ARRÊTÉ CONCERNANT LES COLPORTEURS ET
LES MARCHANDS AMBULANTS
DANS LA VILLE DE DIEPPE
En vertu des pouvoirs que lui confère la Loi sur la
gouvernance locale, chapitre 18, le conseil de la Ville
de Dieppe, dûment réuni, adopte ce qui suit :
1. DÉFINITIONS
Dans le présent arrêté :
«agent chargé de l'exécution des arrêtés» signifie
une personne nommée par le conseil municipal
pour assurer l'application du présent arrêté; (By-
Law Enforcement Officer)
« cantine mobile » signifie une camionnette
spécialement équipée pour fournir un service de
cantine, sans espace de cuisine intérieur, tel
qu'illustré à titre d'exemple en annexe C ; (coffee
truck)
«colporteur» signifie toute personne qui vend de
porte à porte des articles ou marchandises;
(pedlar)
«commerçant
de
Dieppe»
désigne
une
corporation qui exerce des activités de commerce
au détail de marchandises ou de nourriture dans
un commerce ou un restaurant situé à l'intérieur
des limites de la municipalité; (Dieppe business
person)
«marchand ambulant» signifie toute personne,
entreprise, société de personnes ou association
qui se livre temporairement à la vente d'articles,
de marchandises ou de nourriture dans la
municipalité; (transient trader)
«municipalité» désigne la Ville de Dieppe;
(Municipality)
«permis» signifie un permis de colporteur ou de
marchand ambulant et tout renouvellement de

A BY-LAW RELATING TO PEDLARS
AND TRANSIENT TRADERS
IN THE CITY OF DIEPPE
Pursuant to the authority vested in it by the Local
Governance Act, Chapter 18, the Council of the
Municipality of Dieppe, duly assembled, enacts as
follows:
1. DEFINITIONS
In this by-law :
"By-Law Enforcement Officer" means a person
appointed by the Municipal Council to enforce the
provisions of this by-law; (agent chargé de l'exécution
des arrêtés)
"mobile canteen" means a pick-up truck specially
equipped to provide a canteen service, with no inside
cooking space, as illustrated by way of example in
Appendix C; (cantine mobile)
"pedlar" means any person who sells from door to
door goods or merchandise; (colporteur)
"Dieppe business person" means a corporate entity
conducting retail trade in merchandise and/or food
in a business or restaurant located within the
boundaries of the Municipality; (commerçant de
Dieppe)
"transient
trader"
means
any
person,
firm,
corporation, partnership or society who engages in a
temporary business of selling merchandise and/or
food within the Municipality; (marchand ambulant)
"Municipality"
means
the
City
of
Dieppe;
(municipalité)
"licence" means a pedlar's or a transient trader's

PERMIS
(1) Nul ne doit se livrer aux activités de
colporteur ou de marchand ambulant dans la
municipalité sans disposer d'un permis valide
délivré conformément au présent arrêté.
(2) La période de validité d'un permis est de
trente (30) jours.
(3) Le permis est incessible.
3.
DEMANDE DE PERMIS
(1) La demande d'un permis de colporteur ou de
marchand ambulant doit être présentée par
écrit au Secteur d'exécution des arrêtés au
moyen du formulaire prescrit, au moins cinq
(5) jours ouvrables avant la date du début des
activités visées.
(2) La demande d'un permis de marchand
ambulant doit comprendre une lettre de
consentement du propriétaire du ou des
terrains où l'activité aura lieu et un document
qui démontre l'adresse commerciale ou
résidentielle à Dieppe, à la satisfaction de la
municipalité.
(3) Une demande de renouvellement d'un
permis de colporteur ou de marchand
ambulant doit être présentée au plus tard,
deux (2) jours ouvrables avant la date
d'échéance du permis.
(4) La période de validité d'un permis renouvelé
commence le lendemain du dernier jour de
validité du permis antérieur.

