought is used to tow or otherwise
transport a mobile vendor for which a use of street permit has been issued under
the Streets By-law.
Application process
2.
The Chief Operating Officer of the Winnipeg Parking Authority may require an
application for a Mobile Vendor's Parking Permit to be made in or on a particular form and may
require applicants to provide information and supporting material that is reasonable to process,
assess and issue the Permit.
Conditions of Permit
4.
The Chief Operating Officer may impose conditions on a Mobile Vendor's Parking Permit,
including those that limit a permit's application to particular locations, streets or areas of the
City.
Refusal to issue and revocation of Permit
5.
The Chief Operating Officer of the Winnipeg Parking Authority may refuse to issue a
Mobile Vendor's Parking Permit if a fine or administrative penalty for a contravention of a
parking provision in any City by-law, whether by the applicant or in respect of the vehicle for
which a Permit is sought, is outstanding.

6(1)
The Chief Operating Officer of the Winnipeg Parking Authority may revoke a Mobile
Vendor's Parking Permit if
(a)
a fine or administrative penalty for a contravention of a parking provision in any
City by-law in respect of the vehicle for which a Permit is sought is still owing on
the date the City is entitled to take collection proceedings in respect of it;
(b)
the vehicle for which the Permit was issued is or has been repeatedly stopped or
parked on a street in a manner that breaches the by-law or a condition of the
Permit.
6(2)
Before revoking a Mobile Vendor's Parking Permit, the Chief Operating Officer of the
Winnipeg Parking Authority must give or send the permit holder a notice stating
(a)
his or her intention to revoke the permit and why;
(b)
that the permit holder may respond to the notice by
(i)
in the case of a revocation due to unpaid fines or administrative
penalties, paying the outstanding fines or administrative penalties or
entering into a payment arrangement satisfactory to the Chief Operating
Officer within 15 days of the date the notice is given or sent; or
(ii)
providing reasons why the permit should not be revoked; and
(c)
that the permit will be revoked if the permit holder fails to respond within seven
days of the date the notice is given or sent, or such longer period of time as set
out in the notice.
6(3)
The Chief Operating Officer may revoke the Mobile Vendor's Parking Permit by giving or
sending a notice to the permit holder.
6(4)
When a permit holder has had a Mobile Vendor's Parking Permit revoked, he or she is
not eligible for another Permit for a period of one year.
6(5)
A notice under this Schedule may be given by personal service or may be sent by
delivery or registered mail to an address provided for this purpose by the permit holder, and is
deemed to have been sent on the date that it is delivered to the address.
