CONTROLLING OF COMPANION ANIMALS IN
THE CITY OF BATHURST

(1)
"Animal Control Officer" means the person or
persons appointed by the City Council to administer and
enforce the by-law and includes a police officer, any
employee, agent and company authorized by the City to
enforce this by-law. (agent de contrôle des animaux)

enforcement purposes)
(d) that is kept for the purpose of security or
protection, whether residential, commercial or
industrial, of persons or property
(e) that has shown the disposition or tendency to
be threatening or aggressive.

(a) "Dog Running At Large" means a dog that is
not on the property of the owner and not on a leash
and/or not under the control of a person
responsible. (errant)

device of adequate strength over the mouth of an animal to

"Owner" means any person, partnership,
association or corporation that owns, possesses or has

If any part of this by-law is held to be invalid and struck
down, it does not invalidate the remaining provisions of the
by-law.

PROVISIONS OF NEEDS

Every person who keeps an animal within the
municipality shall provide the animal or cause it to be
provided with:

(a) Clean, fresh drinking water and suitable food
of sufficient quantity and quality to allow for
normal, healthy growth and the maintenance of
normal, healthy body weight;

(b) Food and water receptacles kept clean and
disinfected, and located so as to avoid

(c) The opportunity for periodic exercise sufficient
to maintain good health, including the

(d) Necessary veterinary medical care when the
animal exhibits signs of pain, illness or

Every person who keeps an animal which normally
resides outside, or which is kept outside unsupervised for
extended periods of time, shall ensure the animal is
provided with an enclosure that meets the following
criteria:

(a) A total area that is at least twice the length of
the animal in all directions;

appropriate to the animal's weight and type of
coat. Such shelter must provide sufficient
space to allow the animal the ability to turn

and sanitized and excreta removed and
properly disposed of daily.

No person may cause an animal to be hitched, tied
or fastened to a fixed object where a choke collar or choke
chain forms part of the securing apparatus, or where a rope
or cord is tied directly around an animal's neck.

No person may cause an animal to be hitched, tied

confinement for an extended period of time.

No person may cause an animal to be confined in
an enclosed space, including a car, without adequate

(6)
No person may transport an animal in a vehicle
outside the passenger compartment unless it is adequately
confined or unless it is secured in a body harness or other
humane manner of fastening which is adequate to prevent it
from falling off the vehicle or otherwise injuring itself.

(1)
Every owner of a dog or a cat not
designated as an "indoor cat" over the age of four (4)
months, shall have such dog or cat vaccinated against
rabies. This vaccination is required on an annual basis
unless satisfactory documentation is received from the
attending veterinarian.

quatre (4) mois ou d'un chat âgé de plus de quatre (4)
mois qui n'est pas qualifié de « chat d'intérieur » est tenu
de faire vacciner son chat ou son chien contre la rage.

documentation pertinente émise par le vétérinaire traitant

Every owner of a dog over the age of four (4)
months, shall have such dog vaccinated against distemper
and canine parvovirus. This vaccination is required on an
annual basis unless satisfactory documentation is received
from the attending veterinarian.

An owner who neglects or refuses to have his or
her dog and/or cat which has not been designated as an
"indoor cat" vaccinated against rabies, unless satisfactory
documentation is received from the attending veterinarian
and his or her dog vaccinated against distemper and canine
parvovirus on an annual basis is in violation of the
provisions of this by-law unless satisfactory
documentation is received from the attending
veterinarian.

vacciner annuellement son chien ou son chat qui n'est pas
qualifié de « chat d'intérieur » contre la rage et contre la

The Animal Control Officer shall seize and
impound any dog and/or cat which is known to be or
suspected to be, or there are reasonable and probable
grounds to believe to be rabid, and shall cause such dog
and/or cat to be quarantined or destroyed. All costs
associated therewith shall be the responsibility of the
owner.

en fourrière tout chat ou chien qui a contracté ou qui est
soupçonné d'avoir contracté ou pour lequel on a des motifs
raisonnables et probables de croire qu'il aurait contracté la

Where an animal is suffering from any
communicable disease, the owner shall not permit the
animal to be in any public place and shall not keep the
animal in control with, or in proximity of, any other animal.

d'une maladie contagieuse de permettre à son animal de se
trouver dans un endroit public ou de le garder à proximité
d'un autre animal.
(6)
A person who owns an animal that is rabid,
suspected to be rabid, or has been exposed to rabies, shall
immediately report the matter to the District Medical
Health Officer and the Animal Control Officer or the
Rabies Hotline.

