Ia ville de Beaurivage
En vertu des pouvoirs que lui confdre la Loi sur
l'urbanisme, 2017 , ch.19,le Conseil municipal de la
ville de Beaurivage, d0ment r6uni, adopte ce qui
suit:
1
Le pr6sent arrdt6 peut 6tre cit6 sous le titre
"AnGt6 portant adoption de I'Arr6t6 de zonage
de la ville de Beaurivage ".
2. Est adopte I'Arr6t6 de zonage de la ville de
Beaurivage.
3. Le document intitul6 " Arr6t6 portant adoption
de l'Arr6t6 de zonage de la ville de Beaurivage"
ci-joint annexe A, constitue l'Andte de zonage
mentionn6 au paragraphe 2 ci-dessus et fait
partie int6grante du pr6sent andt6.
4. La Carte de zonage - Zoning Map jointe au
pr6sent arr6t6 en tant qu'annexe B fait partie
int6grante du pr6sent arrdt6.
5. Sont abrog6s I'arrdt6 19-03 intitul6 <Arr6t6
portant adoption de I'arr6t6 de zonage de la
ville de Richibucto > adopt6le21ianvier2020,
et l'ensemble de ses modifications.

By-Law 25-03
By-law to Adopt the Town of Beaurivage
Zoning By-law
Under the authority vested in it by the Community
Planning Act,2017, c.19, the Municipal Council of the
Town of Beaurivage, duly gathered, adopts the
following:
This By-law may be cited as "By-Law to Adopt
the Town of Beaurivage Zoning By-law".
The Town of Beaurivage Zoning By-law is
hereby enacted.
3. The document entitled "By-law to adopt the
Town of Beaurivage Zoning ByJaw attached
hereto as Schedule A, constitutes the Zoning
By-law refened to in subsection 2 above and
forms an integral part of this By-law.
4. fhe Carte de zonage - Zoning Map attached to
this By-law as Schedule B is an integral part of
this By-law.
5.
By-law 19-03 entitled " A ByJaw to Adopt the
Town of Richibucto Zoning By-law " adopted on
January 21st,2020, and all amendments thereto
is hereby repealed.

2(1) Le pr6sent arr6t6 :
a)

modification des terrains, bAtiments ou constructions

3(1) Le Conseil peut interdire l'edification d'un
bdtiment pour lequel ilestime que n'ont pas ete prises
des mesures satisfaisantes pour le viabiliser en
6nergie 6lectrique, eau, 69outs, voies d'accds et
autres services ou 6quipements.
Lieux inesth6tiques
4(1) S'il estime qu'un bAtiment ou une construction est
delabr6, dangereux ou inesth6tique, le Conseil peut :
a) soit l'am6liorer, I'enlever ou le d6molir aux frais
du propri6taire;
b) soit acquerir la parcelle sur laquelle se trouve
le bAtiment ou la construction.

5(1) En conformit6 avec le paragraphe 117(6), le
Conseil peut, dr sa discr6tion, autoriser un promoteur
-r payer d la municipalite une somme de 1500,00 $ au
lieu de fournir les emplacements de stationnement
hors-rue obligatoires, laquelle somme sera payable
selon les modalit6s et aux conditions 6tablies par le
Conseil.

Part 1 - APPLICATION
Scope
2(1)This by-law:
(a)
divides the municipality into zones;
(b)
prescribes, subject to the powers reserved in
the Commission,
(i) the purposes for which land, buildings and
structures in any zone may be used, and
(ii)
the standards to which land use, and the
placement, erection, alteration and use of buildings
and structures must conform; and
(c)
prohibits the use, placement, erection or
alteration of land, buildings or structures other than in
conformity with the purposes and standards mentioned
herein.
Powers of the Municipal Council
Refusalfo issue a building permit
3(1) The Council may prohibit the erection of a
building when, in its opinion, satisfactory
arrangements have not been made for the supply of
electric power, water, sewerage, access roads or
other services or equipment.
Unsightly premrses
4(1) When, in its opinion, a building or structure is
dilapidated, dangerous or unsightly, the Council may
(a) improve, remove or demolish such building or
structure at the expense of the owner thereof; or
(b) acquire the parcel of land on which such building
or structure is located.
Payment of a sum in lieu of supplying parking spaces
5(1) Pursuant to subsection 1 17(6), the Council may, at
its discretion, authorize a developer to pay to the
municipality the sum of $1500.00, in accordance with
the terms and conditions determined by Council, in lieu
of providing the off-street parking spaces required
hereunder.

ailleurs interdit par le pr6sent arr6t6;
b) exiger la cessation ou la suppression d'un
am6nagement autoris6 conform6ment a
I'alin6a a) d l'expiration de la p6riode
autoris6e.
Modification d I'arr6t6 de zonage
7(1) Quiconque souhaite faire modifier le pr6sent
arrdt6 doit :
a) adresser dr cette fin au Conseil et avec une
demande etablie en double exemplaire, 6crite et
sign6e, qui comprend les 6l6ments suivants;

6(1) No building or structure may be erected on any site
where it would otherwise be permitted under this by-law
when, in the opinion of the Commission, the site, by virtue
of its soil or topography, is marshy, subject to flooding,
excessively steep or otherwise unsuitable for the
proposed purposes.
6(2) The Commission may, subject to such terms and
conditions it considers appropriate:
(a) authorize, for a temporary period not exceeding
one year, a development otherwise prohibited by
this by-law,
(b) require the termination or removal of a
development authorized under paragraph (a) at
the end of the authorized period.
Amendment to the Zoning By-law
7(1) Anyone requesting to have this by-law amended
shall:
(a) submit a written and signed request, addressed to
the Council for this purpose, in duplicate, including
the following elements.
(i) the zoning by-law to which the amendment is
sought,T
(ii) a list of the properties affected,
(iii) a list of the owners involved,
(iv) a description of the current use of the lands,
buildings or structures,
(v) a description of the proposed use of the lands,
build ings or structures,
(vi) plans and drawings in order to properly
visualize the project;
(vii) a description of the amendment sought, and
(viii) a list of reasons for requesting the amendment,
along with any supporting documents
considered necessary to show that the
proposal is useful; and
(b)
pay a fee of $1,500.00 to the Council
7(2) lf it considers it appropriate, the Council may
return all or part of the fee set out in paragraph
7(1Xb)

