October 21, 2019 Village of Belledune Traffic Regulation By-Law By-Law #: TR - 11- 2003 A BY-LAW OF THE MUNICIPALITY OF BELLEDUNE TO REGULATE TRAFFIC. THE COUNCIL OF THE MUNICIPALITY OF BELLEDUNE DULY ASSEMBLED HEREBY ENACTS AS FOLLOWS; 1. In this By-Law "municipality" means the Village of Belledune "council" means the Mayor and Council of the Village of Belledune. MOTOR VEHICLE ACT 2. The definitions in Chapter M-17 of the Motor Vehicle Act Part 1 apply to this By-Law. TRUCK RESTRICTONS 3. (1) Excluding Provincial Highways (Route 134 & Route 11), no person shall operate any Vehicle registered with a gross mass of 4500 kilograms or more on any of the streets or portions thereof as listed here (a) Turgeon Road south of Highway 11 to Colony Road (b) Hodgins St. East north of Highway 134 to Curry Drive (2) The following vehicles are exempt from the provisions of subsection (1) (a) a vehicle defined as an emergency vehicle under Section 1 of the Motor Vehicle Act, R.S.N.B. 1973, c.M-17; (b) a vehicle transporting materials for the construction, repair or maintenance of any of the said streets or the construction or repair of water, sewer, power, or telephone services situated thereon; and collection of municipal solid waste (c) a vehicle transporting materials to or from a building or property fronting on any of the said streets; (d) passenger/family-type vehicles and buses. (3) The council shall cause "NO TRUCKS" signs to be erected on said streets (4) Every person is guilty of an offence under this By-Law who (a) erects, places, puts or maintains any building, structure, gasoline pump, lumber, logs, stones, snow or other encumbrance or obstruction over or upon any highway (b) alters any highway, or fills up or obstructs any ditch, water course or drain constructed for the purpose of carrying off water from a highway. (5) (a) When considered necessary or advisable the council may close temporarily, permanently or for a specified period of time any municipal street or portion of street by causing to be posted on the street or portion signs or notices to the effect October 21, 2019 that the street or portion is closed temporarily, permanently or for a specified period of time, and evidence of the existence on a street or portion of a street of a sign or notice to the effect that the street or portion is closed temporarily, permanently or for a specified period of time is proof, in the absence of evidence to the contrary, that the sign or notice was posted and maintained under the authority of the council and that the street or portion of the street is closed temporarily, permanently or for a specified period of time. (c) The council may limit the closing of municipal streets or portion thereof under subsection (a) to a specified class of motor vehicle. (6) The Council may, by motion, grant a temporary exemption not exceeding 36 months for the purpose of allowing the use of a road or street mentioned in paragraph (1) by a truck owner or a trucking company. PARADES AND PROCESSIONS 4. (1) No parades or other processions shall be held in the Village without first obtaining the written permission of the RCMP and the Village Council and before making notification to the District Transportation Engineer, within two weeks prior to the parade and conforming to all relevant safety factors. (a) The organizer is responsible to provide to the municipality, three week prior to the event, a written confirmation that they have considered and adequately addressed the following factors: - Potential for interruption/inconvenience of traffic flow - Alternate routes for detour purposes - Potential for accidents - Highway conditions and alignment - Fulfillment of safety standards - Availability of policing services - Availability of required signing for detour purposes SPEED LIMITS 5. (1) Excluding Provincial Highways (Route 134 & Route 11), no person shall drive a vehicle at a speed in excess of the signs posted. SNOW OR ICE ON STREETS 6. No person shall place snow or ice upon any street, sidewalk or square in such manner that impedes or is likely to impede movement of traffic or pedestrians. (Section 69, Highway Act) PENALTIES 7. Any person who violates section 3 of this By-Law is guilty of an offence and is liable to a summary conviction to a fine of $125.00 EFFECTIVE DATE 8. The present by-law comes into force when filed in the registry office.