"resident" means a natural person having a principal
place of residence within the boundaries of the
municipality; (résident)

LICENCE
1)
No person shall engage in business as a pedlar or
a transient trader within the Municipality
without having a valid licence issued under this
by-law.
(2) A licence is valid for thirty (30) days.
(3) The licence is not transferable.
3.
APPLICATION FOR A LICENCE
(1) An application for a pedlar's or transient trader's
licence shall be submitted in writing to the By-
law Enforcement Division, on the prescribed
form, at least five (5) working days prior to the
commencement date of the activities.
(2) The transient trader shall submit a letter of
consent from the owner of the property or
properties where the activity will take place and
a document indicating the commercial or
residential address in Dieppe, to the satisfaction
of the municipality.
(3) An application for renewal of a pedlar's or
transient trader's licence shall be submitted at
least two (2) business days before the licence
expires.
(4) The validity period for a renewed licence starts
the day after the previous licence expires.

4.
DÉLIVRANCE DE PERMIS
(1) Les permis sont délivrés par le Secteur
d'exécution des arrêtés.
(2) La municipalité de Dieppe peut limiter, en
n'importe quel temps, le nombre de permis
délivré.
5. RESPONSABILITÉS DU DÉTENTEUR DU PERMIS
Tout permis délivré aux termes du présent arrêté
doit être affiché bien en vue aux endroits nommés
dans ledit permis, ou le détenteur d'un permis doit
rendre disponible ce permis à la demande de
l'agent chargé de l'exécution des arrêtés.
6.
FRAIS DE PERMIS
Les frais de permis sont énoncés à l'Annexe B ci-
jointe et doivent être acquittés avant l'émission
du permis.
7.
EXCEPTIONS
Le présent arrêté ne s'applique pas :
(1) à une personne qui vend de porte à porte des
fruits, des légumes, de la viande ou d'autres
produits provenant de sa ferme ou de son
jardin;
(2) au pêcheur qui vend de porte à porte le
poisson, les huîtres ou tous autres fruits de
mer qu'il a pêchés lui-même;
(3) aux
personnes
employées
par
des
associations
de
tempérance
ou
de
bienfaisance ou des associations religieuses
de la province, qui colportent ou vendent des
brochures sur la tempérance ou d'autres
publications morales ou religieuses sous la
direction de ces associations, à l'exclusion de
tous autres objets ou marchandises;
(4) aux marchands ambulants
4.
ISSUANCE OF LICENCE
(1) Licences are issued by the By-Law Enforcement
Division.
(2) The Municipality of Dieppe may limit the number
of licences issued at any given time.
5.
RESPONSIBILITIES OF LICENCE HOLDER
A licence issued under this by-law shall be posted
conspicuously in the places of business named
therein or the licence holder shall present this licence
on demand to the by-law enforcement officer.
6.
LICENCE FEES
The licence fees are set out in Appendix "B" attached
and shall be paid before the licence is issued.
7.
EXCEPTIONS
This by-law does not apply:
(1) to a person who goes from door to door selling
fruits, vegetables, meats, or other products
harvested from his farm or garden;
(2) to a fisherman who goes from door to door
selling fish, oysters, or any other seafood
harvested by him from the sea;
(3) to persons employed by a temperance,
benevolent or religious organization in the
province who peddle or sell temperance tracts or
other moral or religious publications under the
direction of such organizations, to the exclusion
of other goods or merchandise;
(4) to transient traders

a)
qui ont une entente avec la municipalité

événement organisé par un organisme

(5) aux cantines mobiles stationnées sur les sites
de construction ou en zone industrielle.
8.
INFRACTIONS
(1) Quiconque contrevient à l'une ou l'autre des
dispositions du présent arrêté est coupable
d'une infraction et passible, sur déclaration de
culpabilité, d'une amende d'au moins trois
cent cinquante dollars (350 $) et d'au plus
deux mille cent dollars (2 100 $), et ce,
multipliée par le nombre de jours que dure
l'infraction.
(2) Quiconque omet de se conformer à une
disposition du présent arrêté pourra voir son
permis être révoqué par un agent d'exécution
des arrêtés, sur place ou par avis signifié de
façon suffisante au colporteur ou au
marchand ambulant, remis en personne ou
envoyé,
par
courrier
recommandé
et
affranchi, à sa dernière adresse connue ou à
son dernier établissement connu. La
signification
de
l'avis
par
courrier
recommandé est réputée avoir été effectuée
quatre (4) jours après la mise à la poste de
l'avis.
(3) Quiconque contrevient à l'une ou l'autre des
dispositions du présent arrêté peut être jugé
inéligible pour un nouveau permis ou pour un