"private access" means an access way belonging to and
normally maintained by an individual, business or
association;
"community activity" means an activity organized or
sponsored by one or more organizations or interest
groups that is related to education, recreation, health and
community cultural activities and serves all or part of the
community;
"home occupation" means a secondary use that is
clearly related and secondary to the residential use of the
property in a main building or accessory (if permitted) or
part of a dwelling unit;
"climate change adaptation" means the process of
adjusting to actual or expected climate change and its
effects to moderate harm or exploit opportunities;
"advertisement poster" means a freestanding, two-
sided, triangulated poster that is not permanently fixed to
the ground and that is designed to be moved;
"projecting sign" means a sign which is wholly or
partially dependent upon a building for support and which
projects more than 30 cm beyond such building;
"sign, community identification" means a permanent
sign identifying a community, such as a subdivision, a
multi-unit residential complex, a condominium building or
a building for institutional use;
"subdivision sign" means a temporary sign that sets out
the design plan for the project or development of the
subdivision, showing the name of the subdivision, the
names of architects, engineers, landscape architects,
contractors or other craftsmen, as well as the names of
owners, funding partners, sponsors and other persons or
companies who have a role or interest in the project;
"sign, illuminated" means a sign that provides artificial
light directly or through any transparent or translucent
material, from a source of light connected with such sign;
or a sign illuminated by a light focused upon or mainly
directed at the surface of the sign;

"canopy sign" means a canopy that is attached or
integrated into a permanent projection of a building or a
fixed or projecting structuralframe that protrudes from the
exterior wall of the building;
"agri-tourism" means an activity related to agriculture
that takes place on a farm by a producer. This activity
complements the farm business and mainly highlights its
own production (or activities). The aim of the activity is to
bring tourists into contact with the farmer in a welcoming,
informative, educational and entertaining way, while
generating additional income;
"street line" means the boundary line of a street;
"pet, domestic, familiar" means an animal ordinarily
kept inside a dwelling or in an outdoor park or accessory
building solely for the purpose of pleasure and
companionship, but for no other purpose; This definition
includes dogs, cats, rabbits, small birds, small lizards and
rodents, but excludes livestock, sheep, horses, pigs,
poultry, bees and animals ordinarily kept as livestock;
"in-law suite" means an apartment contained within a
main single detached dwelling and which is internally
accessible from the main dwelling unit;
"service shop" means a building or part of a building
used for the sale and repair of household items and shall
include glass replacement shops, radio, television and
appliance repair shops, but shall not include industrial
uses or manufacturing or motor vehicle repair shops, and
vehicles designed and intended to serve as industrial
vehicles, heavy equipment or tractor trailers,
"climate change mitigation" means efforts to avoid,
reduce or remove the emission of greenhouse gas, as de-
fined in the Climate Change Act, into the atmosphere;
"building" means any roofed structure, whether
temporary or permanent, used or built for the shelter,
accommodation or enclosure of persons, animals,
materials or equipment, and includes any vessel or
container used for any of the foregoing purposes;

un 6tablissement utilis6 par des m6decins et un

"accessory building" means a subordinate building or
structure on the same lot as the main building and
devoted exclusively to an accessory use, but does not
include a building attached in any way to the main
building;
"main building" means a building in which is conducted
the main use of the lot on which the building is located;
"attached building" means a building otheruvise
complete in itself, which shares one or more walls or part
of a wall, above grade, in common with an adjacent
building or buildings;
"personal services shop" means any or all part of a
building in which persons provide direct services or
otherwise directly meet the individual and personal needs
of persons, including establishments such as barber
shops, beauty salons, laundries, hair salons,
shoemakers, sewing establishments, pick-up and laundry
facilities and dry cleaning establishments, but this
definition does not include establishments where goods
are manufactured for retail orwholesale sale;
"office" means a room or rooms where business may be
transacted, a service performed or consultation given, but
shall not include the manufacturing of any product or the
retail selling of goods;
"medical and health office" means an establishment
used by qualified medical practitioners and staff, for the
provision of medical and health care on an outpatient
basis. This term refers to such uses as medical or dental
offices, occupational therapy, occupational health and
safety offices, physiotherapy services, counselling
services, chiropractic services and ancillary clinic
counselling services, but does not include veterinary
services;
"cannabis" means cannabis as defined by the
Government of Canada, pursuant to the Cannabis Act;
"shopping centre" means a commercial building with a
minimum area of 1,500 square metres with more than one
commercial establishment, designed, developed,
operated or managed by one or more owners or tenants,
where retail establishments, financial institutions,
restaurants, grocery stores, offices and other

materials;
"salvage yard" means a lot or premises for the storage,
handling or processing of and sale of scrap material, and
without limiting the generality of the foregoing, shall
include waste paper, rags, used bicycles, vehicles, tires,
metal or other scrap material or salvage;
"recycling depot" means a building which is used for the
deposit, collection and handling of waste paper, rags,
tires, bottles or other materials which are to be delivered
wholesale to other off site operations for further
processing or salvage;
"kennel commercial" means a building or structure
where more than four (4) dogs, are bred and raised or
boarded, with or without veterinary care;
"cemetery" means land primarily used for the interment
of human remains and where chapels, churches, funeral
homes, crematoria and related facilities may be
incorporated as accessory uses;
"veterinary clinic" means a facility for the medical care
and treatment of animals and includes provisions for their
overnight accommodation, including an animal shelter,
but does not include any outdoor facilities such as
kennels, pen runs and enclosures;
"Code" means the National Building Code of
Canada in effect in the Province of New Brunswick;
"lot coverage" means that percentage of the lot area that
is permitted to be covered by all buildings above ground
level, other than swimming pools, and shall not include
that portion of such lot area which is occupied by a
building or portion thereof which is completely below
ground level, and for the purpose of this definition the
maximum lot coverage in each zone shall be deemed to
apply only to that portion of such lot which is located
within said zone;
"drive-thru business" means an establishment
designed to provide, either completely or in part, services
or products to customers while in their vehicle;
"commission" means the Kent Regional Service
Commission;

"condominium development" means a building or
group of buildings where the occupants are owners of
their dwelling, as set out in Chapter C-16.05 of the
Condom ini u m Propefty Acl;
"sustainable development" means development that
meets the needs of the present without compromising the

