VEHICLES IN THE PARKING ZONES UNDER THE
JURISDICTION OF CITY OF BATHURST

BE IT ENACTED by the council of the City of Bathurst
under the authority vested in it by the Municipalities Act,
R.S.N.B. 1973, c.M-22 and the Motor Vehicle Act,
R.S.N.B. 1973, cM-17, as follows:

In this By-law:

a) "No Parking Zone" means any place where a Vehicle
cannot stop, stand or park as per Section 193 of the Motor
Vehicle Act, Chapter M-17. R.S.N.B as amended; (Aires de

c) "Parking Attendant" means any person hired by the
City of Bathurst for the purpose of collecting moneys from
reserved parking zones, and to see to the enforcement of this
By-law with authority to issue parking violation tickets in the
Parking Zones of the City of Bathurst, and includes any
police officer, Bylaw Enforcement Officer, agent or
company authorized by the City to enforce this by-law;

or parking lot or parking facility approved by Council for the
purpose of parking Vehicles for a maximum period of time
and upon payment in a form prescribed by this By-law; (Aire

Friday, Victoria Day, Canada Day, New Brunswick Day,
Labour Day, Thanksgiving, Remembrance Day, Christmas
Day and Boxing Day; (Jour férié)

Victoria, fête du Canada, Fête du Nouveau-Brunswick, fête

highway, lane, path or other public place located in the

PART 2 - ON STREET AND OFF STREET PARKING
PARTIE 2 - STATIONNEMENT SUR RUE ET HORS

2.
The Streets or portions of Streets lying within the
City limits of the City of Bathurst, as identified by posted
signs, constitute the on-street parking areas, which are
designated as Two-Hour Free Parking Zone.

les aires de stationnement sur rue qui sont désignées aires de

3.
The parking lots or portions of parking lots lying
within the City limits of the City of Bathurst, as identified by
posted signs, constitute the off-street parking areas, which
are divided into Reserved Parking Zones, Thirty minute
Parking Zones, Two-Hour Parking Zones and Handicap
Parking Zones.

4.
Subject to this By-law, the parking of a Vehicle
within a Two-Hour Parking Zone is permitted without charge
or fee for a maximum of two consecutive hours.

5.
The parking of a Vehicle within a Reserved Parking
Zone is permitted upon the purchase of a monthly parking
permit issued under a form prescribed by the City of
Bathurst.

6.
Monthly parking permits can be purchased on a
monthly basis either for a period of one or more consecutive
months terminating at the end of each calendar year.

7.
The fee for a parking permit shall be, as indicated
in Annex "A" attached plus applicable taxes and shall be
purchased from the City of Bathurst and will become
effective April 1, 2017.

8.
A monthly parking permit shall be visibly placed on
the interior of the Vehicle on the windshield, on the dash or
on the rear-view mirror in such a manner that the parking
permit is clearly visible from the exterior of the Vehicle.

9.
Where a parking permit is displayed on or attached
to a Vehicle in accordance with the above section, it may be
parked in the Reserved Parking Zone specified on the permit
for the period so indicated.

10.
Any parking permit issued under this By-law
remains the property of the City of Bathurst and shall be
returned to the City of Bathurst upon request.

11.
A parking permit that is used in contravention of this
By-law may be cancelled by the City of Bathurst.

12.
The holder of a parking permit that is cancelled
under the above section shall return it immediately to the
City of Bathurst who shall refund the permit fee, if any, for
the unexpired portion of the month or year in respect of
which the permit was issued.

Subject to Section 14, the parking of a Vehicle
within a Handicap Parking Zone is permitted without charge
or fee.

14.
The parking of a Vehicle within a Handicap Parking
Zone is permitted upon the display on the Vehicle of a
disabled person identification plate, permit or placard issued
under the Motor Vehicle Act.

PART 3 - ENFORCEMENT

15.
a) Any Peace Officer or any person employed by
the City of Bathurst as a Parking Attendant is hereby
authorized to take any action or issue such tickets as they
may deem necessary to enforce any provisions of this by-
law.

b) A Peace Officer or any person employed by the City of
Bathurst as a Parking Attendant is hereby authorized to give
evidence pursuant to subsection 164(3) of the Municipalities
Act, R.S.N.B. 1973, cM-22, with amendments thereto.