l'on soupçonne être atteint de la rage ou qui a été exposé au

UNSANITARY CONDITIONS PROHIBITED

No person shall keep an animal in unsanitary conditions
within the municipality. Conditions shall be considered
unsanitary where the keeping of the animal results in an
accumulation of fecal matter, an odor, insect infestation or
rodent attractants which endanger the health of the animal
or any person, or which disturb or are likely to disturb the
enjoyment, comfort or convenience of any person in or
about any dwelling, office, hospital or commercial
establishment.
À l'intérieur des limites de la municipalité, personne ne doit
garder un animal dans des conditions insalubres. Les
conditions seront jugées insalubres lorsque la garde de
l'animal cause l'accumulation de matières fécales, d'odeurs

If a dog or cat defecates on any public or private
property other than the property of its owner, the owner
shall cause such feces to be removed immediately or shall
be guilty of an offence under this by-law.

tenu d'enlever immédiatement les matières fécales, à défaut
de quoi il ou elle sera reconnu(e) coupable d'une infraction

other reason have his or her animal bark or howl
excessively or in any other manner disturb the quiet of any
person.

LICENSING

PERMIS
(1)
Every owner of a dog and/or cat shall, before the
31st day of March in each year, register with the Animal
Control Officer, or City of Bathurst, each dog and/or cat he
or she owns, and pay the registration fee as per Schedule A.

Tout propriétaire d'un chien et/ou d'un chat doit,
avant le 31 mars de chaque année, enregistrer chaque
animal au bureau de l'agent de contrôle des animaux et
acquitter les frais attenants prévus dans l'Annexe A.
(2)
A person who becomes an owner of a dog or cat
after the 31st. day of March in each year, shall register such
dog or cat immediately and pay the registration fees
required in Schedule A.

Quiconque devient propriétaire d'un chien ou d'un
chat après le 31 mars de chaque année devra faire
enregistrer immédiatement l'animal et acquitter les frais
attenants prévus dans l'Annexe A.
(3)
Any persons not obtaining their registration tag by
the dates required, shall pay a penalty of $10.00 to be added
to the regular registration fees.

Quiconque ne fait pas immatriculer ses animaux
avant la date prescrite sera passible d'une amende de 10$,
laquelle sera ajoutée aux droits d'enregistrement.
(4)
The Animal Control Officer or City of Bathurst, at
the time of registration of a dog or cat, shall issue to the
owner a registration tag showing the number under which
the dog or cat is registered and the year of registration,
along with the name of the City of Bathurst.

Au moment de l'enregistrement d'un chien ou d'un
chat, l'agent de contrôle des animaux de la Ville de
Bathurst émettra au propriétaire une plaque
d'immatriculation sur laquelle sont inscrits le numéro
d'enregistrement du chien ou du chat, l'année

Ville de Bathurst.

Proof of all required vaccinations or satisfactory
documentation from the attending veterinarian shall be
shown at time of licensing. Copies of such documentation
shall be kept by the municipality and Animal Control
Officer.

fournir la preuve que l'animal a eu les vaccinations
réglementaires, ou être en possession de la documentation

The owner of any dog and/or cat aged four months
or more shall obtain a license for the animal by registering
the dog and/or cat with the municipality and paying a fee as
determined by the municipality (See Schedule A for the fee
schedule).

mois ou plus doit se procurer les plaques d'immatriculation
de l'animal (chien ou chat) en enregistrant celui-ci au

The owner shall renew the license annually with
the Animal Control Officer or the municipality.

When the dog and/or cat is off the property of the
owner, the owner shall cause the animal to wear around the
neck a collar to which shall be attached the current license
tag issued for that dog and/or cat by the Animal Control
Officer and/or the municipality.

The license fee for a dog and/or cat owned by a
citizen over 65 years of age shall be reduced by 20%.

Owners of cats registered to a legitimate farming
operation are exempt from paying the license fee.

A dog used as a guide or for assistance to a
disabled person shall be licensed and shall wear the current
license tag. Any person who produces evidence
satisfactory to the Animal Control Officer and the
municipality showing that the dog is required as a guide or
for assistance by a disabled person shall be exempt from
paying the license fee.

personne handicapée doit être enregistré et doit porter une

(12)
The Animal Control Officer and the municipality
shall keep a record of all dogs and cats registered and
licensed, showing the date and number of registration and
license, and the name and description of the dog or cat,
with the name and address of the owner.

A license tag, which is lost after it has been issued,
shall be replaced for a fee of two dollars ($2.00).

The Animal Control Officer may seize and
impound:

(a) every dog running at large or every cat running
at large

(b) every dog or cat not wearing a collar and tag
while off the premises of the owner and not
accompanied by a person responsible.

(2)
The Animal Control Officer shall make all
reasonable efforts to identify and contact the owner of
every stray animal received, whether the animal is living or
dead.

L'agent de contrôle des animaux fera tout en son
pouvoir pour identifier et contacter le propriétaire de tout
animal errant reçu, que l'animal soit vivant ou mort.
(3)
Every dog or cat impounded shall be provided with
clean food and water and sheltered in sanitary conditions.
The animal shall remain impounded for five days, unless
the animal is claimed by its rightful owner. If not claimed
within that time, the animal shall become the property of
the Animal Shelter (Bathurst) Inc.