"Director" means the Provincial Planning Director
appointed under section 9 of the Community Planning
Act;
"screening" means the use of landscaping, fences or
berms to visually and/or audibly separate areas or uses;
'nerect" means to construct, build, assemble or reinstall a
building or a structure and also includes preparatory work
on the site;
"elevation" means the vertical distance between the
average high tide level per (CGVD2O13)and the highest
waterproof point in the building's foundation.
"parking space" means an area for the temporary
parking or storage of motor vehicles, and which has
adequate access to permit ingress and egress of a motor
vehicle to and from a street or highway by means of
driveways, aisles or maneuvering areas;
"warehouse" means a building used primarily for the
storage of goods and materials;
"outdoor storage" means the storage of merchandise,
goods, inventory, materials or equipment or other items,
by locating them on a lot exterior to a building but does
not include an outdoor display court;
"sign" means the indication, the description, the
illustration or logo, illuminated or non-illuminated, that
provides information, such as a product, the location, the
activity, the person, the institution or the business, and is
posted outside a building. This definition excludes traffic
road signs as defined by legal notices and the Motor
Vehicle Act:
"free-standing sign" means a sign which is supported
by one or more masts, supports or posts attached to the
ground. This sign is not connected to a wall of the
establishment;
"facade sign" is a sign which is attached, painted or
represented in any manner whatsoever on the fagade of
a building or structure;
"variable electronic sign" means a sign on which
messages or images are displayed by means of light

"self-storage facility" means a business that rents
warehouses of various sizes and are locked, within which
goods can be stored. The tenant of a self-storage space
may, at any time, access the space and add or retrieve
goods at any time;
"retail store" means a building or part of a building in
which goods, wares, merchandise, substances, articles
or things are offered for sale directly to the public at retail
value and shall include minor food processing and
packaging in connection with the sale of food products;
"wholesale establishment" means a building in which
commodities in quantity are offered for sale mainly to
industrial, institutional, and commercial users or to
retailers or other merchants mainly for resale or business
use;

retail store, as well as to other similar uses. Common
areas take up an area equal to at least 10% of the total
area of each multi-unit building, and the exterior area of
the building may take up 50% of the total area;
"storey" means that portion of a building which is
situated between the top of any floor and the top of the
next floor above it, and if there is no floor above it, the
portion between the top of such floor and the ceiling
above it;

view is considered having a corresponding number of

"family" refers to one or more persons who are not
necessarily related and occupy a space and form a single
household as opposed to a group staying in a hotel,
boarding house or a rooming house;
"hobby farm" means an agricultural activity or a use
secondary to a main residential use, when permitted, the
hobby farm shall;

related to the repair or alteration of motor vehicles, but
shall not include the manufacturing or fabrication of motor
vehicle parts for the purpose of sale nor the retailing of
gasoline or other fuels;
"parking garage" means a covered or enclosed
establishment containing communal parking spaces for
the parking of vehicles;
"daycare centre" means an establishment for the
provision of care and supervision to children, as
regulated under the Child and Family Services Act;
"natural gas" includes the same definition as in the Oil
and Natural Gas Act;
"bed and breakfast" / "tourist home" means a single
detached dwelling in which the owner or manager lives,
providing overnight accommodation and meals (usually
breakfast, but occasionally other meals as well) for the
travelling public;
"dwelling" means a building or part of a building,
occupied or capable of being occupied as a home or
residence by one or more persons, and containing one or
more dwelling units but shall not include a hotel, motel,
apartment hotel or hostel;
"secondary dwelling unit" means a secondary dwelling
unit in relation to the main dwelling unit;

habitation "two family dwelling" means a building containing two
dwelling units;
"semi-detached dwelling" means a dwelling unit
attached to another dwelling unit by a common above
grade wall with each dwelling usually located on a
separate lot;
"multi-family dwelling" means a building with three or
more dwelling units;
"single family dwelling" means a dwelling other than a
mobile or mini home, travel trailer or motor home
containing only one dwelling unit;
"height" means in respect to a main building or structure,
the vertical distance between the established grade and
the highest point of the roof surface for a flat roof, hip roof,
or gable roof, or to the roof line in the case of a gambrel
or mansard roof. Also means the vertical distance
between the average ground level and the highest point
of the building or structure;
"height of a sign" means the vertical distance between
the highest point of the sign from ground level or from the
sign bracing;
"hotel or motel" means a commercial building or
buildings providing temporary accommodations for
travelers or transients on a year-round basis, and may
have a public dining room and convention room;
"building inspector" means a person appointed by
Council or the Commission under The Community
Planning Act or The Local Governance Act, who
exercises the powers and performs the duties and
functions set out in this By-law;
"cultural facilities" means any land, structure or room
designed or used mainly for theatre performances or
dance shows, concerts, movies, conferences or exhibits,
or a series of artistic, cultural, academic, or scientific
exhibits;
"extractive use'n means all buildings, aggregate plants,
material storage areas and weigh scales associated with
the excavation of rock, borrow material, soil for
commercialsale or use but does not include structures or
storage areas which are fundamental to the activities of
mining;

premises authorized by a license issued by the
Government of Canada, pursuant lo the Cannabrs Acf for
growing, producing, testing, destroying, storing, or
distribution of cannabis but does not include the retail
sale of cannabis or cannabis related products;
"residential care facility" means a building or place or
part of a building in which accommodation and nursing,
supervisory and/or personal care is provided, or is made
available for more than three persons with social health,
legal, emotional, mental or physical handicaps or
problems, and includes such facilities as those licensed
by the Family Services Act, or by any other provincial
legislation, but does not include any public or private
hospital or sanatorium, or a jail, prison or reformatory;
"recreational facility" means a place designed and
equipped for sports and recreational activities and other
uses related to other ordinary and usual recreational
activities;
"green infrastructure" means natural assets, including
forests and climate resilient lands, enhanced assets, in-
cluding urban trees and bioswales, and engineered as-
sets, including permeable pavements and green roofs;
<< community garden >> " means a shared, associative,
or collective garden, primarily a vegetable garden, rural
or urban, managed collectively by a group of residents.
Each gardener is responsible for maintaining their small
garden and is the exclusive beneficiary of their harvest.
The maintenance of common areas is the joint
responsibility of all members;

equipped with facilities for playing any game of chance or
skill, but not including locations containing only pool or
billiard tables, gaming machines, bowling alleys or bingo
halls;

o'loading and unloading space" refers to the part of a
lot that is reserved and maintained on the same lot, where
its main use consists of having enough facilities to access
and exit through alleys, driveways or service courts; it is
used to park commercial vehicles on a temporary basis
while merchandise is loaded or unloaded;
"entertainment place" means a movie theatre or other
type of theatre, an arena, an auditorium, a public hall, a
billiard room, a bowling alley, a skating rink, a bingo hall
or other similar venues;
"lot line" means a common line between a lot and an
abutting lot, lane, street, parcel of land or body of water;
"rear lot line" means the lot line farthest from or opposite
to the front lot line;
"front lot line" means the line dividing the lot from the
street or other means of access, and
(i)
in the case of a corner lot - the shorter boundary
line abutting the street shall be deemed to be the
front lot line and the longer boundary line abutting
the street shall be deemed to be the flankage lot
line; and where such lot lines are of equal length,
the front lot line shall be either of the lot lines and
the other lot line shall be the flankage lot line;
boundaries dividing the lot from a street shall be
deemed to be the front lot line; or