16.
For the purpose of the enforcement of the parking
provisions of this By-law, a Parking Attendant is authorized
to place an erasable chalk mark on the tread face of the tire

of any parked or stopped Vehicle, and the Parking Attendant
of the City of Bathurst will incur no liability for his doing

17.
If a Vehicle is parked in violation of Section 30 of
this By-law or for a period of more than 24 hours beyond the
time limited by this By-law, a Peace Officer or any person
employed by the City of Bathurst as a Parking Attendant
may take such Vehicle or cause it to be impounded in a
suitable place and all costs and charges for the removal, care,
or storage of the said Vehicle shall constitute a lien upon
such Vehicle.
17.

(1).
There shall be no liability attached to a
Peace Officer or Parking Attendant, for any damages
to a Vehicle taken into his custody under this
section.

There shall be no liability, save as in
negligence, attributed to a towing company acting
under the instructions of the Peace Officer or
Parking Attendant for the taking into custody of a
Vehicle for a violation under this By-law.

When a Parking Attendant finds a Vehicle parked in
violation of this By-law, he shall attach to such Vehicle a
notice that such Vehicle is parked in violation of a provision
of this By-law, and such notice shall constitute a parking
violation ticket.

20.
The Parking Attendant shall record on the parking
violation ticket referred to in Section 19 to the owner or
operator:

the approximate location of the violation;

the license number of such Vehicle;

the time when such Vehicle was found
parked in violation of any provision of this By-law;

e)
any other fact or knowledge which is
necessary to a thorough understanding of the circumstances
attending such violation;

paid for this violation or offence.

PART 4 - VIOLATIONS

21.
No person shall park a Vehicle at a Parking Zone
except in accordance with this By-law.

22.
No person shall park a Vehicle outside a Parking
Zone.

No person shall park a Vehicle within a No Parking
Zone.

de stationnement interdit.
24.
No Vehicle the length of which exceeds six and one
half (6.5) meters shall park at a Parking Zone.

25.
No person shall park a vehicle for a period longer
than two hours on any of the streets or portions of streets as
identified by posted signs.

No person shall park a vehicle for a period longer
than thirty minutes on any of the streets or portions of street
as identified by posted signs.

27.
a) No Vehicle shall be parked within a Reserved
Parking Zone without a parking permit at any time between
the hours of 7:00 a.m. and 5:00 p.m. on any day except
Saturdays, Sundays and Statutory Holidays.
b) No person operating or in charge of a motor
vehicle shall park such motor vehicle to occupy a metered
parking space beyond the period which has been paid for and
indicated on the parking meter.
27.

28.
No person shall park a vehicle on a street or portion
of street designated as a parking space for disabled persons,
unless the vehicle is being used to transport a disabled
person and a disabled person's identification plate, permit or
sticker issued by the Province of New Brunswick is
displayed in a prominent place on the windshield or rear
window of the vehicle.

Notwithstanding any other provision contained in
this By-law, no person shall park a Vehicle on any street or
portion of streets between the hours of 12:00 midnight and
7:00 a.m. of any day from November 1st to April 30th of

PART 5 - VOLUNTARY PENALTIES

30.
The owner or operator of a vehicle who violates any
provision in this By-law commits an offence.

31.
Every person charged with an offence under this by-
law may, within fourteen (14) days from the date of the
offence and prior to a charge being laid in Provincial Court ,
pay a voluntary payment to the City of Bathurst as follows:

dispositions du présent Arrêté pourra, dans les quatorze (14)
jours suivant la date de l'infraction et avant qu'une accusation

Thirty Dollars ($30.00) for parking a
Vehicle outside of a parking space in any Parking
Zone;

oversized Vehicle which length exceeds six and one

($125.00) for parking a Vehicle in Parking Zone
designated for disabled persons without meeting the
requirements set out in section 28;

32.
When the voluntary penalty is paid within seven
days from the date of the offence and prior to a charge being

laid in Provincial Court, the voluntary penalty shall be
reduced to 50% of the respective amount set in this By-law.
This provision does not apply to Section 31 (f).

33.
Upon payment of such voluntary penalty, no further
proceedings shall be taken under this By-law in respect of
the said offence.

34.
If the voluntary payments set out in section 31
and 32 above have not been received on or before the
hearing scheduled for entering of a plea before the
Provincial court, the person charged with the offence is
liable for a fine of five hundred dollars ($500.00).

reçues avant la date prévue pour l'inscription d'un

PART 7 - BY-LAW REPEALED

35.
By-law No. 2004-05 "A by-law relating to the
Parking of Vehicles in the Parking Zones under the
Jurisdiction of the Bathurst Parking Commission" and all its
amendments are hereby repealed.
34.
