## BYLAW NO. W-1.1 ## A BYLAW RESPECTING WATER RATES AND SEWER RENTALS BE IT ENACTED by the Council of the Village of Bath under the Authority vested in it by the Municipalities Act, R.S.N.B. 1973, C.M.-22 as follows: ## 1.DEFINTIONS ## 1.01 In this Bylaw: "Committee means the Finance Committee of the Council. "Owner" means the person in whose name a property is assessed under the Assessment Act, Chapter A-14, R.S.N.B. 1973, and amendments thereto, and includes the executors, administrators and assigns of such person. ## 2. WATER RATES - 2.01 The owner of a property is liable for all water rates, meter rentals and sewer rentals imposed with respect to such property whether occupied by himself or his tenants and shall pay to the village all such rates and rentals at the times prescribed in this bylaw. - 2.02 (1) The owner of land on which there is a building located such that there is a water main available to service the building shall pay a quarterly service charge as established through the annual budget process per unitSee Appendix "A") regardless of whether or not the building receives service from the water main, and such sum shall be paid within 30 days after the billing date. - (2) The owner of a property, the water supply of which is metered, shall pay a commodity charge as established through the annual budget process, and such sum shall be paid within 30 days after the date of the billing. - (3) The owner of a property, the water supply of which is not metered, shall pay a quarterly flat rate commodity charge as established through the annual budget process (See Appendix "A") per unit and such sum shall be paid within 30 days after the date of billing. - (4) The water rates tor water purchased in bulk at a location approved by the Manager of Public Works for the purpose shall be 1.5 times the rate in 2.02(2). - 2.02 The owner of a property the water supply of which is metered shall pay to the Village quarterly at the same time as the water rates a meter rental in accordance with the following rates, where a meter rental is applicable. - 2.03 Where regular maintenance is done to a hydrant by village staff, such hydrant being on private property but connected to the village water system, the owner of the property shall pay an annual fee of $250.00, such sum to be paid within 30 days after the date of the billing. | Meter Size | Quarterly Rate | |--------------------------|------------------| | 20 millimetre or smaller | 2.00 | | 25 millimetre | 3.00 | | 40 millimetre | 6.00 | | 50 millimetre | 9.00 | | 75 millimetre | 30.00 | | 100 millimetre | 40.00 | | 150 millimetre | 60.00 | | 200 millimetre | 80.00 | ## 3. SPRINKLERS The owner of a building in which a sprinkler system for fire protection is installed and the owner of a property upon which a hydrant is located shall pay to the Village the cost of any repairs made or service provided by the village of such sprinkler or hydrant a the request of such owner. ## 4. SEWER - 4.01 The owner of land on which there is a building located such that there is a sewer main available to service the building shall pay a quarterly service charge as established through the annual budget process per unit (See Appendix "A") regardless of whether or not the building receives services from the sewer main, and such sum shall be paid within 30 days after the date of billing. - 4.02 The owner of a property the water supply of which is metered shall at the same time as the water rates for the property are payable, pay a commodity charge as established through the annual budget process on quarterly water meter readings. Where processes exist on the property which, in the opinion of the Manager of Public Works, can increase wastewater flows significantly beyond the metered volumes of water delivered to the property, the effluent shall be metered or measured for billing purposes, to the satisfaction of the Manager of Public Works. - 4.03 The owner of a property connected to the sanitary sewer, the water supply of which is not metered shall at the sane time as the water rates for the property are payable, pay a quarterly flat rate commodity charge as established through the annual budget process (See Appendix "A") per unit. ## 5. CONNECTION FEES - 5.01 The owner of a property is liable for all connection fee(s) imposed with respect to such property whether occupied by himself or his tenants and shall pay to the village such fees as prescribed in this bylaw. - 5.02 (1) The connection fee for water and sanitary sewer shall be Three thousand dollars ($3000.00) - (2) The connection fee for only water shall be Two thousand dollars ($2000.00) - (3) The connection fee for only sanitary sewer shall be Two thousand dollars($2000.00) ## 6. REFUNDS Upon application of an owner the Manager of Public Works may, with the approval of the Committee, grant a refund of rates or rentals or an allowance for any cause, which he deems proper. ## 1. FAILURE TO PAY The Manager of Public Works may shut off the water supply and or sewer supply to any property with respect to which any rates, rentals or penalties payable under this bylaw remain unpaid where: - 7.01 (1) 30 days have elapsed from the date of billing. - (2) after the expiration of the 30 day period above mentioned, the clerk has sent a notice by ordinary mail to the owner which states that, if outstanding amounts are not paid by the date and time established in the notice, the water and or sewer supply shall be shut off; and - (3) the amounts owing remain unpaid at the expiration of the date and time established in the above notice. - 7.02 Where a notice of shut off has been given under Section 7.01, the owner shall be charged a fee of fifteen dollars ($15.00), regardless of whether the arrears are paid on or before the date and time established in the notice, or alternative arrangements for payment are made. - 7.03 Where a notice of shut off has been given under Section 7.01, and the account remains unpaid by 12:30 p.m. of the date established for shut off, the owner shall pay a fee of seventy five dollars ($75.00), together with any amount in arrears to settle the account in full regardless of whether a physical shut off has been accomplished. ## 8. SERVICE CHARGES - 8.01 All user charges or portion thereof remaining unpaid after the due date, shall be considered delinquent and subject to an interest charge of 1.53% per month (19.99% compounded annually). - 8.02 All legal costs associated with collection of past due accounts shall be included with water and sewer charges and shall be payable in accordance with applicable section of this bylaw. ## 9. REPEAL PROVISIONS - 2.01 ByLaw W-1, A bylaw Respecting Water and Meter Rates and amendments thereto, given third reading May 10, 2010, is hereby repealed. - 9.02 The repeal of Bylaw W-1, A Bylaw Respecting Water and Sewer Rates, Shall not affect any penalty, forfeiture or liability incurred before such repeal or any proceedings for enforcing the same completed or pending at the time of repeal nor shall it repeal, defeat, disturb, invalidate or prejudicially affect any matter or thing whatsoever completed existing or pending at the time of repeal <!-- image --> <!-- image --> READ FIRST TIME READ SECOND TIME READ THIRD TIME AND ENACTED August 15, 2011 August 15, 2011 September 19, 2011 SIGNED: MAYOR CHolmes.