"lot" means a parcel of land described in a deed or
subdivision plan, used or proposed to be used as the site
of a building or structure or appurtenance thereto;
"corner lot" means a lot situated at the intersection of,
and abutting on, two or more streets;
"interior lot" means a lot other than a corner or through
lot;
"through lot" means a lot bounded on two opposite
sides by streets or highways provided, that if any lot
qualifies as being both a corner lot and a through lot as
defined herein, such lot shall be deemed to be a corner
lot for the purpose of this by-law;
"rowhouse dwelling" means a building that is divided
vertically into three or more dwelling units, each of which
is located on a separate lot;
"mini home or mobile home" means any dwelling that
is pre-manufactured and designed to be transported to
the lot to be installed on the foundation as one integral
unit;
"micro-brewery/distillery" means a use where beer,
cider, wine or spirits, or a combination thereof, are
manufactured in the following quantities per calendar
year: (a) no more than 800,000 litres of beer or cider; (b)
no more than 100,000 litres of wine; and (c) no more than
75,000 litres of spirits.
"tiny home" means a single-family dwelling unit with an
area of less than 600 square feet, including attic floor
area, that is constructed or prefabricated and
permanently anchored to a foundation and has
permanent connections to public or private utilities,
"alteration" means any change in a structural
component or any increase in the volume of a building or
structure;
"main wall" means the exterior front, side or rear wall of
a building;

"established grade" means the average elevation of the
finished ground surface adjacent to a building, excluding
localised depressions such as vehicle or pedestrian
entrances and when used with reference to a structure
shall mean the average elevation of the finished grade ol
the ground immediately surrounding such structure.
"intensive livestock operation" means a livestock
facility or operation involving 250 or more animals;
"social club" means a non-governmental, non-
commercial, and non-profit organization whose main
activities are of a social, cultural, sporting or recreational
nature;
"billboard sign" means a large ground sign or facia wall
sign which is not related to any business or use located
on the lot or premises;
"public park" means a park owned or controlled by a
public authority or by any board, commission or other
authority established under any statute of the Province of
New Brunswick or Government of Canada;
"garden suite" means an independent detached dwelling
on a regulatory foundation designed to be located in the
rear yard of the lot where an single-family dwelling is
already existing;
"boarding or roaming house" means a dwelling in
which either room or room and board is provided, for a
monetary gain to persons, exclusive of the owner of the
building;

construction, basin or tank above or below grade which is
designed to hold water and having the capacity to contain
water to a depth of 61 cm (2 feet) at all times;

full scientific certainty should not be used as a pretext for
postponing the adoption of measures to prevent
environ mental deterioration";
"condominium/bare-lands property" means land or a
collection of buildings, primarily used for residential
purposes, in which each individual unit is held in separate
private ownership and all facilities and outdoor areas are
used in common by all tenants, and are owned,
administered and maintained by a corporation created
pursuant to the provisions of the New Brunswick
Condomi ni u m Property Act;
"brownfield development" means the remediation or
decontamination and redevelopment of an abandoned,
vacant, derelict or under-utilized commercial or industrial
site that may be contaminated;
"paved" means the use of asphalt, asphaltic or portland
cement, concrete or other similar substances such as
brick or stone to create a smooth surface, including
bituminous penetration, but not the use of gravel, clay, dirt
or slag;
"trailer, motor home, caravan" means an enclosed,
wheel mounted itinerant dwelling that can accommodate
a family and is designed as a travelvehicle and registered
under the Motor Vehicle Act;
"street or road" means the entire right-of-way of each
street, road or road allowance vested in a municipality,
the Province of New Brunswick or the Government of
Canada;
"institutional services" means the use of lands,
buildings or structures for the public or not for-profit
sectors, and may include, but is not limited to, schools,
churches, indoor recreational facilities, community
centres, public hospitals and government buildings;
'obituminous shale" has the same definition as set out in
lhe Bituminous Shale Act;

"floor area" means the total amount of usable floor
space in a building;
"gross floor area" means the total amount of the floor
areas of a building above and below grade, measured
between the exterior surfaces of the exterior walls of the
building at each floor level, but excluding car parking
areas within the building; and for the purpose of this
clause, the walls of an inner court shall be deemed to be
exterior walls;
"directory sign" means a sign with more than one
establishment which displays only a listing of the names
of these businesses or organizations without advertising
copy, except a business logo;
"playground" means an area of landscaped open space
equipped with children's play equipment such as slides,
swings or wading pools;
"outdoor display court" means an area of land where
goods are displayed which are available for sale to the
general public from a retail outlet located on the same lot
or on another lot. Without limiting the generality of the
foregoing, outdoor display includes the display of cars,
trucks, vans, motorized campers, trailers, boats,
snowmobiles, motorcycles, swimming pools, decorative
fountains and prefabricated cottages and homes;

