| **BY-LAW NO. EC-06****A BYLAW OF THE MUNICIPALITY OF EASTERN CHARLOTTE****ALL-TERRAIN VEHICLES ON MUNICIPAL ROADS** |

| Pursuant to the powers conferred by the *Off-Road Vehicle Act*, S.N.B. 1985, c. O-1.5 and its amendments, the Council of the municipality of Eastern Charlotte duly assembled enacts as follows: **TITLE** This By-Law will be cited as the "All-Terrain Vehicle (ATV) By-Law". **DEFINITIONS** "All-Terrain Vehicle" means all vehicles included in the definition of "All-Terrain Vehicle" as defined in the aforementioned *Off-Road Vehicle Act*, with the exception of amphibious vehicles and snowmobiles, may be simplified as "ATV". **GENERAL PROVISION** 1. All-terrain vehicles may be driven along portions of local streets/roads in the community of St. George, as set out in Section 2 and Section 3, at a speed not exceeding 40 km/hr or otherwise as posted. 2. All-terrain vehicles may be driven, in the community of St. George, on the full length of Main Street between the civic addresses of 1 and 152; the portion of Portage Street to connect from Main Street to Wallace Street; the full length of Wallace Street; and, a portion of Brunswick Street between the civic addresses of 1 and 176, as set out in the Schedule "A". 3. All-terrain vehicles may be driven, in the community of St. George, on a portion of Manor Road between the civic addresses of 140 and 234, as set out in the Schedule "B". 4. Schedule "A" & Schedule "B" form an integral part of this by-law, and display the route permitted for travel under this by-law. 5. All-terrain vehicles are allowed to travel as specified above under the following conditions: a. Have a valid Trail Permit as required under the Province of New Brunswick's *Off-Road Vehicle Act* (SNB 1985, c O-1.5) or a valid permit from another Province member of a reciprocal agreement with New Brunswick, this permit being in the form of a sticker which must be clearly and permanently displayed on the ATV or side-by-side. b. The driver must be able to provide on request a valid registration document, an insurance document for the vehicle, and a visible license plate with a valid sticker must be visible. c. No person shall operate an all-terrain vehicle on the route outlined in Section 2 and Section 3 unless they are in possession of a valid driver's license. d. Respect all regulations specified in the Province of New Brunswick's *Motor Vehicle Act* (RSNB 1973, c. M-17) as they apply to the *Off-Road Vehicle Act* (SNB 1985, c O-1.5). 6. The driver or any occupant of the all-terrain vehicle must be properly wearing a helmet that complies with the standards prescribed by Regulations under the Province of New Brunswick's *Motor Vehicle Act* (RSNB 1973, c. M-17). 7. The all-terrain vehicle must be outfitted with the necessary equipment as described in Section 22 and Section 23 of the Province of New Brunswick's *Off-Road Vehicle Act* (SNB 1985, c O-1.5). 8. All-terrain vehicles must operate in the same direction as traffic and travel in a single file to the extreme right of the street. 9. All-terrain vehicles shall give the appropriate signals as required under the *Motor Vehicle Act* (RSNB 1973, c. M-17) and obey all traffic control devices. 10. Any other vehicle utilizing the street shall have the right of way. 11. All-Terrain vehicles are not permitted on municipal administered trails that are primarily designated for walking or cycling and prohibited from operating on sidewalks. 12. All-Terrain vehicles driving on local roads within the municipality of Eastern Charlotte other than the route(s) outlined within shall be subject, but not exclusive, to penalties under Section 14. 13. Portions of the route outlined in Section 2 and Section 3 of this By-Law are subject to a Provincial Highway Usage Permit. **OFFENCE** 14. Anyone who violates this by-law commits a punishable offence and is liable to a fine of $100.00, in addition to any fine under the Province of New Brunswick's Off-Road Vehicle Act (SNB 1985, c.