Tout chien ou chat mis en fourrière recevra de la
nourriture et de l'eau propre et sera logé dans un endroit
salubre. L'animal demeurera en fourrière pendant cinq
jours, à moins que son propriétaire ne vienne le réclamer.

Where in the opinion of the Animal Control
Officer, a dog or cat seized and impounded is injured or ill
and should be destroyed without delay for humane reasons
or for reasons of safety to persons, the dog or cat may be
euthanized humanely if reasonable efforts to locate the
owner of the animal have failed.

Si, de l'avis de l'agent de contrôle des animaux,
l'animal saisi est blessé ou malade et devrait être euthanasié
pour des raisons humanitaires ou pour protéger la santé et la
sécurité des personnes, l'agent de contrôle des animaux

Where a dog or cat seized and impounded is
injured or ill and is treated by a veterinarian, the
municipality shall, in addition to any impoundment fees, be
entitled to charge the person claiming the animal for the
cost of the treatment.

attempt to find the owner, either by radio announcement or
posting a notice at the Animal Shelter (Bathurst) Inc.

Notwithstanding section 6 C, where in the opinion
of the Animal Shelter (Bathurst) Inc./Gloucester SPCA, it is
unlikely that a seized dog or cat will recover from its
injuries or it would be inhumane to allow the continued
pain and suffering of the seized dog or cat, the Animal
Shelter (Bathurst) Inc./Gloucester SPCA may humanely
euthanize the dog or cat .

The owner of a dangerous dog shall ensure that:

dangerous dog in accordance with the fees
outlined in Schedule A

a securely enclosed and locked pen or
structure, suitable to prevent the escape of the
dangerous dog and capable of preventing the
entry of any person not in control of the dog.
Such pen or structure must have minimum
dimensions of two meters by four meters and
must have secure sides and a secure top. If it
has no bottom secured to the sides, the sides
must be embedded into the ground no less than
thirty centimeters deep. The enclosure must
also provide protection from the elements for
the dog. The pen or structure shall not be
within one metre of the property line or within
three metres of a neighbouring dwelling unit.
Such dog may not be chained as a means of
confinement.

(g) a sign, in both official languages
(English/French), is displayed at each entrance
to the property and building in which the dog is
kept, warning in writing, as well as with a
symbol, that there is a dangerous dog on the
property. This sign shall be visible and legible
from the nearest road or thoroughfare.

(h) a policy of liability insurance, satisfactory to
the municipality, is in force in the amount of at
least One Million dollars, covering the twelve
month period during which licensing is sought,
for injuries caused by the owner's dangerous
dog.

The municipality shall have the authority to make
whatever inquiry is deemed necessary to ensure compliance
with the provisions outlined in this section.

If the owner of a dog that has been designated as
dangerous is unwilling or unable to comply with the
requirements of this section, said dog shall then be

agency or licensed veterinarian, after a fourteen day
holding period. Any dog that has been designated as
dangerous under this by-law may not be offered for
adoption.
(3)

veut pas ou ne peut pas se conformer aux exigences du

No unauthorized person shall use, set or maintain a leg-hold
trap, a killing trap or a snare in a suburban area.

No person shall have, keep or possess a snake or
other reptile.

possess a snake or other reptile in restricted areas, provided
it is in a case or cage or other container designed in such a
fashion that it will completely confine such snake or reptile.

This by-law shall be enforced by the Animal Control
Officer, a person appointed by the City Council to
administer and enforce the by-law, a police officer, and any
employee, agent and/or company authorized by the City of
Bathurst.

Conseil municipal pour administrer et mettre en

(1)
Any person who contravenes any provision of this
by-law or if any person interferes or attempts to interfere
with the Animal Control Officer or agent while exercising
his/her functions under this by-law is guilty of an offence.

Each day of violation of any provision of this by-
law shall constitute a separate offence.

The levying and payment of any fines shall not
relieve a person from the necessity of paying any fees,
charges or costs from which he or she is liable under the
provisions of this by-law.

en aucune façon le contrevenant de l'obligation de payer
tous frais ou coûts dont il est passible sous les dispositions
du présent arrêté.
(4)
A Provincial Court Judge, in addition to the
penalties provided in this by-law, may, if he/she considers
the offence sufficiently serious, direct or order the owner of
a dog or cat to prevent such dog or cat from doing mischief
or causing the disturbance or nuisance complained of, or
have the animal removed from the City, or order the animal
destroyed.

Un juge de la cour provinciale peut, s'il juge
l'infraction suffisamment grave, en plus d'imposer les

above have not been received on or before the hearing
scheduled for entering a plea before the Provincial Court,