"climate resilient lands" means lands able to with-
stand and recover from extreme weather events and
protect other lands and developments from the impacts of
climate change, including:
(a) wetlands,
(b) dunes,
(c) beaches,
(d)floodplains,
(e) riparian zones, and
(f) vegetated and forested areas
"active transportation" means the transportation of
people or goods by:
(a) human activity, including walking, jogging, running,
snowshoeing, skiing and paddling, or
(b) the use of human-powered or partially human-
powered aids such as wheelchairs, scooters, watercraft,
bicycles, e-bikes, skateboards and in-line skates;
"sight triangle" means the triangular shaped area of
land, free of buildings or structures, formed by measuring
from the point of intersection of street lines on a corner
lot, the distance required by this by-law, along each such
street line and adjoining such end points with a straight
line;
"accessory use" means a use subordinate and
naturally, customarily and normally incidental to and
dependent upon a main use of land or buildings and
located on the same lot with such main use;

purpose of preparing farm products for wholesale or retail
consumption,
(k) the storage, use or disposal of organic wastes for farm
purposes,
(l) the operation of pick-your-own farms, roadside stands,
farm produce stands and farm tourist operations as part
of a farm operation,
(m) the application of fertilizers, conditioners, in
secticides, pesticides, fungicides and herbicides,
including ground and aerial spraying, for agricultural
purposes, or
(n) any other agricultural activity or process prescribed by
regulation.
"aquaculture use" means use for the purpose of aqua-
culture, as defined in the Aquaculture Act, and for the as-
sociated processing, storing, packaging and distributing;
"commercial recreation use" means a building or lot or
part of a building or lot used solely for commercial
recreation, sport or entertainment purposes and without
limiting the generality of the foregoing, may include such
establishments as dance halls, horse or vehicle racing
tracks, rifle ranges, marinas, bowling alleys, miniature
golf courses, bingo halls, roller skating rinks and drive-in
theatres, and may include a dwelling unit or dwelling units
for maintenance or security personnel;
"community use" means a non-profit use of a building
or a part of a building or land used for community
activities;

on the same lot as the place of education;
"silvicultural use" means the growing and sustainable
harvesting of trees, including for the purposes of
producing firewood, wood pulp, trees and other primary
forest products, sawing and hewing wood with a portable
saw, and producing Christmas trees and special forest
products, such as maple syrup, bark products and wood
for furniture;
a) storing, repairing or creating fishing equipment
for commercial or business use;
b) and the processing, storing, packaging
distributing of bait and aquatic plants
animals;
and
and
"public utility" means any agency, which under a
franchise or proprietorship, furnishes the public with
electricity, g?s, steam, communications, rail
transportation, water, sewers, waste collection or other
services or a similar private company having a franchise
to provide a public service;
"commercialvehicle" means a vehicle which is licensed
as a commercial carrier as determined by the Registrar of
Motor Vehicles;
"prime agricultural area" means an area that meets
one or more of the following criteria:
a) the area is Canada Land Inventory Class 2,
3 or 4 land that is currently in agricultural use
or cleared for agricultural use;
b) the area is being used for, being prepared to
be used for or has been identified for the
future development of maple sugaries or the
production of wild blueberries or cranberries;
c) the area is an existing woodlot that is
associated with an agricultural operation and
is part of an area that includes Canada Land
lnventory Class 2, 3 or4 land that is currently
in agricultural use or cleared for agricultural
use; or
d) the area is Canada Land lnventory Class 5,

Designated Watershed Protected Area or
Designated Wellfield Protected Area

watercourse or other wetland, and
b) lands that are federally or provincially
designated for environmental protection or
conservation.

or used in whole or in part for any purpose or in any
manner prohibited by this by-law.

the Commission and the municipality may
establish, the following secondary use:
(i) a professional home occupation

(c) under 119(1) and subject to such conditions as
the Commission and the municipality may
establish, an accessory dwelling unit such as:
(i) garden suite, in-law suite, basement
apartment, garage suite;
(d) any building, structure or use that is incidental
to the main use of the land, building or
structure, if such main use is permitted by this

to in section 10 unless such lot is serviced by the
municipal sewer system or private system.
11(2) No main building or structure may be placed,
erected or altered on a lot, and no building or structure

(a) 7.5 meters of a street line,
(b) subject to subsection (2) with respect to a
side lot line, '1.5 meters from one side and

buildings or structures shall only be located on a lot in an
Al zone if the Minister has approved a specific proposal
regulated under section 38 of the Community Planning
Act.
114(2) The standards and requirements for the A/ zones
cannot be subject to this by-law, but rather are governed
by the proposal approved by Council under section 59 of
lhe Community Planning Act.

Part 4' GEN ERAL PROVISIONS
Professional home occupations
1 15(1) Subject to the provisions of 115(2), if the carrying
on of a professional home occupation in the home is
permitted by this by-law, the main residence may be used
for the exercise of one of the professional activities listed
below;
a)
a real estate/insurance agent;
an architect, draftsman, surveyor, architect,
an engineer, consultant or other
professional;
(i)
( ii)
(iii) a lawyer or notary;
(iv) a financial professional;
(v)
a seamstress or tailor;
(vi) a daycare centre at home;
(vii) a health care professional;

occupations in the home are permitted in the Rural
Residential (RR), Resource (RE), Agriculture (AG)
zones;
(i) at home car sales (maximum of 4 vehicles);
(ii) a dog sitting service (maximum of 10 dogs);
(iii) a kennelfor dogs, according to 129(1);
(iv) the preparation and sale of homemade and
artisanal products;
(v) the repair and maintenance of small
machinery and equipment;
c) any other similar or similar professional activity,
with such approval and under such terms and
conditions that the Council and the Commission
may establish.
115(2) The operation of a home occupation is subject to
the following conditions:
(a) the number of employees is limited to the owner
in addition to one (1) additional employee;
(b) it is restricted to the main building and cannot
be established, even partially, in an accessory
building or structure, except in rural residential
(RR), resource (RE), agriculture (AG) zones;
(c) the occupancy area shall not exceed twenty-
five (25) per cent of the total floor area of the
dwelling and shall not exceed fifty (50) square
metres;
(d) other than a sign permitted to be displayed
within the zone, no alteration to the architecture
of the residence shall be visible from the
outside;
(e) a daycare licensed by this by-law shall comply
with all provincial regulations relevant to its

Stationnement hors-rue
117 (1) Sous r6serve des pr6sentes, un bAtiment ou une
construction ne peut 6tre implant6, 6difi6, modifi6 ou
utilise que si des espaces de stationnement hors-rue
ont ete pr6vus conform6ment aux prescriptions des
dispositions 117(1) a 117(6).
117(2) Les espaces de stationnement hors-rues vis6s d
117(1) doivent 6tre calcules de la fagon suivante :