organized by an agency accredited by the
Municipality in accordance with the municipal
policy

accreditation
of
community
organizations; or
c) who are participating in an activity or event
organized by a private organization that has
rented space on municipal grounds for this
activity or event;
(5) to mobile canteens parked on construction sites
or in an industrial zone.
8.
VIOLATIONS
(1) A person who violates any provision of this by-
law is guilty of an offence and liable on
conviction to a minimum fine of three hundred
fifty dollars ($350) and a maximum fine of two
thousand
one
hundred
dollars
($2,100)
multiplied by the number of days during which
the offence continues.
(2) Anyone who fails to comply with a provision of
this by-law may have their license revoked by a
By-Law Enforcement Officer, on site or by notice
sufficiently served on the pedlar or transient
trader, delivered in person or mailed prepaid
registered post to the last known residence or
place of business of the pedlar or transient
trader. Service of the notice by registered post
shall be deemed to have been effected four (4)
days after the notice was mailed.
(3) A person who violates any provision of this by-law
may be deemed ineligible for a new licence or for

renouvellement de permis existant pour une

9.
ABROGATION
L'arrêté nº P-2 intitulé « Arrêté concernant les
colporteurs et les marchands ambulants dans la
Ville de Dieppe », fait et adopté le 13 mars 2017,
et toutes ses modifications, est abrogé.
10. INTERPRÉTATION
Aux fins d'interprétation du présent arrêté, le
masculin comprend le féminin, et le singulier
comprend le pluriel, selon les exigences du texte.

years.
9.
REPEAL
By-Law No. P-2 entitled "A By-Law Relating to Pedlars
and Transient Traders in the City of Dieppe", ordained
and passed on March 13, 2017, and all amendments
thereto, is repealed.
10. INTERPRETATION
For purposes of interpreting this by-law, words
importing the singular number include the plural and
words importing the masculine gender include the
feminine gender.

Annexe A
Frais de permis
Groupe A :
Un commerçant de Dieppe utilisant son propre
véhicule de marchand ambulant : aucun frais
Groupe B :
Un commerçant de Dieppe désirant accueillir sur son
terrain divers marchands ambulants :
200 $ par tranche de 30 jours, payable au plus tard le
jour ouvrable précédant le début des activités. Cette
catégorie de permis permet au commerçant de Dieppe
titulaire du permis d'accueillir sur son terrain divers
marchands ambulants, mais un seul marchand
ambulant à la fois, pendant toute la période de validité
du permis.
Pour
chaque
marchand
ambulant
additionnel, un permis additionnel est requis.
Groupe C :
Résidents :
200 $ par tranche de 30 jours, payable au plus tard le
jour ouvrable précédant le début des activités.
Autres que Groupes A, B & C :
300 $ par tranche de 30 jours payable au plus tard le
jour ouvrable précédant le début des activités.
Appendix A
Licence Fees
Group A:
Dieppe business people using their own vending vehicle :
no fee
Group B:
Dieppe business people who wish to welcome various
transient traders on their lot:
$200 per 30-day period, payable no later than on the
working day preceding the start of the activities. This
category of licence allows for Dieppe business people, who
hold a licence, to welcome multiple transient traders onto
their property, but only one at a time, for the entire period
of validity of the licence. For additional transient traders,
an additional licence is required.
Group C:
Residents:
$200 per 30-day period, payable no later than on the
working day preceding the start of the activities.
Other than Groups A, B & C:
$300 per 30-day period, payable no later than on the
working day preceding the start of the activities.