116(1) Unless specifically stipulated elsewhere in this By-
Law, no more than one main building or main structure
may be placed or altered on a lot, and a building or a
structure shall not be converted into a second main
building or second main structure.
116(2) The Commission may, under the conditions it
deems reasonable, approve uses in areas where it is
proposed that uses other than single-family and two-
family dwellings, excluding condominium projects,
occupy more than one main building on the lot.
Off-street Parking
117(1) Subject to the following conditions, a building or
structure shall not be placed, erected, altered or used
unless the off-street parking areas have been provided in
conformity with the requirements of provisions 117(1) to
117(6).
117(2) Off-street parking spaces referred to in 1'17(1)
must be calculated as follows:
(a) housing units (at least 1.5 spaces per dwelling);
(b) retail stores, similar establishments (one space at
least per 14 square metres of floor area);
(c) food establishments and bars, (at least one
space per group of 4 customers that can be
served);
(d) offices (at least one space for every 90 square
metres of gross area up to a maximum ol 270
square metres and one additional space per 45
square metres beyond 270 square metres);
(e) recreation and recreation establishments,
churches, community centres and other
gathering places, (one space for at least 5 seats
fixed to the floor or at least one space for every

desservi;
et pour mobilite r6duite;
(a) doit avoir au moins une longueur de 7
mdtres et une largeur de 4 mdtres,
(b) doit 6tre am6nag6 d un endroit qui favorise
l'accds facile au bAtiment,
(c) doit Otre d6sign6 et identifi6 s6par6ment
des autres cases de stationnement, et
(d) le nombre de case requise doit 6tre
conforme au Code national du bitiment du
Canada en vigueur.
117(4) Si le nombre d'emplacements de stationnement
n'est pas inf6rieur d la superficie prescrite pour tous les
espaces requis, des mesures peuvent 6tre prises en
commun pour des emplacements de stationnements
sur un m6me lot desservant deux ou plusieurs 6difices.
117(5) Si des mesures ont 6te prises en commun pour
des emplacements de stationnements hors-rue en vertu
de 117(4), les emplacements de stationnements
doivent;

greater);
(f) hotels and motels, (one space per room);
(g) schools and youth clubs, (at least one location
per class or room and if the club or premises
includes an auditorium or assembly area, one
additional location per 20 square metres of the
auditorium or assembly area); and
(h) industrial establishment, warehouses, yards or
storage buildings, maintenance and repair
establishment, (one location at least per group of
5 employees or per 90 square metres of gross
floor area, whichever is
greater).
117(3) A standard parking space:
(a) must be at least 6 metres long and 3
metres wide;
(b) must have easy access from a street; and
(c) must be within 150 metres of the building
being served;
and for reduced mobility;
(a) must be at least 7 metres long and 4
metres wide;
(b)
must be located in an area that allows
easy access to the building;
(c) must be designated and identified
separately from other parking spaces, and
(d) the number of spaces required must be in
accordance with the current National
Building Code of Canada.
117(4) lf the number of parking spaces is not less than
the prescribed area for all the required spaces, joint
arrangements may be made for parking spaces on the
same lot serving two or more buildings.
117(5) lf measures have been taken jointly for off-street
parking spaces under 117(4), the parking spaces must;

assurer la rdception ou la livraison des marchandises
ou mat6riel doit, selon les modalit6s qui suivent,
am6nager et maintenir des emplacements de
stationnements hors-rue sur les terrains y attenants
pour garer ces v6hicules et proceder aux op6rations
de chargements et de ddchargements.
(a) dans le cas des magasins de vente au d6tail ou
en gros, d'6tablissements d'entreposage en vrac,
d'entrep6ts ou autres 6tablissements similaires;
(a) be paved with durable materials that are dust-
proof;
(b) have access to and exits which, in the opinion
of the Commission, take into account the
topography of the land and traffic in general;
and
(c) not be used for the repair or maintenance of
automobiles except in an emergency.
117 (6) Notwithstanding sections 117(1) to 117(5),
Council may, if it deems it appropriate, permit the
developer of a projet to pay to the Municipality the sum of
$1,500.00 per space in lieu of establishing off-street
parking as required by this by-law.
Off-street loadinq and unloading
118(1) The owner of any building, structure or premises
used, in whole or in part, for a use requiring the use of
vehicles to receive or deliver goods or equipment must, in
accordance with the following terms, set up and maintain
off-street parking spaces on the adjoining land for the
purpose of parking these vehicles and carrying out
loading and unloading operations.
(a) for retail or wholesale stores, bulk storage facilities,
warehouses and other similar establishments:

area is more than 2,700 square meters.
118(2) Loading and unloading areas mentioned in 1 1B(1)
must:

dwellings must comply with the following requirements:

6tre conforme aux dispositions de 121(1) d 121(4).
121(2) Quand le plan du mur d'un bAtiment forme une
partie de l'enclos indique d 121(1);
a) une entr6e principale ou une porte de service ne
peut en faire partie; et
b) une porte d cet endroit, autre que la porte

Fences
120(1) Notwithstanding any other provision of this by-
law and subject to this section, a fence may be erected
or located in a yard.
120(2) A fence erected within eight (B) metres of a
street line shall not be more than one ('1) meter in height
at any location.
Subject to subsection 120(2), a fence may not exceed in
height;
a) '1.5 meter in a residential zone;
b) 2.5 meters in any other zone
120(3) A barbed wire fence may be permitted in
commercial, industrial and agricultural zones, as long as
the minimum height of the fence is 2 meters.
Fences for swimminq pools
121(1) A swimming pool may not be installed unless it is
surrounded by a fence or a wall, a building or a structure
or both and its height must reach 1.5 meters and comply
with provisions 121(1) to 121(4).
121(2) When a wall of a building forms part of the
enclosure indicated in 121(1);
a main entrance or a service door cannot be
part of it; and
b) a door in this location, other than the door to a
residence or a dwelling unit, shall be equipped
with an automatic closing mechanism and an
automatic safety lock installed at (1.5) meters
from the bottom of the door.
121(3) The enclosure described in 121(1) shall not be
surrounded by ramps, railings or other accessory items
which could facilitate the climbing of the wall.

(ii) steel wire must be at least 12 or 14 gauge
and have an approved covering equivalent
to the thickness of a 12-gauge steel wire
and;
(iii) steel poles with a diameter of at least 4
centimeters; to be buried below the freezing
point with a coating of cement and spaced
at a maximum of 3 meters; and fitted at the
top with a horizontal rail with a diameter of
at least 4 centimeters;
b) in the case of a wood fence,
(i) vertical planks measuring at least 2.5 x 10
centimeters, spaced at a maximum of 4
centimeters attached to structural lumber
and arranged in such a way as to prevent
climbing from the outside; and
(ii) square cedar supporting posts measuring at
least 10 centimetres or cyllndrical posts with
a diameter of at least 10 centimeters, buried
in the soil below freezing point and placed at
2.5 meter intervals; the part buried in the
ground must be treated with a preservative
and the fence shall be attached at the top
with a horizontal rail measuring at least (5 x
15) centimetres; and

Enlevement de la couche de terre arable
122(1) Sous r6serve du pr6sent article, il est interdit
d'enlever, par extraction ou de toute autre
fagon, la couche de terre v6g6tale d'un lot ou
de toute autre parcelle en vue de la vendre
ou de l'utiliser.
a) ll est toutefois permis d'enlever pour le
vendre ou l'utiliser l'exc6dent de terre
v6g6tale provenant de l'edification d'un
bitiment ou d'une construction aprds
d6duction des quantit6s n6cessaires aux
travaux de nivellement et d'am6nagement
paysager du lot;
b) Malgre le paragraphe (1), la production de
gazon est permise lorsque le propri6taire du
terrain affecte d cette activit6 a conclu avec
le Conseil un accord garantissant la remise
en 6tat du terrain.
Enseignes et affichage
123(1) Une personne ne doit pas construire, 6riger,
exposer, modifier ou relocaliser une enseigne; de plus,
le propri6taire ou le locataire d'une propri6t6 ne doit pas
permettre, tol6rer ou autoriser la construction,
l'installation, l'6talage, la modification ou la
relocalisation d'une enseigne sur un terrain sans qu'un
permis d'affichage ne soit obtenu selon les dispositions
de cet arr6t6.
Un permis n'est pas requis pour les types d'enseignes
non-illumin6es suivantes et le nombre total d'enseignes
ci-dessous est limit6 d (2)et;
c) if it consists of a structure with material not
mentioned in (a) and (b), its strength must match
what is prescribed herein.
121(4) The fences forming an enclosure as indicated in
121(1):
a) must constitute a whole with the fence in terms of
its structural aspects and its height;
b) shall have solid hinges; and
c) shall be equipped with an automatic lock placed at
a height of (1 .5) meters from the bottom of the door,
allowing the door to close automatically.
Topsoilremoval
122(1) Subject to this section, it's forbidden to remove,
by extraction or any other way, the topsoil from
a lot or any other parcel for the purpose of
selling or using it.
a) Where, in connection with the construction of a
building or structure, there is more top soil than
is required for grading and landscaping on the
lot, such excess of top soil may be removed for
sale or use.
b) Notwithstanding subsection (1), the farming of
sod is permitted if the owner of the land has
entered into an agreement with the Council to
guarantee the rehabilitation of the land.

property shall not permit, tolerate or authorize the
construction, installation, display, alteration or relocation
of a sign on land without a permit to display a sign being

centimritres de profondeur en tout temps pour
un site d'extraction non cl0tur6; ou
c) se servir de lieu d'entreposage ou de vidange
de mat6riaux toxique, de ferraille, de d6chets
domestiques, de restes de constructions ou
de toutes autres mat6riaux susceptibles d'6tre
nuisible d I'environnement.
125(3)Tout site d'extraction doit r6pondre aux normes
suivantes :
a) aucune extraction ne peut 6tre effectu6e dt
moins de 250 mdtres de tout plan d'eau;
b) le propri6taire du terrain doit maintenir libre de
poussidres, les voies d'accds et les rues
servant au transport de materiaux; ces routes

mdtres de tout bdtiment principal;

Safety and siqn maintenance
124(1) The owner or lessee of a property on which a
sign is located is prohibited from allowing the sign, its
supports, anchoring and electrical system to become
unsightly, squandered or dangerous.
124(2) Signs, including their frames, brackets, anchors
and electricalwiring, must be constructed in accordance
with the building by-law, and the relevant provincial and
national fire
and
electrical codes.
124(3) lt may become necessary to remove a sign that
has become unsightly or dilapidated if it constitutes a
safety hazard.
Standards for Aq g reqate Extraction
125(1) Subject to this section, no person shall undertake
or continue the excavation of sand, gravel, clay, shale or
limestone or any other material for the purpose of sale or
any other commercial use except in conformity with the
standards of this by-law.
125(2) The extraction site shallnot:
a) damage any adjoining propertY;
b) allow the accumulation of water to a depth greater
than 60 centimeters at any time during the year, for
an extraction site not fenced; or
c) serve as a storage place or dump for toxic
materials, scrap iron, domestic waste, construction
material or any other material likely to be harmful to
the environment.
125(3) All extraction sites shall be subject to the following
conditions:
a) no extraction may be done within 250 meters of
any water surface;
b) the owner of the land must keep the access
roads and streets used for the transport of
materials free of dust; These access roads
must be located at least 30 metres from any
main building;
c) be located at least 300 meters from any
dwelling;
d) be located within 30 metres of the boundaries
of private land, unless written permission is
obtained from the owner;

I'extraction et tout bAtiment, construction ou

I'entreposage situ6s dt plus de 350 mdtres
d'une route publique ou d'un accds priv6;
j) le propri6taire du terrain est responsable de
maintenir un site s6curitaire; (barrieres,
cldtures, affiches etc.), et adh6rer aux
diff6rents reglements provinciaux qui peuvent
6tre applicables;
k) avoir un plan d'arpentage du site d'extraction;
l) I'extraction de materiel du site ne d6passe
pas une profondeur oil I'eau peut s'accumuler
de fagon continuelle sur plus de 5 centimdtres
pour une periode s'6talant sur 12 mois; mais
advenant qu'il y ait accumulation continuelle
d'eau d6passant le critdre ci-haut mentionn6,
I'op6rateur responsable recouvrira
compldtement l'6tendue d'eau de mat6riel
similaire d celui du site d'extraction jusqu'd ce
qu'il n'y ait plus d'accumulation d'eau;
m) le propri6taire du terrain est responsable de
maintenir les heures d'oP6rations
d'extractions entre 6h00 et 21h00.
125(4) Lorsque les op6rations d'extractions ont cess6
pendant plus de 10 mois aprrls 6puisement du permis,
ou une p6riode plus longue d6terminee par la
Commission et la municipalite, le terrain devra 6tre
remis en 6tat de la manidre suivante,
a) l'enldvement des equipements, bAtiments ou
constructions relatif aux travaux d'extraction;
e) be located within 100 metres of the foundation

obtained from the owner;
f) be located at a distance of 100 meters from a
private drinking water well, in the case of a
gravel pit or sand pit, unless written permission
is obtained from the owner;
g) be located within 300 metres of a commercial,
industrial, agricultural or communal well, in the
case of a gravel pit or sand pit, unless the
applicant has obtained prior written permission
from the Department of Environment and Local
Government;
h) be located within 600 metres of a water supply
well, in the case of a rock quarry, unless the
owner or user of the well and the Department
of Environment and Local Government have
written permission to do so; in any case,
activities must be held at a minimum distance
of 300 metres;
i) Have the top or base of the slope of the
excavation, or any building, structure or site of
any intended repair or storage located at more
than 350 meters from a public highway or
private access road;
j) The owner of the land is responsible for
maintaining a safe site (barriers, fences, signs,
etc.) and complying with various provincial
regulations that may aPPIY;
k) have a survey map of the extraction site;
l) the extraction of material on the site will not
exceed a depth where water continually
accumulates over more than 5 centimeters for
a period spanning 12 months; however, in the
event of a continual accumulation of water
exceeding the above-mentioned criterion, the
operator responsible will completely cover the
accumulated water with material similar to that
of the extraction site until there is no more water
accumulation;
m) the owner of the land is responsible for limiting
the times of extraction operations to between
6:00 am and 9:00 pm.
125(4) Where extraction operations have ceased for
more than 10 months following expiry of the permit, or for
a longer period determined by the Commission or the
Municipality, the land shall be restored as followed:
a) removal of equipment, buildings and structures
related to the extraction work;

conformit6 avec le Rdglement du Nouveau-Brunswick
90-79; Lol sur /'ass ainissement de l'eau.
Lots sous-dimensionn6s existants
127(1) Une construction ou un bAtiment peut 6tre
6rig6, situe, deplac6, modifi6 ou reimplant6 sur un lot
qui ne satisfait pas aux dispositions du pr6sent article
ou i des dispositions pr6cisees dans des zones indivi-
duelles, si les exigences suivantes sont satisfaites:

can be put back into the excavation, spread out on
the site or removed from the site once the slope of
the excavation has been levelled to 30 degrees of
the horizon;
c) the site must be levelled and/or be sloped to
prevent the accumulation of water to a depth of
more than 60 centimetres at any time, except
during the snow melt period, and the site must be
free of debris from the project.
Drinkinq water protection
126(1) Lot servicing through the installation of a private or
public drinking water well must be done in compliance
with the New Brunswick Regulation 90-79; Clean Water
Act.
Existinq undersized lots
127(1) A structure or building may be erected, located,
moved, altered or relocated on a lot that does not meet
the provisions of this section or specified provisions in
individual zones, if the following requirements are met:

Kennels
129(1) Kennels are a specific use permitted in the
Resource Zone (RE) and Rural Residential (RR) for
which the Commission and Council may impose terms
and conditions subject to subsection 53(4) of the
Community Planning Act.
a) the land intended to accommodate a kennel must
be at least 12,000 square metres in area;
b) no building, structure or housing for animals shall
be located in the front yard;
c) no building, structure or shelter for animals is
permitted within 20 metres of an adjacent
property.
129(2) Under section 53(3Xc) of the Community
Planning Act, the Commission may issue terms and
conditions for the protection of the health, safety and
welfare of the general public, and the protection of
surrounding properties. Such terms and conditions may
include, but are not limited to:
a) standards of protection and safety for the public
and animals as set out in the document entitled "
A Code of Practice for Canadian Kennel
Operations ", 3rd Edition ,2018 (or its most recent
edition, if applicable) and published by the
Canadian Veterinary Medical Association;

130(1) Notwithstanding any other provision in this
Regulation and subject to section 130(2), it is prohibited
to develop a habitable area with less than 3.8 meters
(CGVD2O13) of elevation in relation to a flood plain,
wetland or watercourse.

i) the liveable or public space must be equal to or

ii)the permit application must be accompanied by
a plan showing the elevations of the building
space, as stated in 130(2)i);
iii) the minimum exempt elevation is free of any
opening in the foundation that may make the
building susceptible to water penetration;
iv) the foundation in 130(2)iii) constitutes an area
that cannot be made into a liveable space.
b) ln the case of an existing building, the building may
only be enlarged if the work does not reduce the minimum
elevation prescribed in this Regulation,

Standards for liveable/seasonal/moveable vehicles
131(1) Subject to this section, a trailer, caravan, motor
home or any other liveable vehicle shall not be installed,
except where it complies with this by-law.
131(2) The uses mentioned in 131(1) shall not:
(a) be within the front setback of the main building or
structure, except for installations in the driveway of the
property;
(b) be less than three (3) meters from a side or rear lot
line;
(c) have a period of activity exceeding sixty (60) days
during the summer,
(e) occupy the same space during storage as during the
period of activity;
(f) contravene applicable laws and regulations in the case
of connections to appropriate systems of the main

toute habitation r6sidentielle existante;

Multi-Family Residential (R3) and any commercial,
ind ustrial or community;
(v) exceed (3) units per 4000m2 of subdividable land in
the case of an installation exceeding a period of one (1)
year;
(vi) be considered a main building in residential zones
(Rl)and (R2), in these zones they may be considered as
an accessory dwelling unit with a maximum of one (1) unit
per property.
Green Enerqy
132(1) Where a wind energy system is a permitted use,
the
following provisions
aPPIY:
a) a wind energy system is subject to a site
plan/location at the time of application;
b) small wind turbines must be at least 1.5 times their
height from any highway, public or private right-of-
way and property line;
c) wind turbines, other than small wind turbines, must
be set back at least 550 metres from any existing
residential dwelling;

solar panels is permitted, the following provisions apply:

134 By-law No. 1 9-03 is rePealed
if the installation is not on a building roof and is
instead located on a platform or similar base, the
setbacks of an accessory building in the relevant
zone apply;
a solar panel system must adhere to relevant and
applicable provincial or national standards prior
to the issuance of the Permit.
i)
133(1) By way of variance and once certain conditions
have been established, a shipping container or a
commercial trailer without a hitch and without wheels
may be approved as an accessory building, except in
(R1), (R2), (R3) and (RM) zones. The variance may only
be granted if the Counciland the Commission determine
that there will be no negative impact on safety or other
important considerations for the community, and that
the visual impact on the neighborhood will be modest or
comparable to that of an accessory building.
